Should the Mayor and City Commission approve a Special Exception for Amoco Petroleum Products?
BACKGROUND:
This proposed Amoco convenience store with gas sales is located at the northeast corner of the intersection
of Clarke Road and Silver Star Road. The property is zoned C-2 which permits the proposed use as a
Special Exception. The subject property is part of a two -lot commercial subdivision which is currently
undeveloped. Both the northwest and southwest corners of the intersection also have C-2 zoning and have
been developed as shopping centers with outparcels. The southeast corner of the intersection is not within
the City Limits and is currently undeveloped; however, it is currently the subject of an annexation
application. The new library and at least one other commercial use are anticipated to be developed on that
property within the next few years.
Policy 6.8 in the Future Land Use Element of the Comprehensive Plan states that "Where commercial
development is allowed at the intersection of major roads, no more than (2) two quadrants will be approved
for gas stations or auto -related activities." There is an existing Exxon station with a convenience store
located at the southwest corner of this intersection. The proposed Amoco station will be the second such
station at this intersection.

Approval of a Special Exception typically includes a Preliminary Plan and a list of conditions of approval for
the Special Exception. One of the main issues discussed during the review of this application was an
existing 36 inch oak tree and efforts to preserve that tree. Planning Department staff worked closely with the
site designers to rework the site to preserve the tree. However, due to the location of the tree on the site, it
was necessary to move the gas pump island canopy 10' into the required 50' building setback from Clarke
Road. The Planning Department feels that the benefit of saving the 36' oak tree justifies the 10'
encroachment into the required 50' building setback from Clarke Road.
All of the usual Special Exception conditions of approval have been incorporated into this Preliminary Plan.
However, approval of the Amoco Petroleum Products Special Exception as currently submitted (plans
received October 6, 1997) will require a waiver to the requirement for a 50' building setback from Clarke
Road, in order to preserve the existing 36 inch oak tree on the site.
The attached Preliminary Plan for this Special Exception for Amoco Petroleum Products was reviewed by the
Development Review Committee (DRC) on September 23, 1997. The Committee voted unanimously to
recommend approval of the proposed Preliminary Plan and Special Exception for Amoco Petroleum
Products, including the waiver to the 50' building setback from Clarke Road in order to preserve the existing
36 inch oak tree on the site.
PLANNING & ZONING COMMISSION MEETING AND RECOMMENDATION:
On October 14, 1997, the Planning and Zoning Commission held a public hearing on this Special Exception
for Amoco Petroleum Products. During the public hearing, the developer's representatives were present but
did not speak because staff was able to answer all the questions asked by the Commission. Two people from
the audience spoke. One was concerned about possible needs for future right-of-way, and the other was
concerned about the possibility of another gas station at the southeast corner. However, staff s responses
appeared to address their concerns adequately and there was no opposition to the Special Exception. After a
brief discussion, the Planning and Zoning Commission voted unanimously to recommend approval of the
Special Exception for Amoco Petroleum Products, in accordance with staffs recommendation.
STAFF RECOMMENDATION:
Based on the recommendations of the DRC the Planning and Zoning Commission, Staff respectfully
recommends that the Mayor and City Commissioners approve a Special Exception for Amoco
Petroleum Products, to be built according to the attached Preliminary Plan date stamped received by
the City on October 6, 1997, including a waiver to the 50' building setback from Clarke Road in order
to preserve the existing 36 inch oak tree on the site.
