Preliminary Subdivision Plan

ISSUE:
Should the Mayor and City Commissioners approve the Preliminary Subdivision Plan for the
Clarcona Crossings subdivision?
BACKGROUND:
The Clarcona Crossings subdivision will include a total of 122 single family residential lots to be
constructed in two phases, located on the south side of Clarcona Ocoee Road, between Clarke
Road and Apopka Vineland Road. Except for a few small wood-framed structures in the
northern portion of the site, the subject property is currently undeveloped and is covered with a
large number of trees, consisting of mostly planted\pines and numerous oaks of all sizes. The
southern edge of the subject property abuts the northern boundary of the Sawmill subdivision.
The property surrounding the proposed subdivision has Orange County R-CE and A-1 zoning
(east - undeveloped), R-1-A zoning (south and west — retention pond, Lake Addah and SF
homes), and R-1-AA zoning (north and south - undeveloped).
DISCUSSION:
As shown in the Preliminary Subdivision Plan, the Clarcona Crossings subdivision will have two
points of access from Clarcona Ocoee Road. There will also be two points of access connecting
to adjacent properties to the south — one to the existing Sawmill subdivision (near the east end)
and one to currently undeveloped property which is currently under review for another
subdivision (near the west end). As with other subdivisions, there will be a 6 foot brick wall with
appropriate landscaping along the northern boundary of the subdivision adjacent to Clarcona
Ocoee Road. The property has R-1-AA zoning, dictating a minimum lot width of 75 fe-,
(minimum 9,000 sf). A small amount of additional right-of-way will be provided for Clarcona
Ocoee Road, to be dedicated to the City, in order to accommodate Orange County's current
road widening plans for that road. ���

There are a few unique issues to be addressed by this subdivision plan. One is the fact that the
two portions of the subject property are not contiguous (southeastern area adjacent to the
Sawmill retention pond). A road connecting the two portions will be provided across the corner
of the retention pond tract (owned by the City) to connect the two portions of the subdivision.
Another issue is providing access to a landlocked parcel of land adjacent to the southeast corner
of the southern portion of the.subdivision. That landlocked parcel currently is accessed by a dirt
driveway along the eastern edge of the subject property, adjacent to the railroad tracts. In order
to continue to provide access to that parcel, the subdivision plan provides a separate tract of
land fora private driveway.,leading to that parcel, located between the rear of the adjacent lots
and the railroad tracts.
A third unique issue, the one with the greatest potential impact on the subdivision plan, is the
fact that the current 100 year flood plain elevation for Lake Addah is at 81.0. If that elevation is
used, this subdivision plan as currently presented could not be approved because a large
portion of the development (several lots, retention ponds and a road) will encroach upon the 100
year flood plain, which is not permitted by the Ocoee Comprehensive Plan. . However, the
Project Engineer believes that the 81.0 elevation is not appropriate and.is working with the
Federal:'Emergency Management Agency (FEMA) to have the 100-year flood plain elevation
changed to 70.0, which he believes is appropriate. ' The. City Engineer and the City's
Engineering Consultant are comfortable with.this procedure. Conditions of Approval #'s 45 and
46 address this issue, acknowledging that the Project'Engineer is working to have the elevation
changed and indicating'that if the elevation is not changed, the Preliminary Subdivision Plan will
have to be revised prior to submittal of the Final Subdivision Plan for Phase 2.
This Preliminary Subdivision Plan includes two proposed waivers from certain Land
Development Code requirements. The first waiver is related to the maximum block length of
1,000 feet, which would be necessary because the distance between the two Clarcona Ocoee
Road entrances is 1,350 feet. The second waiver is related to the required 50' building setback
from Clarcona Ocoee Road on two lots, which would be necessary because Lots 11 and 12 are
not as deep as the other lots along that road, due to the additional road right-of-way being
dedicated to the City. Both of these proposed waivers are supported by Staff.
The Preliminary Subdivision Plan for the Clarcona Crossings subdivision was reviewed by the
Development Review Committee (DRC) on February 6, 2001. The Committee voted
unanimously to recommend approval of the Preliminary Subdivision Plan, including the
proposed waivers, subject to making certain revisions to the plans. All of the DRC requirements
have now been satisfactorily addressed in these plans.
PLANNING &ZONING COMMISSION RECOMMENDATION:
On February 28, 2001, the Planning and 'Zoning Commission considered the Preliminary
Subdivision Plan for the Clarcona Crossings subdivision. During the discussion, Staff and the
applicant responded to various questions from the audience and the Commission. There were
numerous questions about saving trees, about changing the 100 year flood plain elevation,
potential flooding, and access issues, as well as a few other topics. When the discussion was
finished, the Planning and Zoning Commission voted 6-0 to recommend approval of the
Preliminary Subdivision Plan for the Clarcona Crossings subdivision, date stamped received by
the City on February 13, 2001, in accordance with the staff recommendation, with additional
conditions and comments as follows:

Additional Conditions:
#47 The Developer shall post signage and/or place temporary barricades that
will require that_all construction access related-to development of.the.site
to be from Clarcona Ocoee Road.
#48 The finished::floor_elevation for all lots within the subdivision shall be at
82.00' or above.
Special Recommendation to the City Commission:
The Planning and Zoning Commission was very concerned about the issues
involved with changing the 100 year flood plain elevation. They understood the'
process proposed by the applicant to change the elevation, but were concerned
about approving a Preliminary Subdivision Plan that shows development within
the 100 year flood plain, which is contrary to conservation policies in the
Comprehensive Plan. Therefore, the Planning and Zoning Commission
expressed their desire to have the City Commission give special consideration to
Condition of Approval # 46 and emphasize the importance of that condition and
direct the City Engineer to closely monitor that process. That Condition requires
the Preliminary Subdivision Plan..to be revised if the 100 year flood plain elevation
cannot be changed as proposed by the applicant.
STAFF RECOMMENDATION:
Based on the recommendations of the DRC and the Planning and Zoning Commission,Staff
respectfully recommends that the Mayor and City Commission approve the Preliminary
Subdivision Plan for the Clarcona Crossings subdivision, including the proposed waivers
and the two additional Conditions of Approval recommended by the Planning and Zoning
Commission, as date stamped received by the City on February 13, 2001.
