FLIPPEN,BUILDING AND ZONING OFFICIAL 1�• DATE: FEBRUARY 12, 1998 SUBJECT: RESOLUTION OF THE CITY OF OCOEE PERTAINING TO THE GOVERNOR'S BUILDING CODE STUDY COMMISSION ISSUE Should the Honorable Mayor and Board of City Commissioners approve a Resolution to the Governor of Florida which states that the City of Ocoee has areas of concern contained in the Final Report of the Governor's Building Code Study Commission? BACKGROUND/DISCUSSION On February 3, 1998, at the regularly scheduled City Commission meeting, the Board of Commissioners after considering a staff report submitted. by the City Building Official, authorized a Resolution to be drafted that set forth the concerns of the City of Ocoee of certain recommendations contained in the Governor's Building Code Study Commission Report. RECOMMENDATION I would respectfully recommend the Honorable Mayor and Board of Commissioners approve Resolution 98-03. RESOLUTION 98-03 A RESOLUTION OF THE CITY OF OCOEE, FLORIDA SUPPORTING CERTAIN RECOMMENDATIONS OF THE GOVERNOR'S BUILDING CODES STUDY COMMISSION TITLED 5 FOUNDATIONS FOR A BETTER BUILT ENVIRONMENT AND OPPOSING CERTAIN RECOMMENDATIONS OF THE GOVERNOR'S BUILDING CODES STUDY COMMISSION TITLED 5 FOUNDATIONS FOR A BETTER BUILT ENVIRONMENT. WHEREAS, the Governor's Building Codes Study Commission has completed their intensive study of the feasibility of a single building code system for the State of Florida, WHEREAS, this final report has been presented to the Governor of the State of Florida where this report will be considered during the 1998 legislative session, WHEREAS, no comprehensive study has been done to determine the cost to local governments of complying with this proposed legislation. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COMMISSION OF THE CITY OF OCOEE,FLORIDA THAT: 1) The City of Ocoee supports the adoption of a statewide minimum building code that is flexible and prompts innovation in construction. 2) The City of Ocoee supports leaving the enforcement and administration of building codes to local jurisdictions. 3) The City of Ocoee supports leaving the appeal process and final appeal process in the authority of local jurisdictions. 4) The City of Ocoee supports the permitting, plan examination and inspections of all state owned buildings, including schools and prisons, shall be the responsibility of local jurisdictions. 5) The City of Ocoee strongly opposes the removal of authority for local jurisdictions to amend codes and placing authority. in a state board to determine if local code revisions meet state criteria for approval. 6) The City of Ocoee strongly opposes mandatory requirements for local jurisdictions to enforce programs to perform maintenance inspections on all existing commercial, institutional and multi-family residential structures. 7) Copies of this Resolution shall be provided to the appropriate officials.
