MEMORANDUM
TO: The Honorable Mayor and Board of City Commissioners

RE: BID B97-05, SALE OF CITY-OWNED SURPLUS REAL ESTATE
The City Commission earlier in the year declared three pieces of City-owned real
estate as surplus and put them out for bid. The three property locations are
identified as follows:
Site #1: 409 Jackson Street
Site #2: 102 W. Ohio street
Site #3: 703 California Avenue
No bids were received at that time. On December 15, 1996, the surplus
properties were put out for re-bid and were due on January 8, 1997. The results
were as follows:
Sites #1 and 3 received no bids; however, Site #2 received two bids. First Baptist
Church of Ocoee offered a net bid of $102,077.00 with no additional costs to be
paid by the City; however, they have since withdrawn their bid due to financial
concerns. Please see the attached letter from Pastor Laird. The City Attorney has
advised me that a bidder may withdraw their bid prior to award of bid without
the threat of losing the $5,103.85 retainer. Tom West of Ocoee offered $84,100.00
with no additional costs to be paid by the City. Site #2 was appraised at
$103,000.00 and required a minimum net bid of$82,400.00.
The Terms and Conditions of the re-bid required a minimum net bid to the City
which was based on 80% on the appraised value (appraisals were provided by
Consortium of Winter Park, Florida). The bidders had to indicate if there were
any additional costs which the City would be required to pay as part of the sale
of the property.
Since only one valid re-bid has now been received, the City may award the re-bid
to the sole bidder or reject the bid and provide direction to Staff regarding re-
bidding or alternative marketing efforts.
ACTION REQUESTED
The Honorable Mayor and Board of City Commissioners award Tom West of
Ocoee Site #2, identified as 102 W. Ohio Street, in the amount of$84,100.00.

Dear Mr. Shapiro,
I am writing this letter to inform you that the church will be withdrawing it's bid of
$102,077.00 on the 3.8 acre property located at 102 W. Ohio Street do to financial
concerns. I apologize for any inconvenience or extra paperwork that this might cause
you.
I am also asking that you would return to us our$5103.85 retainer. This would relieve a
great burden on the church and we would greatly appreciate it. .
