RE: ARCHITECTURAL DESIGN SERVICES AGREEMENT
Several weeks ago, Commissioner Glass requested a status update on the
design of the lakefront public restroom facility. Since we last discussed this
issue with you, there have been several discussions with the architect of record
regarding the site plan surrounding this facility and, in particular, the architect's
concerns regarding ADA requirements.
The difference of opinion between the architect and our Building Official and City
Engineer was regarding the ADA requirements and the span of those
requirements due to the placement of this facility on the City Hall campus. We
were finally able to work out the amended agreement between the architect and
the City that holds him harmless with regard to any ADA complaints regarding
the design of the building. Both the City Engineer and Building Official and this
writer are sure that this building meets all the requirements necessary for this
site.
Also attached is the projected schedule of completion for this facility.
This writer respectfully requests that this addendum be approved so this project
can be completed.

AMENDMENT TO AGREEMENT FOR
ARCHITECTURAL DESIGN SERVICES AGREEMENT
THIS AMENDMENT TO AGREEMENT FOR ARCHITECTURAL DESIGN
SERVICES ("this Amendment") is made and entered into this day
of , 1997 by and between the City of Ocoee, Florida
("the Owner") and James Swickerath, A. I.A. ("the Architect") .
WITNESSET H:
WHEREAS, the Owner and the Architect have heretofore
entered into a certain Architectural Design Services Agreement for
erection of public toilets, dated November 7, 1995 ("the
Agreement") ; and
WHEREAS, the Owner and the Architect desire to address
certain matters related to compliance of the Project (as defined in
the Agreement) with the American with Disabilities Act ("the ADA") .
NOW, THEREFORE, in consideration of the premises and
other valuable considerations, the receipt and sufficiency of which
is hereby acknowledged, the Owner and the Architect hereby agree as
follows:
(1) The Owner hereby advises the Architect that the
purpose of the Project is to establish a public restroom facility
("the Facility") to serve Starke Lake boat ramp patrons and that
the Facility is not intended to serve the general public.
(2) The Owner has advised the Architect that it has
determined that the ADA requirements for the Project are met if the
Facility is handicap accessible from the parking lot which serves
the boat ramp. The Owner has directed the Architect to design the
Facility as a handicap accessible facility and to provide for the
establishment of a suitably marked handicap parking space at the
boat ramp parking lot and the creation of a handicap accessible
pathway from the parking lot to the restroom.
(3) The Owner hereby agrees, to the extent permitted by
law, to indemnify and hold harmless the Architect from and against
all liabilities and expenses, including attorneys' fees, paralegal
fees and costs incurred, at the administrative, trial and appellate
levels, in connection with any claims which may be brought alleging
that the Facility or the plans and specifications for the Facility
as prepared by the Architect do not comply with the requirements of
the ADA.
(4) The Architect has agreed to design the Facility in
accordance with the directions of the Owner set forth in Paragraph
2 above in reliance upon the indemnification of the Owner as set
forth in Paragraph 3 above.

(5) Except as set forth herein, the Agreement remains
unchanged and in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the day and year first above written.
