This Resolution supporting the "Taxpayer Protection Act" was prepared in response to
your direction at the joint meeting with Apopka and Winter Garden.

RESOLUTION NO. 97-14
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OCOEE, FLORIDA IN SUPPORT OF THE PASSAGE BY THE FLORIDA
LEGISLATURE OF HOUSE BILL NO. 729 (HB 729) KNOWN AS THE
"TAXPAYER PROTECTION ACT," PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, unfunded State mandates on local governments have increased significantly in
recent years; and
WHEREAS, State mandates require cities and counties to perform duties without
consideration of local circumstances and costs; and
WHEREAS, the cumulative impact of legislative and regulatory actions directly affects the
citizens of our cities and counties; and
WHEREAS, the City desires to protect the Home Rule ability of every city to effectively
and locally manage employee salary and benefit packages in the best interests of taxpayers as well
as employees; and
WHEREAS, House Bill No. 729 provides that any general law enacted by the Legislature
after January 1, 1998, which will potentially increase the cost of city or county personnel salaries,
wages or benefits must include an economic impact statement which estimates the total cost to cities
or counties prepared prior to passage of legislation; and
WHEREAS, House Bill No. 729 will bring into law a method for determining the cost to
local governments of implementing the proposed legislation; and
WHEREAS, House Bill No. 729 will provide a comparison of the probable costs and
benefits of the proposed legislation to the probable costs and options for the means to finance the
potential increase and benefit of not adopting the legislation; and
WHEREAS, a Tri-City meeting was held November 10, 1997, and officials from Apopka.
Ocoee, and Winter Garden agreed to support the passage of House Bill No. 729,
NOW, THEREFORE, BE IT RESOLVED, by the City Commission of the City of Ocoee,
Florida that:
1. The City of Ocoee endorses House Bill No. 729; and
2. The City calls on the Legislature of the State of Florida to enact the "Taxpayer
Protection Act" as set out in House Bill No. 729; and
3. The local governments of the State of Florida are urged to adopt a resolution to
urge the Legislature to pass House Bill No. 729 to set standards for economic impact statements to
prevent negative impacts of general law that affect local governments' budgets without full
disclosure of the financial impact; and
4. Copies of this resolution be provided to the appropriate officials.
PASSED AND ADOPTED by the City Commission of the City of Ocoee, Florida,
this day of November, 1997.
