MEMORANDUM
TO: Honorable Mayor and City Commissioners of the City of Ocoee
FROM: Paul E. Rosenthal, Esq., City Attorney . /'1
DATE: November 14, 1997 l
RE: Referendum Date for Consideration of Charter Amendments
At the meeting of August 19, 1997 the City Commission considered the Report
of the Charter Review Commission and accepted certain of the recommendations for Charter
Amendment. At that time, no specific direction was given regarding the timing of any such
referendum. Additionally, a comment was made regarding the possibility of a mail ballot. In
order to prepare the ordinance for the proposed Charter Amendments, it is necessary to receive
direction regarding the scheduling of the referendum.
The following options are available for the City Commission:
(1) Schedule the referendum for consideration at the March 10 General
Municipal Election. This would require that the polls be opened in all of the Districts, rather
than just the two Districts in which City Commission elections will be held.
(2) Schedule a special election and designate the date of such election. This
date would need to be coordinated with the Supervisor of Elections in order to assure that there
is no conflict.
(3) Schedule the election for the March 1999 General Municipal Election
which will include a City-wide mayoral race.
(4) Hold the referendum utilizing a City-wide mail ballot in May 1998 (before
the summer vacation season) or September 1998 (after the summer vacation season). The
scheduling of a mail ballot would need to be coordinated with the calendar of the Supervisor of
Elections.
It is requested that direction be given regarding this matter.
