Rosenthal, Esquire, City Attorney, Mr. Ellis Shapiro, City Manager, Ron Strosnider, Fire Chief DATE: December 6, 1999 RE: Authorization to File Suit on Fire Stations #3 and #4, City of Ocoee The City of Ocoee has completed the remedial work relating to the grading, drainage, driveway and air conditioning systems at the above-referenced facilities. As previously reported, construction and design problems plagued the development of Fire Stations No. 3 and No. 4. As a result of these problems, the City incurred added costs as follows: H V AC Repairs - F.S. #3 -$20,144.00 I I VAC Repairs - F.S. #4 - $20,144.00 1-I V AC Consultant- $1,100.00 Site and Drainage Repairs - F.S. #4 - $90,879.20 Site Consultant - F.S. #4 - $2,638.00 Legal Fees and Expenses - $16,000.00 The City is holding $26,064.00 on the construction contract for F.S. #4 to setoff against these damages. Legal counsel recommends that the City file suit against the engineering firm, Gee &Jenson, and the Contractor, Priority 1 of Brevard, Inc., and its surety, Travelers Casualty & Surety Company, to recover its damages.
