ISSUE:
Should the Mayor and City Commissioners approve the Preliminary / Final Site Plan for the
Florida Auto Auction of Orlando?
BACKGROUND:
The Florida Auto Auction of Orlando has been operating in Ocoee for many years and covers

a II Farms Road ate Maguire Road to the east and Story Road to the north, with a
relatively small piece located north of Story Road. Most of the subject property is zoned C-3,
with the piece located north of Story Road zoned of I-1. The property surrounding the Auto
Auction property has mostly C-3 zoning to the south and east, and Industrial zoning (I-1 and I-
2) to the north. This Preliminary / Final Site Plan is for proposed improvements to the Auto
Auction property which will be constructed in phases.
Phases 1 and 2 as shown on the plans, involve providing a paved surface over a large portion
of the eastern and northern parts of the site, along with the appropriate stormwater
management improvements, and turn lanes on Marshall Farms Road. Phase 3 as shown on
the plans involves additional paving and retention pond improvements near the south end of the
site and realigning the Story Road entrance at the north end of the site.
DISCUSSION:
In response to direction from the City Commission, Staff has asked the applicant to include a
"Master Plan" for all the Auto Auction property in this plan set, in order to establish a base line
for reference when reviewing these proposed improvements and any future improvements.
That Master Plan has now been provided, with most of the information presented in the Land
Use Summary table on Sheet A-1 and in the Master Plan drawing on Sheet A-2 of the plan set.

As part of the review process for the proposed improvements at the Auto Auction, the applicant
was asked to prepare a traffic analysis reflecting the traffic impacts of the current Auto Auction
operations and the additional impact of the proposed improvements. As expected, the traffic
analysis showed impacts on most of the roads and intersections immediately adjoining the site.
In order to mitigate the traffic impacts of the proposed development, it was decided that the
most effective off-site road improvements would include right-of-way dedications for Story
Road, Maguire Road and Marshall Farms Road, turn lane improvements on Marshall Farms
Road, and a contribution to the cost of widening Maguire Road. Due to the extent of these
agreed upon traffic mitigation requirements, a Development Agreement (draft copy attached)
has been prepared which provides the details of how and when each of the mitigation
requirements will be satisfied.
This Preliminary / Final Site Plan includes numerous waivers from the current standards for new
development. However, since most of this property is already developed and the new
development will be an extension of that same development pattern, and given the unique
characteristics of the site and the operations of the Auto Auction, Staff has determined that all
of the proposed waivers are acceptable for this site.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Preliminary / Final Site Plan for the proposed improvements at the Florida Auto Auction of
Orlando was reviewed by the Development Review Committee (DRC) on September 6, 2000.
There was a lengthy discussion regarding the Staff comments (attached), during which the
applicant agreed to make revisions to satisfy essentially all of Staff's concerns. However, there
were still a few issues remaining which required policy direction from the City Commission and
the need to make some modifications to the Land Development Code.
The Committee voted unanimously to recommend approval of the Preliminary / Final Site Plan
for the Florida Auto Auction of Orlando (date stamped received August 29, 2000), with the
incorporation of the City Staff comments as set forth in the DRC report dated September 6,
2000, as modified by agreements at the DRC meeting. The plan set included in the P & Z
package (date stamped September 8, 2000) was the same plan set which was reviewed by the
DRC. The applicant has been working to make the requested revisions since the DRC
meeting.
SPECIAL CITY COMMISSION MEETING:
At the request of the Staff, a Special City Commission meeting was held on September 7, 2000
to address certain policy issues impacting the review of the Preliminary / Final Site Plan.
One issue related to the Auction's proposal for the piping of an existing ditch / canal located
within the 100-year flood plain and as a result the proposed piping (as well as certain off-site
drainage improvements requested by the City) would be prohibited by the Ocoee
Comprehensive Plan since it falls within the definition of "development" under the Land
Development Code. The City Commission agreed with the staff recommendation to address
this issue by amending the LDC definition of "development" to exclude "the piping, covering or
crossing of existing man-made canals or ditches". This amendment will be presented to the
Planning and Zoning Commission and City Commission at subsequent meetings.

Additionally, Staff and the Auction were unable to agree on certain matters related to the
financial contribution to be made by the Auction to mitigate certain traffic impacts. Since these
were policy issues, they were presented to the City Commission. The enclosed draft of the
Development Agreement incorporates the City Commission's policy direction on these issues.
PLANNING 8 ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission considered the Preliminary / Final Site Plan for the
Florida Auto Auction of Orlando on September 12, 2000. Staff and the Applicant's
representatives answered numerous questions from the Commission regarding various
elements of the plan. There were also a few questions from the public which were also
answered. When the discussion was finished, the Planning and Zoning Commission voted 6-1
to recommend approval of the Preliminary / Final Site Plan for the Florida Auto Auction of
Orlando, subject to the Conditions recommended by the Staff.
STAFF RECOMMENDATION:
Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff
recommends that the Mayor and City Commission approve the Preliminary / Final Site
Plan for the Florida Auto Auction of Orlando, as date stamped received by the City on
September 13, 2000, subject to: 1) approval and execution of a Development Agreement
addressing transportation and other issues; 2) the stipulation that proposed piping of
the ditch I canal is conditioned upon City Commission adoption of an amendment to the
Land Development Code exempting such piping from the definition of "development";
and 3) incorporation of the attached Staff comments into the plans prior to November 1,
2000.

In connection with the above-referenced project, we have reviewed the following

1. Florida Auto Auction of Orlando Preliminary/Final Site Plan stamped received by

2. Response of Florida Auto Auction of Orlando prepared by Robert E. Wiegers,
AICP, of Canin Associates, Inc. dated September 13, 2000 and stamped received

3. Exhibits "A", "B", and "C" to the Development Agreement prepared by Canin

All references herein to the "Project" refer to both the existing and proposed Improvements.
Any terms not defined shall be as defined in the proposed Development Agreement.
This memorandum supersedes our memoranda dated August 18, 2000 and August 31,
2000. Based upon our review of the documents noted above, pursuant to the Land Development
Code,we have the following comments:
1. The legal description set forth in Exhibit "A" is inconsistent with the legal
description in the Survey. The discrepancies are noted on the attached marked up
copy of Exhibit"A". Please resolve the discrepancies.

2. The information provided in connection with the Development Agreement
identifies the owner as "Manhaeim Remarketing, LP". Please revise Sheets A-I,
B-3,and C-3 for consistency.
3. Pursuant to the Development Review Committee discussion, please add the
following Conditions of Approval:
On or before November 1, 2000, Owner shall provide an irrigation
plan to the City for review, approval, and administrative
incorporation into the approved P/FSP.
On or before November 1, 2000, Owner shall provide plan sheet(s)
which identify the location of all existing water and wastewater
utilities, including water meters, on the Property for review,
approval, and administrative incorporation into the approved

The following comments are offered in addition to the previous comments dated August 31, 2000
on the submitted Preliminary/Final plan. The comments numbered 3-9, 12-15, 17-26, 29 and 30
have been resolved and require no further action. The remaining comments are numbered to
correspond to the numbers on the previous comments.
1. A copy of the SJRWMD permit shall be submitted to the City for this project.
Please fonvard to the City upon receipt.
2. Submit a copy of the DEP permits or an exemption letter for the water and wastewater lines
associated with this project.
Please forward to the City upon receipt.
10. In accordance with City of Ocoee design standards, minimum side slopes of 5:1 are required
on all stormwater retention ponds. The plans show 3:1 slopes. Please revise as necessary.
A waiver from Ocoee's Land Development Code has been requested.
11. In accordance with the master plan requirements for this site,please identify the location of
all existing water and wastewater utilities, including pipe diameter and water meter locations
on the entire site.
This will be provided to the City by November 1, 2000,per DRC discussions.
16. Please review the storm sewer calculations (NETWORX printout) and revise the calculations
as necessary to address the following items:
• In accordance with City of Ocoee design standards, the storm sewer system must be
designed to handle the 10-year storm. The calculations indicate a 3-year design
storm.
A waiver from Ocoee's Land Development Code has been requested to allow
this design.

• The City's 3 foot cover requirement does not appear to be met at various locations of
the storm sewer system, such as RI (2.45' downstream; 1.95 upstream).
Some inlet elevations have been adjusted, however, there are still locations
where the 3 foot cover requirement is not being met.
27. A fire hydrant will be required in the area of the proposed Vehicle Registration building.
Please contact the Fire Department to determine placement of the hydrant.
The hydrant has been placed too close to the building. The re-location shall be
coordinated with the fire hydrant in the field.

Preliminary/ Final Site Plan, Received September 13, 2000
The following comments need to be addressed and the revisions incorporated into the plans by
November 1, 2000.
1) General Note # 1 on Sheet A-3 should indicate that the shade trees will be oak trees
and that the understory trees will be a mixture of holly trees and ligustrum trees (at least
one third ligustrum).
2) General Note # 2 on Sheet A-3 should indicate that the sizes of the trees will be
measured in DBH (diameter at breast height) rather than caliper. The figures shown are
correct (shade trees 3"-3 %" DBH; understory trees 2"-2 1/2" DBH).
3) Both the Landscape Buffer Plan and Landscape Buffer Section drawings on Sheet A-3
should show the location of the 6' fence (clearly labeled) that will be erected around the
perimeter of the site, relative to the landscape buffer and the storage area/parking lot
pavement.
4) Revise right-of-way dedication lines and the 10' landscape buffer on all appropriate plan
sheets, per the Development Agreement, to reflect a 50' safe sight triangle at the
intersection of Story Road and Maguire Road, and the appropriate turning radius for the
curve at the Maguire Road and Marshall Farms Road intersection.
