ISSUE:
Should the Mayor and City Commissioners approve a Special Exception and Preliminary
Subdivision /Site Plan for Wal-Mart Supercenter?
BACKGROUND:
The proposed Wal-Mart Supercenter is to be developed on a 35.9 acre tract located at
the southwest corner of State Road 50 and Blackwood Avenue. This remnant orange
grove is zoned C-2, Community Commercial District, and is also accessible on the south
from Old Winter Garden Road. The parcel is bound on three sides"by other commercial
uses; namely, Ocoee Commerce Center to the west, Lake Bennet Centre to the north
and Health Central Hospital to the east. To the south of the site is Oak Forest
Apartments. The development is within the State Road 50 Activity Center and is subject
to the upgraded standards of the Commercial and Industrial Development regulations.
The development program for the Wal-Mart Supercenter entails two main components:
1) Construction . of the 213,611 s.f. Supercenter building itself with
associated site improvements including an integrated Tire Lube Express
facility. This "TLE" requires approval of a Special Exception since it falls
under the Service Station category of the Land Development Code.
2) Development of five outparcel lots, three facing State Road 50 and two
fronting Blackwood Avenue., All outparcels will be accessed from shared
driveways within the site. Four of the outparcels are just over one acre in
size with the remaining parcel being almost two acres in size.

Uses for the two outparcels on Blackwood Avenue have been voluntarily limited to
professional offices. All other outparcels are permitted from typical C-2 uses except that
car lots, boat lots and pawn shops have been voluntarily restricted. Further, Lot 4, the
outparcel nearest the intersection of State Road 50 and Blackwood Avenue, has been
further restricted by Wal-Mart from development of automobile service stations or
convenience stores with gas sales.
DISCUSSION:
Transportation Features
Planning for the Wal-Mart Supercenter project has taken a significant amount of time
primarily due to the need for resolution of transportation issues. Throughout the
extensive traffic impact study process, Staff has emphasized the need for Wal-Mart to
mitigate its traffic impacts so as to not adversely affect surrounding roadways. As a
result of these reviews and negotiations, City Staff and the developer have assembled a
traffic improvement package which reflects practical improvements designed to keep the
area-wide roadway system functioning in a manner which meets concurrency guidelines.
The multiple access points provided from all of the surrounding roadways is designed to
balance traffic flows so as to dispense traffic to minimize congestion. Details regarding
each of the proposed roadway improvements are shown on the Preliminary Plans and
further identified in a Development Agreement which is to be considered concurrently
with the Preliminary Plans. A summarized list of Wal-Mart's transportation mitigation
contributions are as follows:
• Add southbound right turn lane at Bluford Avenue and State Road 50.
• Create dual northbound left turn lanes with raised median separators at Old
Winter Garden Road and State Road 50.
• Provide new directional left turn lane and right in / right out entry to site from
State Road 50 including expansion of median separators along State Road
50.
• Provide new right turn lanes leading into site from Blackwood Avenue and
dedicate 15 feet of additional right-of-way to the City.
• Provide new southbound and northbound right turn lanes on Blackwood
Avenue at State Road 50 and at Old Winter Garden Road including the
dedication of an additional 15 feet of right-of-way.
• Provide left and right turning lanes into the site from Old Winter Garden Road
and dedicate 25 feet of additional right-of-way for the Old Winter Garden
Road widening project.

• Upgrade traffic signals at State Road 50 and Old Winter Garden Road and at
State Road 50 and Blackwood Avenue as required, plus provide a temporary
traffic signal at Blackwood Avenue and Old Winter Garden Road with an
additional cash contribution for permanent signal installation as part of the
Old Winter Garden Road widening project.
None of these traffic improvements or right-of-way dedications will be credited against
impact fees. Thus, in addition to these contributions, the Wal-Mart project will also
generate over one million dollars in transportation impact fees which may be used to off-
set City costs for the widening of Old Winter Garden Road and Professional Parkway.
Site Features
This project was designed in strict accordance with the State Road 50 Activity Center
Plan and the upgraded Commercial and Industrial Development Regulations. As a
result, the Plan incorporates many upgraded features that would not normally be a part
of a Wal-Mart Supercenter. As provided for within the Activity Center regulations, Wal-
Mart has negotiated with Staff on a number of proposed waivers which depart from the
strict technical requirements of the Code, but which nonetheless make good sense when
balanced against the off-setting design features of the site which exceed Code
requirements.
Significant site features of this project which will create an upgraded retail center include
the following:
•
• Accent water feature with fountain
• Architecturally integrated site signage
• Enhanced green space and landscaping within the parking lots, around the
perimeter of the site and adjoining the buildings
• Outdoor covered patio with clock tower accent
• Extensive pedestrian amenities throughout the site including crosswalks with
separators at the main entry points and numerous siting areas
• Landscaped cart corral islands in parking lots
• Site lighting package consistent with new regulations providing a safe
illumination intensity while limiting glare
• Stormwater retention ponds all configured and landscaped and Wal-Mart to
assist City with the Lake Bennet outfall project

Waivers -
Requested waivers related to site features include:
1) The computation of parking based upon gross leasable area versus gross
square footage. There is a significant amount of the Supercenter building
that is utilized for storage only, and the amount of parking shown actually
exceeds the typical 5 spaces per 1,000 s.f. requirement.
2) The ability to have more than two outparcels in a row and more than 50%
of the roadway frontage taken up by outparcels. This waiver is offset by
the limitations on uses previously identified and the manner in which open
space is structured around the site.
3) The ability to provide a greater amount of wall signage on the front of the
building. The amount of signage provided is far below what is typically
provided on a Wal-Mart Supercenter and is shown to be comparable to
that which would be permitted for individual uses within a conventional
shopping center having multiple businesses.
4) The ability to consolidate landscaping within the interior of the Wal-Mart
parking lot to set up a more significant internal buffer. The amount of
green area and the number, size and type of required plant materials still
meet all Code requirements even if spacing of islands is modified.
5) The ability to reduce building setback along Blackwood Avenue. This
provision permits the construction of office buildings exhibiting a more
urban character in closer proximity to the road so that parking is
predominately internal to the shopping center thereby creating a building
buffer for the hospital.
Building Features
The architectural character of the proposed Wal-Mart Supercenter is significantly
different from that typically constructed in this area. Staff has worked closely with the
Wal-Mart architect to ensure that the types of architectural elements identified within the
City's upgraded regulations were incorporated into the design. In addition, all future
outparcel uses will need to incorporate elements of the Wal-Mart design within their
buildings to provide an architecturally integrated project.

Significant building features of this project which will create an upgraded retail center
include the following:
• Natural color scheme using warm browns, tans and orange tile accents._
• Clay tile roofs over extended pedestrian walkways creating a continuous covered
pedestrian arcade with arched windows.
• Completely enclosed and architecturally integrated garden center directly
accessible by covered walkway from the main building.
• Extensive design accents including pilasters, caps, belt courses, eifs wall
treatments, decorative cornices, gables and arches.
• Location of all loading areas to the rear of the building screened from view with
masonry walls.
• Screening of all outside ground mounted and roof top mechanical equipment and
the elimination of all outside vending or retail sales displays.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
On July 17, 2000, the Development Review Committee met with representatives of
Wal-Mart to review the proposed Plans and resolve all outstanding issues. After a
detailed review and negotiation of all outstanding issues, the Development Review
Committee found that the Wal-Mart Supercenter project successfully fulfilled the goals
and intents of the upgraded Land Development Code regulations. Accordingly, they
voted unanimously to recommend approval based upon the Plans currently submitted
for approval.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
At their regular meeting on August 8, 2000, the Planning and Zoning Commission held
Public Hearings for both the Tire Lube Express Special Exception and the Wal-Mart
Supercenter Preliminary Subdivision Plan and Site Plan. Presentations were made by
City staff and the developer to explain the various aspects of the project with particular
regard to traffic mitigation, landscaping, and architectural issues. During the Public
Hearing, a number of citizens spoke with particular concerns regarding traffic impacts to
surrounding streets. Representatives from Health Central were there to express
concern about potential traffic impacts which could inhibit access to the hospital
emergency room. After much discussion and debate regarding this issue as well as
other detailed site issues, the Planning and Zoning Commission voted unanimously to

recommend approval of the project in accordance with the Staff recommendation, with
the stipulation that the City Commission address the issue of alternative emergency
access for Health Central from State Road 50.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Mayor and City Commissioners in separate
votes (1) approve the Tire Lube Express Special Exception, and (2) approve the
Preliminary Subdivision Plan and the Preliminary Site Plan for the Wal-Mart
Supercenter as submitted, Plans date stamped received by.the City on August 1, 2000,
subject to approval of the Development Agreement.
