ISSUE:
Should the Mayor and City Commissioners approve the Lot 1 Final Site Plan and Final
Subdivision Plan for the Super Wal-Mart at SR 50 and Blackwood Avenue?
BACKGROUND:
The proposed Wal-Mart Supercenter is to be developed on a 35.9 acre tract located at the
southwest corner of State Road 50 and Blackwood Avenue. This remnant orange grove is
zoned C-2, Community Commercial District, and is also accessible on the south from Old
Winter Garden Road. The parcel is bound on three sides by other commercial uses; namely,
Ocoee Commerce Center to the west, Lake Bennet Centre to the north and Health Central
Hospital to the east. To the south of the site is Oak Forest Apartments. The development is
within the State Road 50 Activity Center and is subject to the upgraded standards of the
Commercial and Industrial development regulations.
DISCUSSION:
The development program for the Wal-Mart Supercenter entails two main components:
1) Construction of the 213,611 s.f. Supercenter building itself with associated site
improvements including an integrated Tire Lube Express facility. This "TLE"
received a Special Exception since it falls under the Service Station category of
the Land development Code.
2) Development of five outparcel lots, three facing State Road 50, and two fronting
Blackwood Avenue. All outparcels will be accessed from shared driveways
within the site. Four of the outparcels are just over one acre in size with the
remaining parcel being almost two acres in size.

Uses for the two outparcels on Blackwood Avenue have been voluntarily limited to professional
offices. All other outparcels are permitted from typical C-2 uses except that car lots, boat lots
and pawn shops have been voluntarily restricted. Further, Lot 4, the outparcel nearest the
intersection of State Road 50 and Blackwood Avenue, has been further restricted by Wal-Mart
from development of automobile service stations or convenience stores with gas sales.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) voted on December 4th to approve the Lot 1 Final
Site Plan and Final Subdivision Plan for the Super Wal-Mart Site, subject to the items listed in
the DRC staff memoranda being provided and/or added to the Plans prior to the pre-
construction conference, subject to Staff administrative approval. These items primarily relate
to various notes to be added to the plans, various stormwater management details, timing of
traffic signals, conveyance of right-of-way for transportation improvements, and provisions
related to the water feature ponds and fountains.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning & Zoning Commission (P&Z) reviewed this project at their regular meeting on
December 12, 2000. Only one citizen spoke at the meeting to request clarification on details
pertaining to the tower.
There was also discussion among the P&Z members having to do with issues regarding the
water features, pedestrian access, pedestrian cross walks, and re-use of the existing Wal-Mart
store. The P&Z members voted unanimously to approve the project with the same stipulations
recommended by DRC.
STAFF RECOMMENDATION:
Based upon the recommendations of the Development Review Committee and the Planning
and Zoning Commission, Staff respectfully recommends that the Mayor and City
Commissioners approve the Lot 1 Final Site Plan and Final Subdivision Plan for the Super Wal-
Mart Site plans date-stamped by the City on December 7, 2000, subject to the attached DRC
staff memoranda items being provided and/or added to the Plans prior to the pre-construction
conference, said changes and conditions being subject to Staff administrative review
subsequent to City Commission action.

Final Subdivision and Site Plan
Pursuant to the City's request, the following are PEC's comments associated with the
review of the Construction Plans and Stormwater Report (date-stamped received by the
City of Ocoee on November 28, 2000)for the above referenced project. It should be noted
that the following comments have no significant impact on the overall project but should
be brought to the attention of the Engineer of Record.
1. The revised drawdown analysis for the proposed wet ponds 1 and 2 is based on
orifices smaller than two inches(i.e., 1.3 inch and 0.8 inch,respectively). Be aware
that this may present a maintenance difficulty due to the restrictive size of the
proposed openings. Please resolve this issue with the SJRWMD.
2. A modified stage/area relationship for proposed wet pond 1 has been noted. Please
be aware that this change may conflict with the maximum allowed permanent pool
depth of 12 feet, per District regulations. Please resolve this issue with the
SJRWMD.
3. Note that the proposed wet pond I does not meet the required storage capacity of
the permanent pool volume.Please resolve this issue with the SJRWMD.
4. Note that several discrepancies between information contained in the drainage
calculations and the construction plans were still noted. For example:
- The Post-development adICPR model and the construction plans differ regarding
outfall pipe line lengths and sizes. For example, the outfall pipe from drop
structure I was modeled as a 30-inch pipe;however,construction plans call for
a 36 inch pipe. Also,confirm pipe length from drop structure 1 to the boundary
node(i.e„37 feet does not seem correct according to the information contained
in the construction plans unless structure S-47 is the boundary node). Also,the

outfall pipe from the proposed wet pond 2 to the proposed dry pond has been
modeled as an 18 inch pipe; however, construction plans call for an 18-inch, a
24-inch, a 24-inch by 38-inch and a 42-inch pipe system.
- The Hydraulic Grade Line Analysis contained within the"Revised Stormwater
Design Calculations" and the construction plans differ regarding several pipe
line lengths and inverts.

The following are the only outstanding items with the submitted Final Site Plan. The numbering
system corresponds to that of the previous review.
I. Provide a copy of the St. John's River Water Management District permit for this project.
2. Provide a copy of the DEP water and sewer permits for this project.
4. Provide a copy of the utility easement document which will allow Wal-Mart to connect to the
sanitary sewer system on Ocoee Commerce Parkway.
In addition, please address the following:
20. Revise Note 1113 on Sheet C-5 to state that the Contractor shall install pre-cast concrete tops
on all inlets.
21. Include the rim elevations on all sanitary sewer manholes.

Review
Project Nos. 97-008 and 97-009
In connection with the above-referenced application, we have reviewed the following
documents:
1. Final Subdivision Plan for tots 1, 2, 3, 4, 5 and 6 and Final Site Plan for
Lot 1 for Wal-Mart Supercenter Store No. 942.01 RSC stamped received
by the City of Ocoee November 28, 2000 (the "Plan"); and
2. Response to comments letter from CPH dated November 28, 2000 and
stamped received by the City of Ocoee November 28, 2000 ("Response
Letter").
This memorandum supersedes our prior memorandum dated October 31, 2000. Based
upon our review of the documents noted above pursuant to the Land Development Code, we
have the following comments:
1. Sheets C-3, C-3A, C-3B, C-3C, C-3D and C-3E are not longer labeled as
such. Please label these sheets consistent with the Index of Sheets on the
cover page of the Plan.
2. Please delete the revisions made to Condition of Approval ("COA") 11.
As was discussed at the TSRC meeting on November 21, 2000, the staff
recommendation with respect to the Final Subdivision Plan will account
for the waiver of COA 11 with respect to the Wal-Mart site.
3. City Staff should consider with respect to item 1.d of the Planning
Department's comments whether the response given to item 1.d of the
Planning Department's comments is sufficient or whether a note should be

added to the Plan which provides that the Developer shall coordinate with
the City with respect to the signalization at Blackwood and Old Winter
Garden Road in an effort to install permanent signalization rather than
temporary signalization.
4. Please be advised that pursuant to the discussion at the TSRC meeting on
November 1, 2000, the Developer is to provide a legal description and
sketch of description for the property referenced in item l.g of the
Planning Department's comments.
5. City Staff should consider whether the note included on Sheet 5 near the
pond sufficiently addresses the concerns raised in items 4.c and 4.d of the
Planning Department's comments.

1s`staff Review for Plans Received November 28, 2000
The Planning Department has reviewed the above listed drawings and we are
requesting the following clarifications or changes.
1) Condition of Approval Number 11 on the Final Site Plan shall be
modified to add the following language: "Vertical construction on the
Wal-Mart site (but not any outparcels) shall be permitted prior to
platting, provided that a plat is submitted within 60 days of FSP
approval and that the plat is recorded and a certificate of completion
issued prior to issuance of any certificate of occupancy. "
2) Detailed traffic engineering data for all intersection improvements must
be provided regarding the addition of turn lanes, signal
equipment/timing modifications, and driveway connections consistent
with the adopted Traffic Study for this project and the Development
Agreement. This data must be submitted to and approved by FDOT
and the City to permit design and construction of these facilities prior to
the Certificate of Completion for Super Wal-Mart.
3) Cross-sections G, H and I shall be modified prior to the pre-
construction conference for stormwater swales along State Road 50.
4) Wet detention pond C shall maintain a minimum water level elevation
of 127 feet and shall be outfitted with a liner and supplementary water
supply, if necessary, to maintain this water feature as an ongoing site
amenity.
5) Wet detention pond B shall maintain a minimum water level elevation
of 123 feet and shall be outfitted with a liner and supplementary water
supply, if necessary, to maintain this water feature as an ongoing site
amenity. If necessary, pond B may be redesigned with a decorative
wall and fence at the south end to create more volume.

6) That specifications for lighted pond fountains shall provide for a
minimum 3 H.P., 20 foot device in pond C, and a minimum of 5 H.P. 25
foot device in pond B.
