RE: Family Aquatic Center
ISSUE:
To give the Mayor and Commissioners information regarding this fiscal years (00/01) operational
costs that are in the budget for the Family Aquatic Center and an approximation for operational
costs for the next fiscal year(01/02). And provide information from Weller Pools regarding
litigation received on the Bid Number B01-05 for the Construction of the Family Aquatic Center
INFORMATION:
The following is the operational costs in this years budget calculated for a May 1, 2001 opening.
BUDGETED- Pool Service $2700 per month X 5 months= $13,500
(Includes full maintenance of equipment, cleaning and chemicals)
Towel Rental $800 per month X 5 months = $4000
Lifeguards 3 daily @48 hrs. wk. X $12.90 hr. X 17 wks. = $31,579.20
Pool Aides 2 @25 hrs. wk. X $7.00 X 17 wks. _ $5950
Electric & Water $600 mon. (approx.)X 5 mon. = $3000
Total operational costs = $58,500 (rounded up)
The costs of the lifeguards have increased to $15.00 per hour versus $12.90 as proposed by the
YMCA (see attachment A) after the budget was completed. Using an approximation of the
Aquatic Center opening for August through September(2 mon.) for the ramaining fiscal year
projects an estimated adjusted budget as follows.
ACTUAL- Pool Service $2700 per month X 2 months= $5400
Towel Rental $800 per month X 2 months = $1600
Lifeguards 3 daily @48 hrs. wk. X *$15.00 X 7 wks. _ $15,120
Pool Aides 2 @25 hrs. wk. X $7.00 hr. X 7 wks. = $2450
Electric & Water$600 mon. (approx.) X 2 mon. = $1,200
Total operational costs = $25,770
Difference of BUDGETED finds minus ACTUAL (estimated) equals = $32,730 n
The following is an estimate for the operational costs of the Aquatic Center based on a seasonal
schedule from April through September(26 wks.).
Pool Service $2700 per month X 6 months = $16,200
Towel Rental $800 per month X 6 months = $4800
Lifeguards 3 daily @48 hrs. wk. X $15.00 X 26 wks. = $56,160
Pool Aides 2 @25 hrs. wk. X $7.00 hr. X 26 wks. = $9100
Electric& Water $600 mon. (approx.) X 12mon. = $7,200
Total operational costs = $93,460
If the Aquatic Center was open year round the operational costs project to $179,720.

In my research for information on heating pools it was discovered that the type of pools that are
commonly being heated are the lap pools versus the zero entry pool. The price for the Geothermal
heating system utilized in the Orange County pool cost $20,000 to install and the electric cost is
$400 per month_ They have two units at their Fort Gatlin site which is a 25 meter lap pool. The
solar heating unit utilized in St. Clouds' 8 lane lap pool cost $20,000 to install and has been
constantly needing repairs. I have been informed that solar heating for commercial pools has not
yet been perfected. Prices received for natural gas heating for a standard lap pool (75'X 45') are
$8000 to $12,000(Borelli &Eco Lab) per year and a propane heated pool would not be cheaper
but more expensive. The electric costs for the pool without a heating system would be
approximately $300 per month and the water cost would he the same amount ($300).
The cost of chemicals for the 95,000 gallon pool range from $5.00 to $10.00 (Borelli, Eco Lab)
per 1000 gallons per month. This equals $475 to $950 per month for chemicals if the pool service
was done in house. Annually this would equate to $5700 to $11,400. This service requires a
Certified Pool Operator (CPO) and/or a Pool Technician.
Income generated from swimming pools generally does not cover the operational costs and
expenses. The St. Cloud pool being open year round and offering swim lessons, annual
memberships, Clubs and Schools usage generates 50% of their operating costs. Generally, I have
found that municipal pools operate at a lost.
Income generated: Eg. Using a fee rate of$2.00 per person and a weekly attendance of 300 to
500 the income would equal $600 to $1000 per week or$15,600 to $26,000 for a 6 month
period. Of course, this income would vary greatly according to the popularity of the pool and the
weather. The fee charged for the towel rental could cover the City's cost of the rental. Please
find attached (B') a proposed 'Pool Agreement' with the West Orange YMCA Family Center.
This agreement is tentative and was introduced during our preliminary budget meetings to discuss
contracting the Lifeguards for the Ocoee Aquatic Center. The schedule near the bottom was
changed slightly to reflect our needs.
Please find attached (C') a letter from H.D. von Weller explaining pending litigation against a
'McDevitt Street Bovis Corporation on the Portofino Bay Hotel at Universal Studios. This
information was requested at the last commission meeting on May I" and involves the pool
construction company, Weller Pools who sent in the low bid for the Ocoee Aquatic Center.
Hopefully, the information given will assist the Mayor and Commission in making their decision.

A few items would be vital fa a positive working relationship:

2. Proper staff to swimmer ratios must be maintained at all times.
3. Maintain a close working relationship with the Aquatic Supervisor.

Pool Agreement
Here is a sketch of the components to be included in the contract between the City of
Contractual items that would be part of a three-year contract:
The City of Ocoee will provide the following:
All Pool Chemicals and Maintenance
All occupancy costs including janitorial resources.
Clerical and housekeeping staff to maintain the premises, equipment and towel
service.
Inventory and Staff for the store
First Aid Supplies
Salary Costs for Lifeguard staff of an agreed rate of$15.00 per staff hour.
West Orange YMCA Family Center will provide:
Screened and fully certified Aquatic staff
Lifeguards to provide safe coverage of the Water Park and Lap Lanes
Supervision for all Aquatic Staff
Swim Lessons: Staff and structure according to national YMCA guidelines
Water Aerobic Classes
Salaries of Swim Instructors and Water Aerobic Instructors
Full Financial Statement of revenue and expenditures relating to the City of
Ocoee Pool
City of Ocoee will collect:
All daily Swim Fees
West Orange YMCA will collect:
Registration information and fees for swim lessons
Fees for Water Aerobics
The pool and programs will operate in full compliance with the Central Florida YMCA
Risk Management Standards.
Addendum items to be reviewed annually.
The pool will open May of 2001 and operate through the month of September. A

Dear Joyce:
Weller Pools is pleased to have been low bidder on your Family Aquatic Center on April 17h- On
yin hiddinq documents, Paragraph 23 titled Summary of Litigation, Weiler Pools failed to
complete the last sentence in the paragraph.
The I &dation that was mentioned in the hid involved two contracts that Weller Pools had with
McDevitt Street Covts Corporation on the Portofino Bay Hotel at Universal Studios. We had a
contract for all of the swimming pools and we had a separate contract fur numerous fountains
throughout the project. The project concluded in September of 1999. Up until that point, the
payments from the Owner to the Contractor had been running approximately 60 days in arrears
by the time we had finished the project and the Owner had taken delivery, we were approximately
90 days behind in our payments from the Contractor in addition to the 10% retainage which the
ONnei and General Contractor had reserved.
Upon the completion of the hotel, the General Contractor McDevitt Street Bows, intormeg
approximately 41 sub contractors that they had not received payment for the October 1999 draw
and Ibat it did not appear that there were going 10 be any payments in the foreseeable future.
the General Contractor has alleged that the Owner owes him an additional 30 Million Dollars and
the Owner has alleged that the General Contractor has overcharged them. This has been goIng
on for almost 2 years and there does not appear to he a quick solution to all of our problems.
We have filed a Breach of Contract lawsuit against Bevis and the numerous suits that have been
bled have been consolidated under one judge in Orange County for mediation. Unfortunately
Nevis and Universal City Partnership who is the Owner of the Hotel have chosen not to deal with
their subcontractors in good faith-
Wcller Pool Constructors completed their work on lime and all of the work was accepted by the
Permitting Authorities and the Owner. There is nothing in this lawsuit that represents any actions
against us (or failure to perform- The only mason that we are presently in litigation is that we
have not been paid what we arc doe on our contract.
If you need any further Information I will he happy to provide it to you hut I believe that Ibis should
explain to everyone's satisfaction the ceg eirements el Paragraph 23.

ISSUE
Should the City Commission select Weller Pool Constructors, Inc. to construct the Ocoee
Family Aquatic Center at the Jim Beech Recreational Facility?
BACKGROUND & DISCUSSION:
The funding sources for this project are a FRDAP Grant (Florida Recreation Development
Assistance Program) in the amount of $150,000, and the Capital Improvement Bond Issue.
The bid was advertised on March 11, 2001, and publicly opened on April 17, 2001. Responses
were received from the following companies:
I) Aquamarine Swimming Pool Inc. $717,900
2) Pool People Commercial $759,900
3) Weller Pool Constructors, Inc. $626,500
Attached is a copy of Weller Pool Constructors' bid along with the bid tabulation sheet, for your
review. Copies of all bids are available in the Finance Department for your review.
The bids were reviewed by the Public Works and Finance Departments. Staff recommends
awarding this bid to Weller Pool Constructors, Inc. as the most responsive and responsible
bidder, per the attached memo from Bob Smith, Public Works Director.
STAFF RECOMMENDATION
It respectfully is recommended that the City Commission award Bid #01-05 to Weller Pool
Constructors Inc., and authorize execution of the agreement between the City and Well- =•e
Constructors Inc. by the Mayor and City Clerk and further authorize the Mayor, City -rk and
Staff to execute all documents necessary to consummate the transaction contempl. b he
