Neither the Police Chief nor the H R Director were directly involved in the numerous discussions concerning this topic. In his report to you the Police Chief attached a survey conducted by the Employee Committee. I am also attaching a survey of five additional municipalities. HISTORY: The City has always paid the Christmas holidays as they are now paid(as designated by the Commission)without any problems. It seems the only holiday affected every four years or more is the Christmas holiday and the 4ih of July. The City employs over 325 individuals and it is difficult to please them all, even if we strive to do so. PROCESS: If the procedure is to change as to how we pay the Christmas and 4Ih of July holiday three things must happen. 1. The City Manager must confer with the affected Department Directors and receive input as to how it would effect operations and if in fact they concur with any change. 2. If the City Manager feels a change should occur he/she must submit language to the Personnel Board who shall make a recommendation of such policy to the City Commission for adoption. See page C29 City Charter, attached. THE PRIDE OF WEST ORANGE 3. The change must be posted city wide to enable all city employees to speak on the issue at a commission meeting because it may effect a change in the employee condition of employment. In addition, any proposed change must be negotiated with any unions in effect. We currently have an employee union representing the Firefighters. From: Marilyn Johnson, Human Resources Specialist VI 0 Date: January 9, 2001 Re: Holiday Pay for Police The following cities responded to our inquiries as to how police officers arc paid for holidays: Clermont - Officers on shift Sunday& Monday this year were paid those days at overtime. Other employees were paid holiday pay for Monday and Tuesday, the designated holidays. Lake Mary - Must go over 84 hours in pay period to get overtime for holiday, if it goes over officers are only paid holiday pay for actual holiday worked. St. Cloud - Extra 8 hours straight time paid to all employees on the designated holiday as determined by the City, not always the actual holiday. Only one day off is paid at Christmas. Oviedo - Same as City of Ocoee Casselberry - Paid for actual day per union contract, can have money or time off. All other employees paid for designated holiday. POWr § C-29 CHARTER § C-30 C. When requested by the City Commission, preparing and submitting a complete report to the City Commission on all cases in which the City Prosecutor has represented the city. § C-30. Personnel system. A. Establishment of a Personnel Board. There shall be a Personnel Board consisting of five members appointed by the City Commission for terms of three years. The members of the Personnel Board shall be qualified electors of the city and shall serve at the pleasure of the City Commission. The Personnel Board shall consist of at least one (1) city employee, one (1) City Commissioner, one (1) person who holds a management position with the city and one (1) citizen of Ocoee who is not employed by and does not hold office with the city. All members of the Personnel Board must be qualified electors of the city during their entire term on the Personnel Board in order to remain a member of such Board. Any city employee, City Commissioner or person holding a management position with the city who is appointed to the Personnel Board must hold his respective position with the city during his entire term on the Personnel Board in order to remain a member of such Board. B. Vacancies. Any vacancy occurring during the term of any member of the Personnel Board shall be filled by the City Commission for the remainder of the term. Such vacancy shall be filled within 30 days after the vacancy occurs. C. Powers and duties. The Personnel Board shall be responsible for reviewing personnel policies for the city which are submitted to them by the City Manager and recommending such policies to the City Commission for adoption or amendment. The City Manager shall adhere to all personnel policies. The Personnel Board shall also have such other powers and duties as may be established by ordinance by the City Commission. [Amended 1-5-1999 by Ord. No. 99-076J 6 Editor's Nate:This ordinance was approved by the electorate of the City of Ocoee by referendum 3-9-1999. Said ordinance also provided for an effective date of 6-1-1999. C29 7-10-99 OCOEE POLICE DEPARTMENT INTER-OFFICE MEMORANDUM TO: Jim Shira, Acting City Manager FROM: Robert E. Mark, Chief of Police elk' DATE: January 4, 2001 SUBJECT: HOLIDAY PAY It is my understanding that there has been various discussions regarding changing the policy for holiday pay for shift-work employees. According to the minutes of the Commission Meeting on December 19, 2000, Commissioner Anderson asked that staff review the City's policy, compare it with other cities' policies and then take it to the Employee Committee for review. The City's Rules & Regulations, Section 8.01, states that when a holiday falls on a Saturday or Sunday, the Friday preceding or Monday following shall be designated a substitute holiday and observed as the official holiday. My department has conducted a little bit of research regarding holiday pay and how often it may effect shift-work employees. The only holidays that will fall on a weekend are July 41", Christmas Eve, Christmas Day and New Year's Day. Unfortunately for some employees, Christmas Eve fell on a Sunday this year therefore,the designated substitute/official holiday for the City was Tuesday, December 26'h. This situation will not occur again until the year 2004 with July 4°' falling on a Sunday, Christmas Day falling on a Saturday and New Years Day falling on a Saturday. The Employee Committee previously conducted a survey of six (6) other citys (between February and April of 2000) to ascertain whether or not they differentiate the holiday for shift-work employees. I have attached a copy of the survey for your review. In essence, the only city that differentiates is the Orlando Police Department and they pay the actual holiday; if city employees receive 2 days off for the holiday, shift-work employees (officers) receive only the actual holiday according to their contract. Apparently this has been an issue for approximately 8 months now as it was first brought up at an Employee Committee meeting and no decision has been made yet regarding any change. Holiday Pay Altamonte Springs Same as regular city employees Apopka Same as regular city employees Maitland Do not get holiday pay as agreement is built into their leave accrual Winter Garden Same as regular city employees Orlando Paid on the actual holiday. If city employees get 2 days off for holiday officers still receive only the actual holiday according to their contract. Winter Park Same as regular city employees.
