Shira, Community Relations/Projects Directo Subject: Ordinance No. 99-26, Regulating Cable Television Franchises Issue Should the Mayor and City Commissioners approve Ordinance 99-26, an ordinance providing procedures and requirements relating to cable television franchises? Background In May, the City Commission held a workshop to discuss its role in regulating cable television in Ocoee. Time Warner representatives were at the meeting to listen to the City's comments and concerns as well as to provide insight into their future plans in Ocoee. Time Warner is currently the only cable television franchise holder in Ocoee. Before this meeting, staff and the City's legal counsel had prepared a working draft of a proposed new cable television ordinance for the City in light of all the changes in the industry since adoption of the existing ordinance back in the early 1980s. Time Warner representatives had been provided copies of the ordinance and the City was working with Time Warner to try to come up with a final document. The first reading of Ordinance 99-26 was held back in July. At that point there were still several issues of concern to both the City and Time Warner. No other cable television representatives had approached the City Commission with comments at that time. The City Commission directed staff to advertise for the second reading and public hearing for the second meeting in August in order to provide additional time for the parties to meet and discuss these issues further. POWY Og Page 2 Cable Television Staff Report- September 16, 1999 The second reading and public hearing was held on August 17, 1999; however, the City Commission continued the hearing to September 21, again to provide additional time to finalize the document. Discussion Staff and the City's legal counsel again met with Time Warner representatives on August 27. Although some progress was made, staff is requesting one final continuance of the hearing to November 2. We have made a good faith effort to work with Time Warner representatives and we will have recommended changes incorporated into the ordinance at that meeting to recommend for your approval. A representative from Leibowitz & Associates will be at your meeting Tuesday night to answer any questions you may have.
