GLASS JIM GLEASON CITY MANAGER ELLIS SHAPIRO Orlando District Board of Missions of the United Methodist Church intends to file an Annexation Application for 7.71 acres it owns on the east side of Clarke Road north of White Road. Pastor Post has requested that the City Commission waive the required $250 Annexation Application flat fee per the attached letter. Additionally, a rezoning application will be required for this site to bring it into conformance with the Land Development Code; therefore, the Commission should consider waiving all related rezoning fees also. In the past, the City Commission has granted fee waivers for rezonings and special exceptions which were initiated by church sponsors. This has included the Reformed Presbyterian Church in 1988, St. Paul's Presbyterian Church in 1990 and 1992, Glad Tidings Assembly of God in 1994, Winter Garden Seventh Day Adventist Church in 1994, Christian Service Center of Central Florida in 1995, and Celebration Baptist Church in 1996. This is a fairly common practice by other local governments, although the City's Land Development Code does not specifically address such waivers. Staff Recommendation: Staff recommends that the Honorable Mayor and City Commissioners approve a waiver of all annexation and rezoning fees related to the West Oaks United Methodist Church. We own 7.71 acres on Clarke Road, just north of the water tower, parcel #21-22-28-0000-00-022. We plan to place a church there in the years ahead and would like to annex into the city. We are requesting a waiver on the annexation fee of $250.00. The property is currently zoned A-1 in Orange County. We would ask that the zoning stay as it is A-1.
