SUBJECT: Request for Fee Waiver for First Spanish Church of Winter Garden
(Pastor Ricardo Orsini)
First Spanish Church of Winter Garden intends to file an application for a Special Exception to
permit the church to be located in a C-2, Neighborhood Commercial Zoning District. The
subject property is located at 325 Ocoee-Apopka Road. Pastor Orsini has requested that the
City Commission waive the required fee ($750) and other related fees per the attached letter.
In the past, the City Commission has granted fee waivers for annexations, rezonings and
special exceptions which were initiated by church sponsors. This has included the Reformed
Presbyterian Church in 1988, St. Paul's Presbyterian Church in 1990, 1992, 1998, and 2000
Glad Tidings Assembly of God in 1994, Winter Garden Seventh Day Adventist Church in 1994,
Christian Service Center of Central Florida in 1995, and Celebration Baptist Church in 1996.
This is a fairly common practice by other local governments, although the City's Land
Development Code does not specifically address such waivers.
Staff Recommendation:
Staff recommends that the Honorable Mayor and City Commissioners approve a waiver of the
special exception fee related to the First Spanish Church of Winter Garden application.

Dear City Committee,
This letter is to inform the City Conunitee that are non exempt number, 58-12-1305-74-55-6 and
1D number 59-356-17-30, is up to date, and thid can be varified with the State. First Assambly of
God has been able to purchase the property in Ocoee with that number. Furthermore, the reason
the non-exempt number is under Southeastern Spanish Council of the A\g is because that is the
Organization that our church belongs to. The Southeastern Council can varify this at
1-407-850-9861.

Dear Sir or Madam.
I would like to make a request but first I think some background information would be
relevant. Just a couple or years ago, I felt called to begin a church in Winter Garden. It was my
desire to bring about a change for the better in one life at a time, thus impacting the community.
During the years since that first start, I have seen families restored, enemies in peace, and whole
families making a new start as happy and productive citizens. It was as I first had wished--this
small church was making a difference.
Recently, we have realized that with our own facilities we could do even more. It is our
intention to begin many more programs and activities, but the schedule is limited in the building
which we now occupy. On our own property, we could maintain a more active ministry and a
much more flexible calendar. These are possible only as we achieve our latest goal, which is to
have our very own property and church building. With this, all the other things become much
more easily accomplished.
I am sure you arc aware that studies show that crime rates drop in direct proportion to the
number of churches in the neighborhood. That gives us reason to believe that our church may be
able to have a great impact on our proposed building neighborhood. We are an active church, full
of exciting and outgoing people. We enjoy interacting with neighbors and other groups and fully
intend to be a positive part of our city.
In spite of the big things we have been able to accomplish in a short time, we are still
small, with a very limited budget. The waiving of the $750 fee is an enormous help to us when it
is considered that a large portion of our membership is comprised of young families with small
children who already give sacrificially to our ministry, as well as showing generosity to friends and
neighbors. Therefore, we would like to respectfully request that you waive the fee in order that
we might sooner sec our goal accomplished and more easily and quickly begin impacting our
community and neighboring communities for the better.

• Provide all vendors with a copy of your Consumer's Certificate of Exemption before making tax-exempt purchases.
• Your Consumers Certificate of Exemption is to be used solely for your organization's customary nonprofit activities.
• Purchases by the exempt organization are only exempt when the Consumer's Certificate of Exemption is presented to
the vendor and the payment is made directly by the organization.
• Purchases made by an individual on behalf of the organization are taxable, even if the individual is reimbursed by the
organization.
• Transactions by an exempt organization such as sales or leases of tangible personal property, transient rental or
sleeping accommodations, real property, or docking spaces are taxable. The organization must register for sales and
use tax certification, and collect and remit sales tax on those transactions. Note: Churches are exempt from this
requirement except when they are the lessor of real property (Section 12A-1.070, Florida Administrative Code).
• Changes in the organization's purpose, federal exemption status, or address must be reported immediately to the
Department of Revenue.
UNDER NO CIRCUMSTANCES SHOULD THIS EXEMPTION BE USED FOR THE PERSONAL BENEFIT OF ANY
INDIVIDUAL. ANY MISUSE OF THIS EXEMPTION WILL NECESSITATE ITS REVOCATION.
