Shira,P.E. ;/ City Engineer/Utiliti-A irector SUBJECT: Kissimmee/Story,Maguire/Marshall Farms Intersections Project On November 5, 1996 the City Commission approved Addendum No. 96-5 to Professional Engineering Consultants, Inc.'s continuing contract. This Addendum, in the not-to-exceed amount of$131,409.00 was for supplementary design, construction management and inspection services for the referenced intersection improvement project. The Addendum was based on PEC's proposal which included$28,902.73 for Post-Design Engineering services, $9,779.96 for Bidding Phase services, and$92,725.77 for Construction Management and Inspection services. Subsequent to that action, Mr. Fred Gardner was hired by the city as a Construction Manager, and we determined that much of the work proposed to be done by PEC under Addendum 96-5 could be performed by Mr. Gardner and other city staff members. We discussed this with PEC, determined that they had not yet hired anyone for this project, and asked them to revise their proposal to reflect the City performing much of the construction management and inspection services in-house. It is our intention that PEC's scope of services for Post-Design Engineering and Bidding Phase services remain as approved in Addendum 96-5, with a not-to-exceed amount of$38,682.69. PEC's revised proposal for Construction Management and Inspection calls for a reduction in fees from$92,725.77 to $30,000.00,a reduction of$62,725.77. The remaining authorization of $30,000.00 is necessary since PEC's services will still be required during the Construction Management phase of the project for such items as shop drawing review, review of Maintenance of Traffic plans, assistance with change order requests, final inspection services and preparation of record drawings. - I recommend that the City Commission authorize the Mayor and City Clerk to execute Amendment No. 1 to Addendum No. 96-5 to PEC's continuing contract in the not-to-exceed amount of$30,000.00. This action will effectively reduce the fee for Construction Management and Inspection services previously authorized under Addendum No. 96-5 by$62,725.77. THE PRIDE OF WEST ORANGE AMENDMENT NO. 1 TO ADDENDUM NO. 96-5 TO AGREEMENT FOR CONSULTING ENGINEERING SERVICES INCLUDING CONSTRUCTION ADMINISTRATION SERVICES FOR INTERSECTION IMPROVEMENTS AT STORY ROAD/KISSIMMEE AVENUE AND MARSHALL FARMS/MAGUIRE ROAD This Amendment No. 1 to Addendum No. 96-5 hereinafter called the Amendment, as of this day of February, 1997, shall constitute an Addendum to the Agreement for Consulting Engineering Services between the. City of Ocoee, Florida (the CITY) and Professional Engineering Consultants, Inc., 200 East Robinson Street, Suite 1560, Lake Eola Centre, Orlando, Florida (the CONSULTANT), dated the 21st day of August, 1984, hereinafter referred to as the AGREEMENT. WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY retained the CONSULTANT to provide professional engineering services as required from time to time, and WHEREAS the CONSULTANT will perform consulting engineering services for the CITY as herein defined. NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth on the part of both parties to be kept and performed, the parties do mutually agree as follows: Section 1 - Services of the Consultant 1.1 The CONSULTANT shall perform the Engineering services as outlined in the • attached amended proposal P-6171A, dated January 30, 1997 relative to the provision of consulting engineering services to the CITY. Section 2 - Compensation 2.1 Compensation by CITY for the amended construction phase services provided under this Addendum shall be computed under Paragraph 6.1.2.3 of tte Agreement, utilizing the Payroll Cost Times a Factor Method of Compensation with the compensation for this additional authorization not-to-exceed $30,000 as outlined in the attached proposal, without further authorization from the CITY. The Amendment-reduces PEC's Scope of Services for cons:, action phase services and reduces the authorization from $92,727 to $30,000 for construction phase services. Section 3 - Time of Completion 3.1 The CONSULTANT shall provide the services by July 31, 1997 as outlined in the attached proposal. City Engineer/Utilities Director City of Ocoee 150 North Lakeshore Drive Ocoee, Florida 34761 Re: Amendment 1 to Addendum 96-5 Construction Phase Services for Story Road/Kissimmee Avenue and Marshall Farms/Maguire Road Intersections- Dear Jim: We are pleased to present the attached modifications to our proposal number P-6171 (dated November 1, 1996) and Addendum 96-5 (dated November 5, 1996). The primary purpose of the modification is to delete the Resident Project Representation (RPR) services from PEC's Scope of Services. The City staff will perform the construction inspection services for this project. Based on our discussions, we have also modified the Scope of Services for the construction phase services to define the role of City staff and PEC engineers during construction of the intersection improvements. The following is a summary of the modified Scope of Services for construction phase services. Construction Phase Services 1. . PEC to provide geotechnical schedule 2. PEC to conduct a pre-construction conference with the Contractor, City and affected utilities. PEC to provide agenda, minutes and any follow-up to all attendees. 3. City to review the Contractor's proposal,'schedule in accordance with the specifications. 4. PEC to review the Maintenance of Traffic Plan proposed by the Contractor in accordance with the specifications. 5. PEC to provide qualified engineering personnel to generally monitor the Contractor's work and verify the work is completed in accordance with the plans and specifications. Shira, P.E. January 30, 1997 Page 2 RFI's. PEC personnel will be available for periodic site visits at the request of the City Engineer. 6. City to review the daily construction logs of the Contractors' progress, Contractor personnel, and equipment on site. 7. City to review the Contractor's request for payment and coordinate with PEC design engineer. 8. City to conduct bi-weekly progress meetings and provide minutes of the meeting to PEC, Contractor and utility. PEC design engineer to attend bi-weekly meetings as requested by the City Engineer. 9. City to receive, review and make recommendations concerning on-site testing reports. 10. City to prepare punch list of items required for completion. PEC to review punch list. PEC/City to make final inspection of the completed construction effort. 11. City to verify that all discrepancies noted in final inspection have been corrected. City to determine that release of lien records have been obtained from all contractors prior to authorization of final approval. 12. PEC to provide City with one complete set of record as-builts, mylar drawings based on records supplied by City's inspectors. 13. City to review Contractor's revised schedule as needed. 14. City to provide all on-site project inspections (RPR). Total fees for PEC's modified construction phase services have been reduced from $92,727 to $30,000 resulting in a$62,727 reduction in expenses to be paid by the City of Ocoee.
