BACKGROUND: The State Road 50 Access Management and Intersection Operations Study was adopted by ordinance as part of the Land Development Code along with the State Road 50 Activity Center Special Development Plan in July of 1998. The Access Management and Intersection Operations Study limits the number, location and configuration of access points along the SR 50 corridor in the City in order to help maintain an acceptable level of service on this very busy arterial roadway. DISCUSSION: A few months ago, the City Commission approved a PUD Land Use Plan Amendment for the West Oaks Square PUD, a small commercial development on the south side of SR 50 across from the West Oaks Mall. That application included a potential second driveway entrance to the site, thus adding an additional access point on the south side of SR 50 approximately % mile east of Clarke Road. The City Commission directed Staff to set up a meeting between the City, FDOT and the Developer to come up with a safe and reasonable additional driveway connection, and if necessary, prepare an amendment to the SR 50 Access Management Plan to accommodate the new driveway. The FDOT meeting was held and all parties have agreed to the provision of an additional right-in only access point to the site together with extension •f the right turning lane. • POW!! NIN\ April 24, 2001 Honorable Mayor and City Commissioners Page 2 The State Road 50 Access Management and Intersection Operations Study did not include a second access point to the West Oaks Square site. Since the change to the PUD provides a second access point from SR 50, even though it is a right-in only driveway, it has been deemed legally necessary to amend the SR 50 Access Management Study to include this additional access point. PLANNING &ZONING COMMISSION RECOMMENDATION: On April 10, 2001, the Planning and Zoning Commission considered this proposed amendment providing for an additional right-in only access point on the south side of State Road 50. During _ the discussion, Staff responded to various questions from the Commission. One of the Commissioners indicated that he did not like this lay-out because he was concerned that it would cause accidents. When the discussion was finished, the Planning and Zoning. Commission voted 6-1 to recommend approval of the proposed amendment in accordance with the Staff recommendation. STAFF RECOMMENDATION: Based on the recommendations of the Planning and Zoning Commission and the direction of the City Commission,- Staff respectfully recommends that the Mayor and City Commission adopt Ordinance#2001-08, approving the proposed Land Development Code amendment to the State Road 50 Access Management and Intersection Operations Study to provide an additional right-in only access point on the south side of State Road 50 approximately one quarter mile east of Clarke Road. Figure 6 of Access Management and Intersection Operations Study adopted by Ordinance No. 98-11 and referenced in Section 6-2.1 of Chapter 180 of the Code of Ordinances of the City of Ocoee is hereby deleted in its entirety and replaced with Figure 6 attached hereto as Exhibit "A" and by this reference incorporated herein. Henceforth, all references to the Access Management and Intersection Operations Study shall mean and refer to said Study as amended by this Ordinance. 006.214546.1 1 SECTION 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. He said a few months ago a proposed amendment had come before`Planning and Zoning Commission for the West Oaks Square PUD, a small,commerciaf 'development on the south side of SR 50 across from the West Oaks,1V1all and east of.,'Citrus Oaks. Mr. Wagner recalled the four elements in that request'were: to,allow restaurant uses; to allow a larger sign; to eliminate the requirement for the;,developer to build a sidewalk; and to allow an additional access point. That approval also included a potential second driveway entrance to the site, thus adding an additional access point on the south side\of\SR`5,0 approximately 1/4mile east of Clarke Road. The City Commission directed Staff\t�o'rneet'-with the Developer and FDOT to come up with a safe and reason`able\additibnal/driveway connection, and if necessary, prepare an amendment to the'`SR 501Access�'1*nagement Plan to accommodate the new driveway. He said the FDOT�meeting jwas held and all parties agreed to the provision of an additional right-in only., access;point-to--theVite together with extension of the right turning lane. As the Aceess\Manage em nt--Plan had been incorporated into the Land Development Code, he._said adding this provision requires a technical change to the SR 50 Access Management-..Plan and consequently to the Land Development Code. He concluded with/Staff s recomm endation for approval. I / 1 Member Matthys'said, as shown, the first access coming eastbound is right-in/right-out and the second one\is,right only. He asked if it would not make more sense to reverse that to have the first\,oneri'ght only and the second one either right-in/right-out or exit only. Mr. Wagner pomted out that the original access serves not only the shopping center that was the subject of the amendment, but also the adjoining strip center. He explained that the possibility which Member Matthys suggested had been considered, but the owner was very concerned about how it limited access to his initial strip center. They were especially concerned about the right-out close to the West Oaks Mall intersection. Mr. Matthys said he was concerned about traffic exiting when other traffic would be turning in a hundred feet down the road. He said the owner said that drivers were stopping and backing up because they had missed the entrance. Member Matthys said he wanted to go on the record that he does not like the way this is laid out because he thought it would cause accidents. I.. Member West asked about the sidewalk. Mr. Wagner said the plan provides for cutting into the slope as the sidewalk will be four to five below the elevation of the road. He said the Developer has put up a bond and will have two years to'buifd,the sidewalk. j j The public hearing was opened.
