ISSUE:
Should the Mayor and City Commissioners approve this Special Exception to permit AT&T
Wireless Services to locate a 150-foot telecommunication tower and related facilities at 835
Marshall Farms Road?
BACKGROUND:
The subject property is located north of SR 50 and east of Marshall Farms Road (refer to
attached location map). The applicant is proposing to lease a ±0.13 acre section of property at
the southeast corner of the subject property to locate the tower and related facilities. The
applicant has submitted the special exception application as required by the Ocoee Land
Development Code, Section 5-19—Telecommunications Service Facilities (established by
Ordinance 97-12). The special exception request is to permit a 150-foot monopole
communication tower with a maximum of 24 flush mounted dual polarized antennas. AT&T
Wireless Services is the only service provider at this time; however, the tower design will permit
up to three (3) additional service providers.
The proposed tower meets the "tower to residential" separation requirements and the "tower to
towel" separation requirements. There are three (3) existing towers in the vicinity of the
proposed tower (refer to the attached location map): one (1) 1,800 feet to the northeast (Bluford
Avenue); one (1) 2,600 feet to the southwest (SR 50 & FL Turnpike); and one (1) 3,270 feet to
the southeast (Rew Circle). The applicant has submitted a certified statement by a Florida
licensed engineer that the proposed facility will not interfere with the public safety system or
other reception or transmission services. The Land Development Code requires that
telecommunication service facilities submit an annual report to the City indicating the number of
carriers, type of service provided, and the appearance of the facility.

The Telecommunications Service Facility Ordinance takes an area based approach to
communication tower location as opposed to the more commonly used zoning based approach.
The Ordinance divides the City into three tower / service facility location areas—Areas One
Two, and Three.
Following is a summary of the types and height of communication towers permitted in each of
the three areas:
• Area One covers approximately 80 percent of the City and permits building mounted,
camouflaged, and innovative communication towers. The maximum height permitted for a
camouflaged tower is 75 feet and 125 feet is permitted for innovative towers. Building
mounted towers may not exceed 50 feet.
• Area Two covers approximately 10 percent of the City and is primarily highway commercial
in nature. In addition to the facilities listed above, Area Two permits monopoles and guyed
towers at a maximum height of 150 feet.
• Area Three covers the balance of the City and is primarily industrial in nature. In addition to
the above listed facilities, Area Three permits lattice towers. Communication towers in Area
Three may not exceed 200 feet in height.
The proposed monople is compatible with the surrounding character and uses in the area.
Industrial uses border the subject property to the north and commercial uses border the
property to the east, south, and west. Exhibit A, attached, is a photo simulation which depicts
what the proposed tower will look like upon installation. The photo was taken from an access
road leading to the leasehold, facing east.
DISCUSSION:
The proposed communication tower complies with requirements of the Section 5-19 of the Land
Development Code (LDC) with two exceptions. The applicant is requesting two waivers from
Sections 5-19 of the LDC. The first waiver requested is from Section 5-19 (H) 7—Osprey/Eagle
Nesting. The LDC requires that telecommunication service facilities incorporate a design that
provides an integral nesting platform for the osprey / eagle to reduce the risk of interference
with tower equipment and maintenance. The flush mounted dual polarized antennas are not
suitable for osprey / eagle nest habitats and thus a nesting platform is not necessary. In
addition, the absence of a nesting platform will lessen the visual impact of the tower by reducing
the silhouette of the tower. The second waiver requested is from Section 5-19 (H) 8—Security
Barrier. The LDC requires that a security barrier surround all facilities and be located on or
within five feet of the property boundary or leasehold. The applicant is unable to place a
security barrier around the leasehold or within five feet as required, as a drainage ditch
traverses the leasehold. Plans for the tower depict a security barrier encompassing the tower
and related facilities.

DEVELOPMENT REVIEW COMMITTEE:
On September 6, 2000, the Development Review Committee (DRC) met to consider AT&T
Wireless Services' application for a Special Exception to install a 150 foot monopole and related
facilities at 835 Marshall Farms Road (Case Number 1-6SE-99). After a few general questions,
the DRC unanimously recommend approval of the Special Exception with two conditions as
follows;
• No new overhead power lines; and
• The color of the tower should be a medium tone gray.
The two conditions of approval by the DRC have been addressed on the plans date stamped
"Received, September 7, 2000" (attached).
PLANNING AND ZONING COMMISSION:
On September 12, 2000, the Planning and Zoning Commission, at their regularly scheduled
meeting, considered the AT&T Wireless Services' Special Exception, Case Number 1-6SE-99.
During the public hearing, the applicant's attorney requested that the City consider permitting
the tower to remain in its natural state (unpainted), citing that painting the tower would create
maintenance problems. After discussion of the special exception, the Planning and Zoning
Commission recommended approval of the Special Exception with the condition that the
exposed galvanized metal of the pole be a medium tone flat gray in appearance.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Honorable Mayor and City Commissioners approve the
AT&T Wireless Services' Special Exception, Case Number 1-6SE-99, to permit the following:
• the installation of a 150-foot monopole communication tower and related
facilities; and
• a maximum of 24 flush mounted dual polarized antennas; and
• a waiver from Section 5-19 (H) 7 of the Land Development Code; and
• a waiver from Section 5-19 (H) 8 of the Land Development Code; and
• the exposed galvanized metal of the pole be a medium tone flat gray in
appearance.
