PARKER 4 OF GOOD CITY MANAGER ELLIS SHAPIRO STAFF REPORT DATE: July 25, 2000 TO: The Honorable Mayor and City Commissioners FROM: Russ Wagner, AICP, Director of Planning V SUBJ: Haynes Brothers Furniture Store (Project No. SS-2000-007) Waiver Requests ISSUE: Should the Mayor and City Commissioners approve two waivers requested as part of the Haynes Brothers Furniture Store project? BACKGROUND: The updated Commercial and Industrial Development regulations permit the City Commission, at its sole discretion, to waive provisions within the Land Development Code when plans have been designed to: 1) be part of an integrated and master planned development; 2) be compatible with surrounding developments; 3) impose no impacts on City infrastructure greater than that generated by other uses normally permitted in the underlying zoning district; and/or 4) provide an off-setting public benefit which is technically sound and measurable. DISCUSSION: The Land Development Code gives the Planning Director authority to negotiate waivers when a specific plan furthers the goals and intents of the Commercial and Industrial Development Regulations. In the case of Haynes Brothers Furniture Store, three large oak trees (28", 36" & 48") are situated in the center of their site located at the northeast corner of Central Commerce Lane and Ocoee Commerce Parkway south of S.R. 50. Knowing the positive public benefits derived by saving trees, Staff has worked with the owners to design their site in a manner which preserves these specimens. As shown on the excerpt drawings, the Haynes Brothers Furniture Store, (in order to build at the same size as would normally be allowed by the Code), needs to occupy a portion of the front yard area (10 ft. setback versus 25 ft. setback) that would normally be required along POW " Oil '- ' hiPrR? r. `: July 25, 2000 Mayor and City Commissioners Page 2 Ocoee Commerce Parkway. The additional land area occupied by the structure within the setback largely corresponds to the green area preserved within the site for the oak trees. Additionally, the owner is requesting that a waiver from parking be permitted, basing it on Gross Leasable Area versus Gross Square Footage. This parking waiver has been granted numerous times on other projects since parking ratios relate more directly to useable building space than overall area.
