BACKGROUND: The Lake Johio Subdivision, to include a total of 87 single family residential lots, is located on the east side of Clarke Road,just north of Silver Star Road. The western portion of the subject property is currently zoned R-1-A. The eastern portion of the property is currently under consideration for annexation (Ordinance No. 99-39) with an initial zoning of R-1-AAA for the lakefront lots and R-1-A for the remainder of the property to be annexed (Ordinance No. 99-40). The property surrounding the proposed subdivision has R-1-A and R-1-AAA zoning (north — single family homes), PUD zoning (west — single family homes), and C-2 zoning (south - vacant). Lake Johio occupies most of the eastern boundary of the property. The western portion of the property is currently occupied by an orange grove, while the eastern portion of the property is mostly open pasture with a few houses and some trees (mostly oaks). All but one of the structures currently on the site will be removed with the last remaining lake front house being incorporated into the new subdivision. PoWF Protect Ocoee's Water Resources December 15, 1999 Honorable Mayor and City Commissioners Page 2 DISCUSSION: The Lake Johio Subdivision is intended to be a private gated community with custom homes. The subdivision will have two points of access, the primary entrance from Clarke Road and a secondary entrance from Silver Star Road, each with a private entrance gate. This subdivision and its association documents will comply with Orange County Resolution # 96-M-22, which stipulates numerous requirements for gated communities regarding the maintenance of the streets and drainage system. Most of the lots (R-1-A zoning) will be a minimum of 70' x 115' (8,000 sf), with the lake front lots (R-1-AAA zoning) a minimum of 85' x 150' (12,750 sf). The minimum living area will be 1,200 sf on the R-1-A lots and 1,600 sf on the R-1-AAA lots. There will be a 6 foot brick wall with appropriate landscaping along the entire western boundary of the subdivision adjacent to Clarke Road. When the commercial property to the south is developed, the developer of that property will build a 6 foot brick wall along the southern boundary. A unique feature of this subdivision is that the stormwater management system and sanitary sewer system are designed, in part, to serve both this subdivision and the adjacent proposed Silver Crossings commercial development south of the western portion of the site. Even though it will also serve the adjacent commercial development, the retention pond in Tract A will be maintained by the Lake Johio Subdivision home owners association. The lift station to be located within this subdivision will also serve the commercial development, but it will be owned and maintained by the City. The Conditions of Approval for the Lake Johio Subdivision are listed on Sheet 1 of the plan set. There is one proposed waiver from Code requirements regarding the need for each lot to have at least 20 feet of frontage on a street. In this proposed subdivision, there are three lots (Lots 29, 30 & 31) which have frontage on a private drive rather than a street. This design is intended to save as many oak trees as possible which are located in that area. The proposed waiver and justification is listed in the Waiver Table on Sheet 1. This proposed waiver is supported by Staff. Additionally, the Plan incorporates undeveloped rights-of-way (Lake Johio Road and Azalea Ranch Lane) which are the subject of a companion petition (Resolution No. 99-22) to vacate these unused roadways. Staff is recommending approval of this petition. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The attached Preliminary Subdivision Plan for the Lake Johio Subdivision was reviewed by the Development Review Committee (DRC) on November 17, 1999. The Committee voted unanimously to recommend approval of the Preliminary Subdivision Plan, including the proposed waiver, subject to several minor revisions. All of the revisions requested by the DRC have been satisfactorily addressed in this plan set. December 15, 1999 Honorable Mayor and City Commissioners Page 3 PLANNING & ZONING COMMISSION RECOMMENDATION: On December 14, 1999, the Planning and Zoning Commission held a public hearing regarding the Lake Johio Subdivision Preliminary Subdivision Plan. Staff answered several questions from the Commission regarding various elements of the plan and the Developer was available for questions if necessary. During the hearing, the Developer's representative pointed out some of the highlights of the plan. He also asked for the Commission's response to a couple of additional ideas that the Developer would like to see incorporated into this development. In response, the Chairman indicated that the P & Z Commission would not address those issues, but the Developer could bring them up to the City Commission. When the discussion was finished, the Planning and Zoning Commission voted unanimously to recommend approval of the Lake Johio Subdivision Preliminary Subdivision Plan, date stamped received by the City on December 8, 1999, in accordance with the staff recommendation. STAFF RECOMMENDATION: Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff recommends that the Mayor and City Commission approve the Preliminary Subdivision Plan for the Lake Johio Subdivision, including the waiver set forth thereon, as date stamped received by the City on December 8, 1999, subject to City Commission approval of Ordinance No. 99-39, Ordinance No. 99-40 and Resolution No. 99-22. It also addressed the potential for building low walls within the flood plain buffer. As you recall, at the November 11, 1999 Development Review Committee (DRC) meeting, you were told that the construction of walls within the flood plain buffer was not be permitted by Code. However, we did not discuss the setback issue. This issue was discussed with the City Manager and City Attorney yesterday to determine the appropriate procedure for considering your request. It was decided that since building setbacks are zoning standards rather than subdivision standards, the City Commission would not be able to consider this as a "waiver" as part of the Preliminary Subdivision Plan approval. A "waiver" from building setback would need to be considered within the context of PUD zoning, or as a Variance through the Board of Adjustment. Therefore, it would be procedurally incorrect to add this proposed building setback of 15 feet to the Preliminary Subdivision Plan as a waiver from Code standards. No. 9908A Mr. Wagner, The enclosed plan should be viewed as a potential addendum to the submitted Preliminary Subdivision Plan. The purpose of this addendum is to explore opportunities with the city on how to treat the lakefront for this project and to look for opportunities to have courtyard designs for the interior lots. Lakefront Lots Proposed enhancements: 1. 15' front setback for garages, 30' front setback living area. 2. All lakefront units to have courtyard design in front yard. 3. Low walls within the flood plain buffer. 4. Nitrate absorbing plant material and native trees along lakefront. Interior Lots Proposed enhancements: 1. Reduce rear yard setback to 15' for all courtyard designed entrances. We believe that these design items will enhance the quality of the project even further. At this time we are presenting these ideas for discussion purposes. Please note that we have revised the preliminary subdivision Plan in accordance with the city standards and are ready, willing and able to construct the project as shown. We look forward to reviewing this project with staff at the 11/17 Development Review Committee meeting.
