More specifically amending Article II, Section 2-4 (C)(81)—Definition of Development and Article V—Table 5-1 "Use Regulations"? BACKGROUND: The City Commission approved the Master Plan and Development Agreement for the Florida Auto Auction on September 19, 2000. The approval of the Master Plan and Development Agreement for the Florida Auto Auction has resulted in the need to proceed with two amendments to the Land Development Code (LDC). This first proposed amendment to the LDC is to Article V—Table 5-1 "Use Regulations". The second proposed amendment to the LDC is to Article II, Section 2-4(C)(81), definition of development. The proposed modifications to the LDC are included in Ordinance 2000-27 (attached). DISCUSSION: This first proposed amendment to the LDC is to Article V—Table 5-1 "Use Regulations". This amendment will add "Motor Vehicle Wholesale" as a new use category to Table 5-1, Use Regulations. Motor Vehicle Wholesale will be a permitted in Zoning Districts C-3 (General Commercial), I-1 (Restricted Manufacturing and Warehouse), and 1-2 (General Industrial) and prohibited in all other Zoning Districts. This modification to Table 5-1 is merely updating the use categories in the Table to include a use that has historically operated in the City for many years. The amendment will modify the uses or activities considered not to be development to include "the piping, covering, or crossing of existing manmade canals or ditches". DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: On September 19, 2000 the Development Review Committee met to review the proposed changes to the Land Development Code. Due to the limited nature of the proposed amendments, the DRC, with little discussion, voted unanimously to recommend approval of Ordinance 2000-27. PLANNING AND ZONING COMMISSION RECOMMENDATION: At their meeting on September 27, 2000, the Planning and Zoning Commission held a Public Hearing to receive input on the proposed changes to the Land Development Code. There was no one present from the public to speak to this issue. After some discussion regarding the need to protect natural floodplains and the need to preserve viable wetland areas, adjoining ditches, manmade or otherwise, the Planning and Zoning Commission voted unanimously to recommend adoption of Ordinance 2000-27. STAFF RECOMENDATION: Based upon the recommendations of the Development Review Committee and the Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commissioners adopt Ordinance 2000-27 amending Article V—Table 5-1 "Use Regulations" and Article II, Section 2-4 (C)(81)—Definition of Development of the Chapter 180 of the Code of Ordinances. WHEREAS, the City Commission of the City of Ocoee desires to specifically provide for the zoning districts in which the wholesaling of motor vehicles is permitted within the City; and WHEREAS, the City Commission desires to restrict motor vehicle wholesaling to C-3 General Commercial District, I-1 Restricted Manufacturing and Warehousing District, and I-2 General Industrial District; and WHEREAS, the City Commission desires to amend the Code of Ordinances so that the piping, covering or crossing of existing manmade canals and ditches does not fall within the definition of "Development." NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment to Use Regulations Table. Table 5-1 entitled "Use Regulations" of Article V of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as set forth on Exhibit "A" attached hereto and incorporated herein by this reference, which amends Table 5-1 and lists "Motor Vehicle 006.168956.2 Wholesale" as a permitted use in Zoning Districts C-3, I-1, and I-2 and prohibits the wholesaling of motor vehicles in all other zoning districts. SECTION 3. Amendment to Definition of "Development." Section 2-4(C)(81) of Article II of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida is hereby amended to read as follows (with additions underlined and deletions stricken): (81) Development: (a) The carrying out of any building activity or mining operation, the making of any material change in the use or appearance of any structure of land, or the dividing of land into two or more parcels. (b) The following activities or uses shall be taken for the purposes of this Code to involve development as defined in this Section: 1. A reconstruction, alteration of the sue, or material change in the external appearance of a structure on land. 2. A change in the intensity of use of land, such as an increase in the number of dwelling units in a structure or on land or a material increase in the number if of businesses, manufacturing establishments, offices, or dwelling units in a structure or on land. 3. Alteration of a shore or bank of a seacoast, river, stream, lake, pond, or canal, including any "coastal construction" as defined in Section 161.021, Florida Statutes. 4. Commencement of drilling, except to obtain soil samples, mining, or excavation on a parcel of land. 5. Demolition of a structure. 6. Clearing of land as an adjunct of construction. 7. Deposit of refuse, solid or liquid waste, or fill on a parcel of land. (c) Notwithstanding anything in this Chapter to the contrary, the The following operations, Of uses or activities shall not be taken for the purpose of this Chapter to involve `development" as defined in this section: 2- 006.168956.2 1. Work by a highway or road agency or railroad company for the maintenance or improvement of a road or railroad track, if the work is carried out on land within the boundaries of the right-of-way. 2. Work by any utility and other persons engaged in the distribution or transmission of gas or water, for the purpose of inspecting, repairing, renewing, or constructing on established rights-of-way any sewers, mains, pipes, cables, utility tunnels, powerlines, towers, poles, tracks or the like. 3. Work for the maintenance, renewal, improvement, or alteration of any structure, if the work affects only the interior or the color of the structure or the decoration of the exterior of the structure. 4. The use of any structure or land devoted to dwelling uses for any purpose customarily incidental to enjoyment of the dwelling. 5. The use of any land for the purpose of growing plants, and harvesting crops, trees, and other agricultural or forestry products; raising livestock; or for other agricultural purposes. 6. A change in use of land or structure from a use within a class specified in an ordinance or rule to another use in the same class. 7. A change in the ownership or form of ownership of any parcel or structure. 8. The creation or termination of rights of access, riparian rights, easements, covenants concerning development of land, or other rights in land. 9. The piping, covering or crossing of existing manmade canals or ditches. SECTION 4. Conflicts. All ordinances, resolutions, parts of ordinances, or parts of resolutions of the City of Ocoee in conflict herewith are hereby repealed and rescinded. 3- 006.168956.2 SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto.
