BACKGROUND: The updated Commercial and Industrial Development regulations permit the City Commission, at its sole discretion, to waive provisions within the Land Development Code when plans have been designed to: 1) be part of an integrated and master planned development; 2) be compatible with surrounding developments; 3) impose no impacts on City infrastructure greater than that generated by other uses normally permitted in the underlying zoning district; and/or 4) provide an off-setting public benefit which is technically sound and measurable. DISCUSSION: The Land Development Code gives the Planning Director authority to negotiate waivers when a specific plan furthers the goals and intents of the Commercial and Industrial Development Regulations. In the case of the Watson Office Plaza, the applicant has agreed to provide additional landscape buffer along the eastern property boundary for the future expansion of Blackwood Avenue. By providing this larger landscape buffer, the future widening of Blackwood Avenue can occur without severely impacting the landscape or parking areas associated with this project. Recognizing the positive public benefits derived by minimizing the impacts to. parking and landscape areas, Staff has worked with the owners to design their site in a manner which creates a larger landscape buffer that it is compatible with surrounding developments without imposing additional impacts on City infrastructure. 0:::: .: : :,: :::.:: Protettbees 1'!aIerRe ores=j August 28, 2000 Mayor and City Commissioners Page 2 The owner is requesting that a waiver from parking be permitted, basing it on Gross Leasable Area versus Gross Square Footage. This waiver request will allow the owner greater flexibility with respect to leasing space for medical office uses, This type parking waiver has been granted numerous times on other projects since parking ratios relate more directly to useable building space than overall area. RECOMMENDATION: Staff respectfully recommends that the Mayor and City Commissioners approve the proposed waiver for the Watson Office Plaza (Project No: SS-2000-002) in order to preserve the additional landscape buffer.
