BACKGROUND: The subject property (a portion of the West Groves) is located north of the Coke Property, west of Ocoee-Apopka Road (Exhibit A of Ordinance 2001-11). The Avanti/West Groves PSP comprises approximately ±383.1 acres, a majority of which is zoned R-1AA, and the remainder zoned R-3, Multiple-Family Dwelling District, and C-2, Community Commercial District. The Avanti/West Groves property was annexed into Ocoee in 1992 via Ordinance 99-32 and rezoned via Ordinance 99-33. The locations of the C-2 and R-3 parcels were selected to align with the West Road/Ocoee-Apopka Road intersection. The rezoning was requested by the applicant to accommodate the realignment of Clarcona Ocoee Road (a.k.a. West Road). The rezoning will not result in an increase in the C-2 or R-3 acreage and is therefore a de minimis change. Exhibit B of Ordinance 2001-11 depicts the proposed reconfiguration of the R1-AA, C- 2 and R-3 parcels. DISCUSSION: The subject property is designated Low Density Residential (<4 du/acre), High Density Residential (8-16 du/acre), and Commercial on the City Future Land Use Map and Joint Planning Area Map. The proposed de minimis rezoning is consistent with Ocoee Future Land Use Map and Joint Planning Area Map, as amended. Staff has determined that the de minimis rezoning is consistent with Ocoee's (1) Comprehensive Plan; (2) Future Land Use Map; (3) Land Development Code; (4) Joint Planning Area Agreement with Orange County; and (5) surrounding land uses and zoning classifications. PAGE 2 MAY 9, 2001 HONORABLE MAYOR AND COMMISSIONERS PLANNING AND ZONING COMMISSION: On May 8, 2001 the Planning and Zoning Commission held a public hearing to consider the Avanti /West Groves rezoning. No one spoke in favor or opposition to the request. The Planning and Zoning Commission unanimously recommended approval of the rezoning. STAFF RECOMMENDATION: Staff respectfully recommends that the Honorable Mayor and City Commissioners adopt Ordinance 2001-11 approving the Avanti/West Groves Rezoning, Case Number RZ-00-04-01, to reconfigure the R1-AA, C-2, and R-3 parcels as shown in Exhibit"A". WHEREAS, the owner or owners (the "Applicant") of certain real property located within the corporate limits of the City of Ocoee, Florida, as hereinafter described, have submitted an application to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") for the de minimis rezoning of certain portions said real property (the "Rezoning"); and WHEREAS, Exhibit "A" attached hereto and by this reference made a part hereof, shows the existing zoning classification of all of the property and proposed rezoning of certain portions of the property; and WHEREAS, the Applicant seeks the rezoning of Parcel 3 containing approximately 2.801 acres, more particularly described in Exhibit "A-3" attached hereto and by this reference 006 215445.2 made a part hereof, from C-2, Community Commercial District, to R-3, Multiple Family Dwelling District; and WHEREAS, the Applicant seeks the rezoning of Parcel 4 containing approximately 0.665 acres, more particularly described in Exhibit "A-4" attached hereto and by this reference made a part hereof, from C-2, Community Commercial District, to R-IAA, Single Family Dwelling District; and WHEREAS, the Applicant seeks the rezoning of Parcel 5 containing approximately 0.822 acres, more particularly described in Exhibit "A-5" attached hereto and by this reference made a part hereof, from R-1AA, Single Family Dwelling District, to R-3, Multiple Family Dwelling District; and WHEREAS, the Applicant seeks the rezoning of Parcel 6 containing approximately 0.042 acres, more particularly described in Exhibit "A-6" attached hereto and by this reference made a part hereof, from R-IAA, Single Family Dwelling District, to C-2, Community Commercial District; and WHEREAS, the Applicant seeks the rezoning of Parcel 7 containing approximately 3.305 acres, more particularly described in Exhibit "A-7" attached hereto and by this reference made a part hereof, from R-3, Multiple Family Dwelling District, to C-2, Community Commercial District; and WHEREAS, the Applicant seeks the rezoning of Parcel 8 containing approximately 2.227 acres, more particularly described in Exhibit "A-8" attached hereto and by this reference made a part hereof, from R-3, Multiple Family Dwelling District, to R-IAA, Single Family Dwelling District; and WHEREAS, the Applicant seeks the rezoning of Parcel 9 containing approximately 2.037 acres, more particularly described in Exhibit "A-9" attached hereto and by this reference made a part hereof, from R-1AA, Single Family Dwelling District, to R-3, Multiple Family Dwelling District; and WHEREAS, following the rezoning of Parcels 3 through 9 herein, Parcel 1 containing approximately 22.417 acres, more particularly described in Exhibit "A-1" attached hereto and by this reference made a part hereof, depicts the reconfigured C-2 Parcel; and WHEREAS, following the rezoning of Parcels 3 through 9 herein, Parcel 2 containing approximately 23.258 acres, more particularly described in Exhibit "A-2" attached hereto and by this reference made a part hereof, depicts the reconfigured R-3 Parcel; and WHEREAS, pursuant to Section 5-9(B) of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida (the "Ocoee City Code"), the Director of Planning has reviewed said Rezoning application and determined that the Rezoning requested by the Applicant is consistent with the 1991 City of Ocoee Comprehensive Plan as set forth in Ordinance ii91-28, adopted September 18, 1991, as amended (the "Ocoee Comprehensive Plan"); and 2 006.215445.2 WHEREAS, said Rezoning application was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee, Florida (the "Planning and Zoning Commission"); and WHEREAS, the Planning and Zoning Commission has held a public hearing and reviewed said Rezoning application for consistency with the Ocoee Comprehensive Plan and determined that the Rezoning requested by the Applicant is consistent with the Ocoee Comprehensive Plan and is in the best interest of the City and has recommended to the Ocoee City Commission that the zoning classification of said real property be Rezoned as requested by the Applicant, and that the Ocoee City Commission find that the Rezoning requested by the Applicant is consistent with the Ocoee Comprehensive Plan; and WHEREAS, the Ocoee City Commission held a de novo advertised public hearing with respect to the proposed Rezoning of said real property; and WHEREAS, the Ocoee City Commission has determined that the Rezoning requested by the Applicant is consistent with the Ocoee Comprehensive Plan; and WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041 (3)(a), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. The Ocoee City Commission has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 2. REZONING. The zoning classification, as defined in the Ocoee City Code, of the following described parcels of land located within the corporate limits of the City of Ocoee, Florida, is hereby changed: a. The zoning classification of Parcel 3 containing approximately 2.801 acres, more particularly described in EXHIBIT "A-3" attached hereto and by this reference made a part hereof, is hereby changed from C-2, Community Commercial District, to R- 3, Multiple Family Dwelling District; b. The zoning classification of Parcel 4 containing approximately 0.665 acres, more particularly described in EXHIBIT "A-4" attached hereto and by this reference made a part hereof, is hereby changed from C-2, Community Commercial District, to R- IAA, Single Family Dwelling District; c. A map of said land herein described which clearly shows the area of Rezoning is attached hereto as EXHIBIT "B" and by this reference is made a part hereof SECTION 3. COMPREHENSIVE PLAN. The City Commission hereby finds the Rezoning of the lands described in this Ordinance to be consistent with the Ocoee Comprehensive Plan. SECTION 4. ZONING MAP. The City Clerk is hereby authorized and directed to revise the Official Zoning Map of the City of Ocoee in order to incorporate the Rezoning enacted by this Ordinance and the Mayor and City Clerk are hereby authorized to execute said revised Official Zoning Map in accordance with the provisions of Section 5-1(G) of Article V of Chapter 180 of the Ocoee City Code. SECTION 5. CONFLICTING ORDINANCES. All ordinances or parts of ordinances in conflict herewith are hereby repealed and rescinded. SECTION 6. SEVERABILITY. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto.
