West Oaks Mall PUD Land Use Plan
Conditions of Approval Amendment
Project # 94-011
ISSUE:
Should the Mayor and City Commission adopt Ordinance # 97-31, which will amend Condition
11 in the Land Use Plan Conditions of Approval for the West Oaks Mall PUD, and approve
corresponding changes to the Development Agreement, the Final Subdivision Plan and the Final
Site Plan for West Oaks Mall?
BACKGROUND:
Due to the size of the Lake Lotta Mall DRI (also known as the West Oaks Mall), the proposed
changes described in the previous agenda item require review and approval at both the state and
local levels. Ordinance # 97-31 would amend the local zoning approval for the West Oaks Mall
PUD to allow the Mall to implement the proposed changes described in the previous agenda item.
This change will also require amendments to the Development Agreement, the Final Subdivision
Plan and the Final Site Plan.
To summarize, the proposed change would allow an increase of 35,000 square feet in the total
square footage of the theater area for a total of 95,000 square feet GLA, and increase the total
number of seats permitted by 2,000 for a total of 5,000 seats. At the same time it would reduce
the total amount of permitted Shopping Center Space by 45,500 square feet.

DISCUSSION:
If adopted, Ordinance # 97-31 will amend Condition 11 in the Land Use Plan Conditions of
Approval for the West Oaks Mall PUD. The Conditions of Approval for the PUD were listed on
Sheet 6 of 14 in the plan set approved with the original PUD. Most of those conditions were
taken directly from the Conditions of Approval in the DRI Development Order. Condition 11 in
the PUD Conditions of Approval addresses floor area and has wording which is essentially
identical to Condition 3 in Part II.A. of the DRI Development Order.
An amended Sheet 6 of 14 listing all the PUD Conditions of Approval is included in the agenda
package. The emphasis of these changes is to allow the Mall to exchange some of the square
footage originally approved as Shopping Center Space for the proposed additional theater space,
as described above. Corresponding changes are proposed for the Development Agreement for the
Mall, the Final Subdivision Plan and the Final Site Plan. Copies of the Third Amendment to the
Development Agreement and the amended Subdivision and Site Plans are included in the agenda
package. All the proposed amendments will be subject to the amendment to the DRI
Development Order becoming effective.
The proposed amendment to Condition 11 was reviewed by the Development Review Committee
(DRC) on September 23, 1997. The Committee voted unanimously to recommend approval of
this amendment to the Land Use Plan Conditions of Approval for the West Oaks Mall PUD.
PLANNING & ZONING COMMISSION MEETING AND RECOMMENDATION:
On October 14, 1997, the Planning and Zoning Commission held a public hearing on the proposed
amendment to Condition 11. During the public hearing, the developer's representatives were
present to answer questions. There was no opposition to the proposed amendment. After a brief
discussion, the Planning and Zoning Commission voted unanimously to recommend approval of
the proposed amendment to Condition 11 of the Land Use Plan Conditions of Approval for the
West Oaks Mall PUD, in accordance with staffs recommendation.
Since the proposed changes to the West Oaks Mall PUD, the Development Agreement, the Final
Subdivision Plan and the Final Site Plan are all the same, the City Commission can vote to take
action on all four items simultaneously. In other words, the City Commission will vote only once
on all four items, rather than taking four separate votes.

STAFF RECOMMENDATION:
Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff
respectfully recommends that the Mayor and City Commission take the following actions:
• Adopt Ordinance # 97-31, which will amend Condition 11 (Sheet 6 of 14) of the Land
Use Plan Conditions of Approval for the West Oaks Mall PUD, finding .that it is
consistent with the Ocoee Comprehensive Plan,
• Approve the Third Amendment to the Development Agreement for the West Oaks
Mall,
• Approve the corresponding amendment to the Final Subdivision Plan for the West
Oaks Mall,.
• Approve the corresponding amendment to the Final Site Plan for the West Oaks
Mall, and
• Making all four of the above approvals subject to the First Amendment to the Lake
Lotta Mall DRI Development Order becoming effective.
