ISSUE:
Should the Honorable Mayor and Board of City Commissioners authorize the
expenditure of approximately $14,000 from General Fund Contingency Account for the
subject project?
BACKGROUND AND DISCUSSION:
On June 2, 1999, the Florida Department of Labor and Employment Security conducted
an inspection of all City buildings. Several minor violations were noted and have been
corrected by city forces or with operational funds. However, the subject violation is a
capital expense, copies of inspection reports attached. This violation is based on
Florida Statute 29 CFR 1910.141(d)(2)(ii), copy attached.
This project requires piping hot water to all lavatories in the Police Department, using
the existing hot water heater. In City Hall, this requires the installation of a 50 gallon
hot water heater and piping to all lavatories.
Public Works contacted four plumbing companies in an attempt to obtain quotes for this
work. Of the four companies, only one, Maitland-Winter Park Plumbing, Inc., was
willing to provide a written estimate and proposal to perform the work. Public Works
has reviewed the proposal (copy attached) and finds their price fair and reasonable.

Staff Report City Hall Water Heater
This company has performed plumbing work in the past for the City. Their work has
always been of a professional nature and their price reasonable. As per their proposal,
their work does not include any required electrical work. The City Hall hot water heater
and circulating pump will require electrical service. At this time Public Works is
attempting to obtain estimates for the required electrical work. It is the opinion of Public
Works that this electrical work should cost approximately $1,000.
RECOMMENDATION:
Therefore, Staff respectfully requests authorization of $14,000 from General Fund
Contingency for the referenced work. This will include $13,000 for the contract with
Maitland-Winter Park Plumbing, Inc., and $1,000 for a yet to be determined electrical
contractor.

It is expressly stipulated and agreed that the undersigned shall not be liable for any delays occasioned by the elements,strikes, fire,
inclemency of the weather,the acts or omissions of other contractors,or persons,or any other similar or dissimilar causes beyond the control of
Maitland Winter Park Plumbing.
Increases in Maitland Winter Park Plumbing's costs,resulting from delays,acts or omissions of owner or contractor,or other persons,
and not caused by Maitland Winter Park Plumbing,shall.be paid by owner/contractor. All extra work or change orders required after the
acceptance of this proposal shall be performed by Maitland Winter Park Plumbing.
Once fixtures,piping,duct work,or other materials called for under this contract have been installed on j9b site by Maitland Winter
Park Plumbing,then the same becomes the property of owner and Maitland Winter Park Plumbing shall not be required to repair or replace
material,equipment or fixtures which may be stolen,damaged or disappear from job site. It is hereby expressly provided that the title to all
material and equipment to be furnished hereunder until installed on job site shall remain in Maitland Winter Park Plumbing and in case of
default in the payments or terms hereof, Maitland Winter Park Plumbing is hereby authorized to enter upon the job sites and take possession of
and remove said material and equipment at any time.
Payment on all invoices is due in full upon receipt of this invoice. Interest at the pre judgment and post judgement rate of 1.5%per
month shall be added to all balances not paid within thirty(30)days. Maitland Winter Park Plumbing, Inc. shall be entitled to its actual
attorneys' fees and costs in the event litigation,arbitration or any appeals thereof is(are)brought by or against Maitland Winter Park,
Plumbing,Inc.in connection with the labor,services and materials represented by this invoice and in the collection thereof.
In the event owner/contractor fails to pay the monies herein required when due,the owner/contractor specifically agrees to pay all
costs, including fees in the event litigation,arbitration or any appeals thereof is(are)brought by or against Maitland Winter Park Plumbing,
Inc.in connection with the labor,services and materials referenced in this Proposal and in the collection thereof.
All of the remedies provided herein shall be construed to be in addition to those provided in the statutes of the State of Florida.
MAITLAND WINTER PARK PLUMBING, INC.'S LIABILITY FOR LOSS OR DAMAGE CAUSED BY DEFECTS IN
PERFORMANCE OR NON-PERFORMANCE OF THE SERVICES OR PRODUCTS SHALL BE LIMITED TO A CREDIT TO
CUSTOMER FOR THE SERVICES OR PRODUCT, UNLESS OTHERWISE SPECIFIED.
MAITLAND WINTER PARK PLUMBING, INC. SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING THE LOSS OF
PROFITS OR INCOME, ARISING DIRECTLY OR INDIRECTLY FROM ANY ACTION OR INFRACTION BY MAITLAND
WINTER PARK PLUMBING, INC.

Maitland Winter Park Plumbing to provide labor, materials, and supervision to install additional hot
water piping to serve existing fixtures plumbed with cold water only. New piping connected to
existing hot water piping in ceiling. Pipe, fittings, valves, supply stops, and connecting tubes to the
following:
A. Four (4) ADA Lavatories
B. Four (4) 8" center lavatories
City Hall:
Maitland Winter Park Plumbing to provide labor, materials, and supervision to install hot water
system for existing lavatories plumbed with cold water only. Pipe, fittings, valves, supply stops, and
connecting tubes to the following:
A. Eight (8) 8" center lavatories
B. Four (4) ADA Lavatories
City Hall hot water system to include:
A. One (1) 50 gal. hot water heater
B. One (1) circulating pump
C. One (1) heater safety pan
D. Electrical work by others
All new installed piping to be covered with 'A" wall armoflex insulation. Pipe work concealed within'
existing chaseways, ceilings and walls. Some minor tile repair will be required by other. All work
performed according to local codes and ordinances. Job duration, one week, start to finish. Proposal
pricing using type L hard copper. Substitute CPVC solvent weld pipe and fittings.
