Addendum to Final Subdivision Plan (Replat of Lots 2, 3, 4& 5)

ISSUE:
Should the Mayor and City Commissioners approve an Addendum to the Final Subdivision Plan
for Lake Bennet Centre, involving a Replat of Lots 2, 3, 4 and 5?
BACKGROUND:
The subject property is located on the north side of SR 50, between Blackwood Avenue and Lake
Bennet. The original Final Subdivision Plan for Lake Bennet Centre was approved by the City
Commission on August 15, 1995 and included a total of 9 lots. In that subdivision plan, Lots 1,
2 and 3 had frontage on SR 50, between Blackwood Avenue and Kelton Avenue. Lot 4 had
frontage on SR 50, between Kelton Avenue and Lake Bennet. Lot 5 was between Kelton
Avenue and Lake Bennet,just north of Lot 4. With the original plan, each of Lots 1 - 5 had to
manage their stormwater retention on site.
DISCUSSION:
This Addendum to the Final Subdivision Plan for Lake Bennet Centre rearranges some of the lots
in the original Final Subdivision Plan (Lots 2 - 5), eliminating two lots and providing an
additional master stormwater retention pond. The land which had been Lots 2 and 3 in the
original plan has been reallocated into a new Lot 1 (of the replat) and a new larger Lot 2. The
land which had been Lots 4 and 5 in the original plan has been reallocated into a new Lot 3, with
frontage on SR 50, and a new Tract "A" for a new master stormwater retention pond, located
between Kelton Avenue and Lake Bennet. The new Lot 1 will be acquired by the Sun Trust
Bank for an expansion of their operations on the original Lot 1. Lots 2 and 3 will be sold to
individual users. All three of the new lots, plus the original Lot 1 will now manage their
stormwater retention in the new master stormwater retention pond in the new Tract"A". /J„

The original Final Subdivision Plan included a long list of Conditions of Approval and a master
landscaping plan so the entire subdivision would have a consistent appearance. With this
Addendum to the Final Subdivision Plan for Lake Bennet Centre, all of those original Conditions
and the landscaping plan will remain in effect. The only changes will be to the allocation of land
to the lots involved and the additional stormwater management facilities. There will be a new
drainage easement on the northwest corner of Lot 7 which will be part of the new stormwater
management facilities. However, the drainage facilities within that easement are designed to
have a minimal impact on the future development of Lot 7.
Since this plan does not significantly change the basic layout of the subdivision, it does not
require an amendment to the Preliminary Subdivision Plan with public hearings. The City
Attorney has determined that these changes do not need to be reviewed by the Development
Review Committee or the Planning and Zoning Commission and require only City Commission
action. Therefore, this Addendum to the Final Subdivision Plan for Lake Bennet Centre was not
reviewed by either of those bodies. A new plat which legally changes the boundaries of the lots
involved will also be considered by the City Commission as a separate agenda item.
STAFF RECOMMENDATION:
Based on an analysis of the revisions to the approved Final Subdivision Plan, Staff respectfully
recommends that the Mayor and City Commissioners approve this Addendum to the Final
Subdivision Plan for Lake Bennet Centre as date stamped received by the City on June 10,
1999.
