FLIPPEN, BUILDING AND ZONING OFFICIAL DATE: JULY 30, 1999 SUBJECT: INTERLOCAL AGREEMENT-ANIMAL CONTROL ISSUE Should the Honorable Mayor and Board of City Commissioners approve modification to an agreement between Orange County and the City of Ocoee that would provide for the City of Ocoee to collect revenue for citations written by the city? BACKGROUND/DISCUSSION Under our existing Interlocal Agreement between Orange County and the City of Ocoee, there were no provisions made for the City to collect revenues for citations written by the Animal Control Officer within our City Limits. This modification will make it legal for the City to collect the revenue for the citations. The Orange County Commission will see these changes at their next meeting of August 3, 1999, for their approval. WITNESSES: WHEREAS,each of the above-named entities operate animal control services within their respective jurisdictions;and WHEREAS,pursuant to Section 43-2 of Article 1 of Chapter 43,.Code of Ordinance of the City of Ocoee,the City has adopted Orange County Code Section 5-32,regarding animal control, the classification of dangerous and potentially dangerous animals and the confinement and quarantine of animals;and WHEREAS,the jurisdictional boundaries of the County and City are adjacent;and WHEREAS,it is the desire of each of the parties hereto to assist one another when such aid is necessary as herein identified;and WHEREAS, the parties hereto recognize and agree it is desirable to provide the most efficient and expeditious response in their respective jurisdictions in order to protect the public health,safety and welfare. NOW,THEREFORE,the parties hereto mutually agree as follows: 1. The City through its Animal Control Officer, will enforce Orange County Code Section 5-32 within the jurisdictional boundaries of the City and may enforce Section 5-32 in any area of unincorporated Orange County as the officer deems necessary for the safety and welfare of 07/29/99 12:49 ORANGE COUNTY GOVERNMENT 4 96568504 rvu.coc vwc citizens pursuant to the Code. 2. Orange County Animal Service employees will continue to enforce Orange County Code 5-32 within the jurisdiction of Ocoee between the hours of 4:00 PM to 8:00 AM Monday through Friday,on Weekends,holidays and in the event of an emergency as determined by Orange County Animal Services internal priority response listing. 3. All animals impounded by the City will be transported to Orange County Animal Services for disposition. Fees,citations,or warning notices will be issued to owners who reclaim their animals,in accordance with Orange County Code Section 5-32,Resolution 96-M-10 and Ocoee Code Section 43-2. 4. Civil penalties shall be assessed in accordance with the schedule established by Orange County Resolution 96-M-10,as it may be amended from time to time. Proceeds of penalties levied within the City as a result of the City's Animal Control Officer, shall be retained by City except for the Five Dollar($5.00)surcharge,levied pursuant to Florida Statute Section 828.27(4)(b), which shall be remitted to County. 5. Ocoee Animal Control personnel shall have access to Orange County Animal Service data processing software to assist with maintaining records on residents and their pets. Access shall be supervised and controlled in accordance with the policies and procedures of the Orange County Department of Information Technologies.
