This change order request was initiated by City staff because this work was not included in the project specifications and is required prior to startup and tic-in of the wells. In accordance with Florida Department of Environmental Protection regulations, Section 62-555, all new wells to be used for drinking water are to be operated for a set period of time and bacteriological samples collected for analysis. Upon collection of twenty consecutive samples that show no evidence of bacteriological contamination the wells can be connected to the "system"and used for the production of drinking water. The work actually includes the installation of temporary piping to the nearest stormwater system.the operation of each well twice a day for at least twenty minutes, the collection of the samples and their subsequent analysis by a certified testing laboratory. The wells were drilled under a separate contract with Diversified Drilling, Inc. The well installation was completed in August of 1995. This bacteriological testing was not included in Diversified's contract because they did not install the permanent pumps and this procedure would have to be repeated at the time of connection to the"system" when the plant contractor was completed with the other improvements. Unfortunately, the performance of the bacteriological testing work was not included in Wharton- Smith's contract. This error was not discovered until Wharton-Smith was in the process of Olt THE PRIDE OF WEST ORANGE performing the hydraulic and bacteriological testing of the new yard piping and ground storage tanks which were installed under their contract. The costs to perform this work are reasonable and are not excessive in regards to negotiating this change order. Many different scenarios involving the temporary piping were researched and costs estimated before arriving at the most efficient and economical option. In addition, Wharton-Smith has offered to perform the work at cost, with no markup for profit and overhead. Staff believes that the proposed $8,036.00 cost to perform this work is representative of the amount the City would have paid, had this work been included in this project's bidding documents. PEC has assumed responsibility for the oversight in not including the work description in the bidding documents. PEC has offered to share in this particular construction change by providing assistance at no cost to the City and has agreed to reimburse the City$5,000.00 of the $8036.00 change order construction cost. If this arrangement is acceptable to the Commission, these costs will be deducted from PEC's contract amount and transferred to Wharton-Smith's construction account. The attachment is a copy of the change order; the backup is available should the Commission want to review it and it is attached to the original Change Order forms. the current contract price including change order No. 2 is $2,602,897.65 (the original contract price was $2,304,000.00). This change order constitutes an increase of 0.35 percent over the original contract price. The new contract price will be $2,610,933.65. No increase in contract time was allowed for this additional work. The funds for this change order will come from the project's construction contingency. I recommend that the City Commission approve Change Order No. 3 by increasing the contract amount by $8,036, with no extension in contract time, and authorize the Mayor and City Clerk to execute Change Order No. 3. Work includes the installation of temporary piping from each well to the nearest stormwater system,set periodic operation of each well and the collection of bacteriological samples for at least ten (10) days. III. JUSTIFICATION Item 3-A Item 3-A Disinfection and bacteriological surveys required per FDEP Permit (see attached FDEP Permits for the new wells at the Forest Oaks WTP and the South WTP). This work is not included with the installation of the wells because the regulation require this testing to be performed just prior to bringing the wells on line. The wells were constructed last year under sperate contract. IV. NARRATIVE OF NEGOTIATIONS Items 3-A Item 3-A Request For Proposal (RFP) No.9 was issued to the Contractor on January 13, 1997. Cost Proposal Summary (CPS) No. 9 was submitted on January 17, 1997. Engineer recommended acceptance of CPS No. 9 to the Owner on January 21, 1997. Owner accepted CPS No. 9 on January 27, 1997 (RFP No. 9 and CPS No. 9 attached). VI. APPROVAL AND CHANGE AUTHORIZATION This proposed change to the Contract is to be approved by the Ocoee City Commission. • 2 Acknowledgments: The aforementioned change, and work affected thereby, is subject to all provisions of the original contract not specifically changed by this Change Order; and, It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original contract other than matters expressly provided herein.
