Issue
Should the Honorable Mayor and Board of City Commissioners approve the replat as submitted?
Background
Lake Bennet Centre is an established subdivision at the northwest corner of SR50 and
Blackwood Avenue. The existing lots 2 through 5 have been reconfigured to increase the size of
lots 1, 2 and 3 while changing a major portion of the existing lot 5 into a retention/detention
area. The developer has issued a Letter of Credit to the city insuring that all site work shall be
completed in time to the city's satisfaction. The site work that will be completed consists of the
following: excavate, grade and seed proposed retention ponds; and, provide and install storm
water piping.
Recommendation
Staff recommends that the Honorable Mayor and Board of City Commissioners approve the
replat as submitted.

Background

1. Prior to the approval of Final Site Plans for the project, or any portion
thereof, the applicant/owner will need to apply for and obtain a Final Certificate of
Concurrency pursuant to Article IX of the Ocoee Land Development Code. Neither
the review of the application/project by the City nor the granting of any approvals in
connection with such review shall be construed to grant the applicant/owner any
entitlement to obtain a Final Certificate of Concurrency with respect to all or any
portion of the project or to create any exemption from the provisions of Article IX
the Ocoee Land Development Code.
2. The City is subject to the terms, provisions and restrictions of F.S. Chapter 163
concerning moratoriums of the issuance of building permits under certain
.circumstances. The City has no lawful authority to exempt any private entity, or
itself, from the application of such state legislation and. nothing herein shall be
construed as such an exemption.
