PARKER CITY MANAGER ELLIS SHAPIRO As discussed at our last City Commission meeting, the Employee Committee by straw ballot asked the employees of the city whether they wished for the City Commission to set the Christmas holidays dates based upon the calendar or continue December 24``1 and 25`h as it is currently in our Rules and Regulations. Pursuant to the attached memo from Alice Tate Barnett of the Employee Committee, the final vote was 105 in favor of the City Commission setting the date, fifty-six people opposed and five no votes. As a result of this ballot it is respectfully requested the second reading of Ordinance #9732 be held and approved. The results are as follows: 105 Yes, I would like to change the Christmas Eve, December 24, holiday to the day after Christmas, December 26, on the years that December 24, falls on Wednesday. 56 No, I want to keep Christmas Eve, December 24, off no matter what day it falls on. 5 Did not vote, but turned in their opinion. PARKER CITY MANAGER ELLIS SHAPIRO Currently our holiday schedule for employees include Christmas Eve and Christmas Day. For most of the years these days fall at such a time that gives our employees a good holiday break. However, sometimes, like this year, Christmas Eve falls on Wednesday and Christmas Day on Thursday. This means that employees will then return on Friday and then be off for the weekend. This means that between vacation and absenteeism, December 26, 1997,. will not be a very efficient day of work in our community. Several employees have asked whether the City Commission might be able to set the Christmas holiday days dependent on when they fall in the week. In discussing this with Paul Rosenthal, City Attorney, he advised me that since the Rules and Regulations were by ordinance, an ordinance would have to be adopted to make the above discussed changes. Furthermore, at budget time, the City Commission agreed to add Martin Luther King's birthday as an official holiday in the City. This change is also included in the attached ordinance prepared by City Attorney Rosenthal for your review and action. DAY AS AN OFFICIAL CITY HOLIDAY AND TO CHANGE THE CHRISTMAS EVE HOLIDAY TO EITHER THE . DAY BEFORE OR THE DAY AFTER THE CHRISTMAS DAY HOLIDAY; PROVIDING FOR SEVERABILITY;- PROVIDING EVERABILITY;PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Ocoee desires to amend the City of Ocoee Personnel Rules and Regulations adopted in Ordinance No. 93-I8, as amended by Ordinance Nos. 95-27, 97-05, and 97-29, to revise the schedule of holidays. NOW, THEREFORE, BE IT ENACTED BY THE CITY COI -Y V1ISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII.of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Section 8.01 of Article 8 of the City of Ocoee Personnel Rules and Regulations is hereby amended to read as follows: 8.01 Days Observed A. When a holiday falls on Saturday or Sunday, the Friday preceding . or Monday following shall be designated, a substitute holiday and observed as the official holiday. B. The observed holidays are: January 1 New Year's Day January - 3rd Monday Martin Luther King, Jr. Day May - Last Monday July 4 September - First Monday November - Fourth Thursday November - Day after Thanksgiving L ree3 3IIICi ... b 2 � December - Day before or after Christmas Dav Holiday as determined by City Commission December 25 Two (2) Personal Days Memorial Day Independence Day Labor Day Thanksgiving Day Christmas Day C. The City Manager will determine which departments or operations will be closed in observance of the holiday. (Additions underlined; deletions are shown by strike thru). SECTION 3. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct. and independent provision and such holding shall not affect the validity of the remaining portion. hereto. SECTION 4. Codification. It is the intention of the City Commission of the City that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter", "section", "article", or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the code is accomplished, sections of this Ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be 2 authorized by the City Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk.
