Cookson, Esq., Assistant City Attorney DATE: March 14, 2001 RE: Deferral of State Board of Education Action on Appeal of Charter School Application On February 6, 2001 the Ocoee City Commission approved a motion to defer the appeal of the Ocoee Charter School Application for sixty (60) days. Based on this action, on February 9, 2001 the attorney the City hired to pursue the appeal, William L. Thompson, Jr., Esq., notified us that he had requested the deferral moving the hearing from February 27, 2001 to April 24, 2001. Nick Gledich, Associate Superintendent for Orange County Public Schools has recently requested that we further defer our appeal another thirty (30) days from the April 24, 2001 date in order for the School Board to avoid incurring legal expenses in preparation of the April 24, 2001 hearing date. Based on the promising ongoing negotiations with the School Board concerning the Ocoee Charter School, and in an effort to avoid incurring unnecessary legal fees by both the City and the School Board in pursuing the appeal, we respectfully recommend that the City Commission advise us to instruct our Charter School attorney, William L. Thompson, Jr., Esq., to further request a deferral of the appeal. Although the School Board has requested only a thirty (30) day deferral, in order to avoid bringing this issue up repeatedly, it is our recommendation that the deferral be for a sixty (60) day period. 006.211867.1
