SUBJECT: UPDATING EXISTING FIRE PREVENTION AND PROTECTION ORDINANCE
ISSUE: -
Should the Honorable Mayor and Board of City Commissioners-adopt Ordnance No. 98-07 ,
repealing in its entirety the current§78-119f Article.I-,-of.Chapter 78 of the City Code of Ordinances and
adopting a new §781 of Article I,of Chapter:78,of the:City.Code of Ordinances to ensure a higher
degree of life safetyr'and fire';protection standards[for buildings,within the,City of Ocoee.
BACKGROUND: - ;i

The current Section§78-1 of Article I,of.Chapter 78 of,the City Code of Ordinances mandates use of the
1991 Standard Fire Prevention Code. This Standard isno longer recognized as an acceptable Standard by
the State of Florida. . ' _ , ,
DISCUSSION:
By Statutory law,the State Fire Marshal-has adapted the.1994 Life Safety Code and numerous NFPA
standards for mandatory use on particular types of occupancies. --

By adopting the 1997 Standard Fire Prevention Code,which referencesthe same NFPA standards as the
State Fire Marshal,and the 1997 Life Safety Code,:the City could mandate the same codes and standards
for all occupancies,not just particular types of occupancies as mandated by the State Fire Marshal. Also,
adoption of these codes and standards would provide a more uniform blend of code research and
enforcement that would parallel the codes and standards used by the City Building Department.
RECOMMENDATION:
It is respectfully recommended that the Honorable Mayor and City Board of Commissioners adopt
Ordinance No. 98-07 .

AN ORDINANCE OF THE CITY OF OCOEE,FLORIDA
RELATING TO FIRE PREVENTION AND PROTECTION
STANDARDS,REPEALING IN ITS ENTIRETY §78-1,OF
ARTICLE I,OF CHAPTER 78 OF THE OCOEE CITY CODE
' OF ORDINANCES AND ADOPTING A NEW§78-1, OF
ARTICLE I,OF CHAPTER 78 OF THE OCOEE CITY CODE . I
OF ORDINANCES;PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION;PROVIDING AN
EFFECTIVE DATE.
WHEREAS,the City Commission of the City of Ocoee desires to adopt minimum fire safety
standard in order to better protect the lives and property of its citizens.
NOW,THEREFORE,BE IT ENACTED BY THE CITY COMMISSION OF THE CITY
OF OCOEE,FLORIDA,AS FOLLOWS:
SECTION 1. . The City Commission of the City of Ocoee has the authority to adopt this
Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 166 and 633,
Florida Statutes.
SECTION 2. The present §78-1 of Article I of Chapter 78 of the Code of Ordinances of the
City of Ocoee,Florida, is hereby repealed in its entirety.
SECTION 3. A new §78-1 of Article I of Chapter 78 of the Code of Ordinances of the City
of Ocoee,Florida,is hereby adopted as follows:
§78-1. For the purpose of prescribing regulations governing conditions hazardous to life and
property from fire or explosion,the following standards are hereby adopted:
1. Standard Fire Prevention Code, 1997 Edition,excluding Section 105 of Chapter 1 thereof.
2. National Fire Protection Association 101 Life Safety Code, 1997 Edition.

SECTION 4. Severability. If any section, subsection,sentence, clause,phrase or portion of
this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent provision and such holding shall not
affect the validity of the remaining portion hereto.
SECTION 5. Codification. It is the intention of the City Commission of the City that the
provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City;and.
that sections of this ordinance may be renumbered or relettered and the word"ordinance"may be changed
to"chapter","section","article";or such other appropriate word or phrase in order to-accomplish such
intentions;and regardless of whether such inclusion in the code is accomplished, sections of this
ordinance
may be renumbered or relettered and the correction of typographical errors which do not affect the intent
may be authorized by the City Manager,without need of public hearing,by filing a corrected or recodified
copy of same with the City Clerk
SECTION 6 Effective Date. This Ordinance shall become effective immediately upon
passage and adoption.

Notice is hereby given pursuant to Article VIII of the Constitution of the State of Florida, and
Section 166.041 and Section 633, Florida Statutes, that the Ocoee City Commission will hold a
public hearing in the Commission Chambers, City Hall, located at 150 N. Lakeshore Drive,;
Ocoee, Florida during a regular session to be held on April 7, 1998, at 7:15 p.m., or as soon
thereafter as possible, in order to consider the adoption of the following ordinance:

Interested parties may appear at the meeting and be heard with respect to the proposed action.
A copy of the proposed ordinance may be examined at City Hall, 150 N. Lakeshore Drive,
Ocoee, Florida, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday.
NOTICE: Any person who desires to appeal any decision made by Commission with
respect to any matter considered at such meeting will need a record of the proceedings and for
such purpose may need to ensure that a verbatim record of the proceeding is made, which
record includes the testimony and evidence upon which the appeal is based. Persons with
