At the commission meeting of September 21, 1999, Ms. Frances Watts employed by the
City of Ocoee as a School Crossing Guard, raised two issues before the commission.
ISSUE ONE
Ms. Frances Watts believes that all Crossing Guards should be paid for holidays and she
further advised the commission that she was not paid for Labor Day.
First, Ms. Frances Watts was indeed paid for the Labor Day Holiday.
Secondly, the Mayor and Members of the Commission adopted the revised Personnel
Rules and Regulations on March 2, 1999 under Ordinance Number 99-12. Under the
revised rules, specifically Section 8.02 Eligibility for Holiday Pay, C 2 "Part-time
employees who are assigned a regular schedule of more than twenty (20) but less than
forty (40) hours a week, shall receive four(4) hours at their regular rate etc."
The above rule is very clear as to which part-time employees are eligible for Holiday Pay.
The City employs eight(8) crossing guards. Five (5) crossing guards work twenty (20)
hours or more a week thereby qualifying for the Holiday pay. Three (3) crossing guards
work less than twenty (20) hours per week therefore,they do not qualify for Holiday Pay
under Section 8.02, C 2.

ISSUE TWO
Shall the city pay all part-time employees whose pay was affected by Hurricane Floyd
and Tropical Storm Harvey and provide the number of affected employees and cost
analysis. See attached.
Under the General Provision Section 1, 102 B Employees Other Than Full-time,
"Temporary, casual, part-time and grant employees shall serve at the will and pleasure
of the City Manager and shall not be entitled to any benefits provided to full time
employees unless otherwise provided in a specific Article or Section of the PRR or
otherwise required by applicable law etc."
At the present time the City of Ocoee employs 23 Part-time employees. Although the
dollar amount for both storms appears to be a small amount this will increase each year
with the addition of more and more part-time employees hired by the City of Ocoee.
If the City of Ocoee were to pay these employees at this time, we would be faced with
having to pay part-time employees for all emergencies in the future. This would be
contrary to the at will employment policy and will become very costly in the future.
