This addendum would authorize PSI to provide geotechnical and construction materials testing and part time resident inspection services for the Orlando Avenue/White Road Improvements Project Phase I and Phase II. In accordance with the construction specification documents. City standards and standard industry practices, certain geotechnical and construction materials testing is required to insure that the materials supplied meet the specifications and that the project is constructed in accordance with the plans prepared by PEC, Inc. The Geotechnical Testing Schedule included in the proposal was prepared by PSI upon review of the project plans and specifications to itemize the various tests required and establish frequencies and estimated numbers for each of the tests. In addition, the Engineering Department proposes to use PSI to provide part time resident inspection services for this project. As part of PSI's testing services they will need to he present when the road base and/or sub base is exposed to test and render opinions on whether it needs to he removed and replaced or is acceptable to leave in place. Although PEC was the design engineer and could render the opinions on the base and/or sub base they would require testing to aide in their decisions, PSI can provide both services; so it is better to only employ one firm to do both tasks and it also eliminates conflicts. The attached letter from PSI lists the services to be provided and establishes set costs for each of the tests and the inspection services in estimating their proposed fee. PSI, Inc. estimated fee for this project is $23,140. These fees are representative of the geotechnical industry and are THE PRIDE OF WEST ORANGE L/j� comparable to similar services from the other Geotechnical Engineering and Testing firms under contract with the City. Although the Geotechnical Testing Schedule is based upon City and FDOT standards for types of tests and their frequency which were used in the preparation of contract specification, unknown field conditions may require more tests to be performed. Any additional tests would only be performed at the direction of City staff, with possible advisement from PEC. Any and all tests which have to be repeated because of failure of the tested material to meet specifications shall be paid for by the contractor. Staff also requests that the Commission allow the establishment of a contingency fund in the amount of$1,860, to cover any additional testing which may be required that would result in exceeding the established contract amount. At this time, staff does not foresee any problems, hut historical experience has proven that geotechnical and materials testing is estimated on established minimums and those minimums are exceeded sometimes based upon the requirements of actual construction activity. Should construction activity require that the initial contract amount be exceeded, Staff will inform the Commission of this fact. Should construction activity require that the budget amount of the initial contract amount plus contingency be exceeded, Staff will prepare an additional amendment for review and approval by the Commission. I recommend that the City Commission authorize the Mayor and City Clerk to execute Addendum No. 2 to the Agreement for Professional Geotechnical Engineering and Testing Services with PSI, Inc. in the not-to-exceed amount of$23,140 to provide geotechnical and construction materials testing and part time resident inspection services for the Orlando Avenue/White Road Improvements Project Phase I and Phase II. In addition Staff requests that the City Commission and the Mayor authorize the Engineering Staff to be able to exceed this initial set amount in the event that construction activity requires, only up to $1,860, for a total not to exceed amount of$25,000. Attachments ADDENDUM NO. 2 to CONTRACT FOR PROFESSIONAL GOETECHNICAL ENGINEERING and TESTING SERVICES for WHITE ROAD/ORLANDO AVENUE IMPROVEMENTS PROJECT PHASE 1 and PHASE 2 This Addendum No. 2 hereinafter called the Addendum as of this _day of , 1999, shall constitute an Addendum to the Agreement for Professional Geotechnical Engineering & Testing Services between the City of Ocoee, Florida (the CITY) and Professional Service Industries, Inc., 1675 Lee Road, Winter Park, Florida 32789 (the CONSULTANT) dated the 4°i day of January, 1994, hereinafter referred to as the AGREEMENT. WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY retained the CONSULTANT to provide professional engineering services as required from time to time, and WHEREAS the CONSULTANT will perform consulting engineering services for the CITY as herein defined. NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth on the part of both parties to be kept and performed, the parties do mutually agree as follows: Section 1 - Services of the Consultant The CONSULTANT shall perform the engineering services as outlined in the attached proposal i761-P8-194 dated February 11, 1999 relative to the provision of consulting services to the CITY. Section 2 - Compensation Compensation by CITY for engineering services provided under this Addendum shall be computed under Section II of the AGREEMENT with the compensation for this additional authorization not to exceed $23,140.00 as outlined in the attached proposal, without further authorization from the CITY. Section 3 - Time of Completion The CONSULTANT shall provide the services as outlined in the attached proposal. (PSI) is pleased to present this revised proposal,to perform construction materials testing services and inspection services for the Orlando Avenue/ White Road Improvement project in Ocoee, Florida. We understand that the project consists of pavement milling, resurfacing, drainage improvements, pavement construction and sidewalk construction. Our services would be performed in accordance with the project's specified testing requirements and portions of the CEI project scope as outlined within a Project Memorandum PEC dated January 12, 1999. Specifically our services would include items #2, #7, and #9 of the scope as well as items #5, #8, #10, #11, #12 and #14 which would be performed jointly with the City and/or PEC. PSI proposes to provide experienced technical personnel to perform the necessary testing and inspection services in accordance with project plans and specifications. It is proposed to accomplish the work on a unit price basis in accordance with the attached Schedule of Services and Fees and that the work be performed pursuant to the PSI General Conditions. Copies of the PSI Schedule of Services and Fees and General Conditions are enclosed herewith and incorporated into this proposal. PSI's fees would only be determined by the actual amount of technical time expended for this project and the amount of laboratory testing performed. Our laboratory and personnel fully comply with the standards of ASTM, AASHTO, AISC, AWS and FDOT standards. Our laboratory has been inspected and approved by the F.D.O.T. in depth inspection team from Gainesville, Florida and by the Army Corps of Engineers, and maintains a CMEC certified laboratory and certified experienced field personnel. PSI will proceed with work on the basis of verbal authorization; however, please sign and return one (1) copy of this proposal intact. Make visits to the site at intervals appropriate to the various stages of construction in order to observe the progress and quality of the Contractor's executed Work. Daily inspections of M.O.T., subsoil excavation, pavement marking and signage, pavement milling, asphalt placement and drainage piping and structures installation will be required. 3. Review and approve Shop Drawings and Samples. 4. Schedule and administer weekly construction progress and other specially called meetings throughout the progress of the Work. Prepare agenda for, preside over and prepare and distribute minutes of construction progress and other specially called meetings. 5. Review and approve Contractor's initial and updated construction progress schedules. 6. Review field questions and or problems and provide interpretation of Contract Documents. Review and provide comments/recommendations concerning results of tests and inspections performed by project Quality Control Consultant. 8. Upon written request by the Contractor, conduct an inspection to determine if the Work is substantially complete. Prepare and distribute a punch list of items to be addressed. 11.
