Waiver Requests

ISSUE:
Should the Mayor and City Commissioners approve three waivers requested as part of the
Usmani Medical Facility site plan?
BACKGROUND:
The Usmani Medical Facility site is located on the south side of Old Winter Garden Road at its
intersection with Boren Drive and is part of a commercial/industrial subdivision which has been
developed with mostly office uses. The updated Commercial and Industrial Development
regulations permit the City Commission, at its sole discretion, to waive provisions within the
Land Development Code when plans have been designed to: 1) be part of an integrated and
master planned development; 2) be compatible with surrounding developments; 3) impose no
impacts on City infrastructure greater than that generated by other uses normally permitted in
the underlying zoning district; and/or 4) provide an off-setting public benefit which is technically
sound and measurable.
DISCUSSION: •

The Land Development Code gives the Planning Director authority to negotiate waivers when a
specific plan furthers the goals and intents of the Commercial and Industrial Development
Regulations. In the case of Usmani Medical Facility, the unique shape of the site and the City's
plans to realign the intersection of Old Winter Garden Road and Professional Parkway have a
significant affect on the design of the retention pond at the southeast corner of the site. In
Staff's opinion, these constraints would make it unreasonable to force the Applicant to meet the
Code requirements for pond side slopes and the landscape buffer requirements for the
retention pond. There are also several oak trees (12" to 30") located in the central portion of
the parking lot. Knowing the positive public benefits derived by saving trees, Staff has 'orked
with the owners to design their site in a manner which preserves these significant trees. ,, 0

The excerpt drawings from the Usmani Medical Facility site plan (Sheet 4 and the landscape
plan) include the Waiver Table outlining the requested waivers and illustrate the issues involved
in these requested waivers. The first two requested waivers involve the design of the retention
pond and the adjacent landscape buffer. The size, shape and location of the retention pond
dictated that the pond side slopes would need to be 3:1, somewhat steeper than the Code
requirement of a minimum side slope of 5:1. These same factors dictated that there would not
be enough room to meet the normal 10' landscape buffer requirement along the southern edge
of the retention pond. Since the City's plans to realign the intersection of Old Winter Garden
Road and Professional Parkway will result in this retention pond being removed and its
stormwater be relocated, Staff determined that it was unreasonable to make the Applicant meet
those Code requirements on this retention pond.
The third requested waiver involves the data used in the calculation to determine the required
parking on the site. The Applicant is requesting that Net Leasable Area be used in the
calculation versus Gross Square Footage which is normally used. Using Net Leasable Area
would require fewer parking spaces, thus allowing them to preserve more existing trees in the
central portion of the parking lot. This parking waiver has been granted numerous times on
other projects, since parking ratios relate more directly to useable building space than to gross
floor area.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Mayor and City Commissioners approve the three
proposed waivers for Usmani Medical Facility (Project No. SS-2000-009), recognizing that the
retention pond will be removed within a few years, and in order to preserve several significant
oak trees on the site.
