RE: Review of Resolution No. 98-07, establishing the Education Commission
In the April 3 meeting several changes to this Resolution were suggested; i.e., Section 5.e. Each
public school within the City of Ocoee shall may have at least one representative member. As
any changes would need to be adopted in the form of a resolution, staff was directed to make a
copy available for review.
RECOMMENDATION
Staff respectfully requests the Honorable Mayor and City Commissioners review Resolution No.
98-07 and give direction regarding the changes desired, with a proposed resolution incorporating
those changes to be brought back before Commission May 1, 2001.

RESOLUTION NO. 98 - 07
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
ESTABLISHING THE CITY OF OCOEE EDUCATION
COMMISSION; STATING ITS PURPOSE AND OBJECTIVES;
SETTING FORTH ITS MEMBERSHIP REQUIREMENTS;
_PROVIDING FOR ITS ORGANIZATION; PROVIDING FOR
SEVERABILITY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Ocoee recognizes
the importance of quality education in the continuing growth and
development of the City; and
WHEREAS, the City Commission desires to enhance the quality of
education in the City by improving the lines of communication between
the City Commission and. the -School Board of Orange County and the Area
Superintendent; and
WHEREAS, the City Commission desires to foster and promote
open communication and cooperation among the citizens of the City of
Ocoee with respect to education within the City; and
WHEREAS, the City Commission desires to create an Education •
Commission to serve in an advisory role to the City Commission on
education issues within the City.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of
Ocoee has the authority to adopt this Resolution pursuant to Article
VIII of the Constitution of the State of Florida and Chapter 166,
Florida Statutes.

SECTION 2 . Establishment. The "City of Ocoee Education
Commission" is hereby established as a permanent advisory body to the
City Commission.
SECTION 3 . Purpose. The general purpose of the Education
Commission is to improve the quality of education for Ocoee students by
serving as an advisory body to the City Commission on education issues
within the City. In no event shall the Education Commission by itself
possess any decision-making authority or be authorized to bind the City
of Ocoee.
SECTION 4 . Obiectives. The City of Ocoee Education
Commission shall promote and improve education in the City of Ocoee by:
a. Maintaining communication with each school within the
City;
b. Facilitating communication between the City Commission
and the School Board of Orange County;
c. Facilitating communication between the City Commission
and the Area Superintendent;
d. Publicizing positive happenings in the schools attended
by Ocoee students;
e. Serving as a forum for discussion of educational issues
and concerns within the City;
f. Making recommendations regarding the education of Ocoee
students directly to the City Commission;
g. Serving as an informational conduit to the community at
large; and

h. Assisting the City Commission and staff as additionally
requested.
SECTION 5 . Membership.
a. The Education Commission shall consist of no less than
seven (7) and no more than fifteen (15) members not including a member
of the City Commission to be appointed by the City Commission and the
City Manager or the City Manager' s designee both of whom will serve as
ex officio non-voting members .
b. All members will be appointed by the City Commission from
a list of interested persons that have completed the application form
for membership on City boards and committees.
c. Of the initial members of the Education Commission, one-
half of the members (or one more than one-half if the initial Education
Commission has an odd number of members) shall be appointed to serve a
one (1) year term. The remaining initial members shall serve a term of
two (2) years . Thereafter, all members shall serve two (2) year terms
and may be reappointed, irrespective of the number of terms previously
served.
d. All members must reside within the City of Ocoee.
e. Each public school within the City of Ocoee shall have at
least one representative member. To qualify as a representative for a
particular school, the member shall reside within that school' s district
and shall be an immediate family member of at least one student
attending that particular school at the beginning of the member' s
current term.

f. All members serve at the pleasure of the City Commission
and may be removed for cause at any time . In no event will the
Education Commission have the authority to remove any member.
SECTION 6. Organization. The Education Commission shall
establish its own operating rules not inconsistent with matters
addressed herein; provided, however, that (1) the initial Chairman shall
be appointed by the City Commission and shall serve as Chairman until
July 15, 2000, whereupon the Education Commission shall thereafter elect
from among its members a Chairman for a term of one (1) year; (2) the
activities of the Education Commission and its members shall be subject
to the Florida Sunshine Law; and (3) all meetings of the Education
Commission will be open to the public with notice thereof posted at
Ocoee City Hall at least forty-eight (48) hours in advance of any such
meeting. Unless otherwise provided in the rules established in this
Resolution or by the rules established by the Education Commission
itself, the Education Commission shall follow the latest edition of
Robert' s Rules of Order.
SECTION 7. Severability. If any section, subsection, sentence,
clause, phrase or portion of this Resolution is for any reason held
invalid or unconstitutional by any court of competent. jurisdiction, such
portion shall be deemed a separate, distinct and independent provision
and such holding shall not affect the validity of the remaining portion
hereto.
SECTION 8 . Effective Date. This Resolution shall become
effective immediately upon passage and adoption.
