Shira, P.E., City Engineer/Utilities Directo SUBJECT: Starke Lake / Lake Olympia Control Structure Work Order # 22 As part of our investigation into the replacement of the two drainwells on Starke Lake, we also investigated the possibility of moving one of the drainwells to give us better individual control of the two lakes. This option turned out to be unfeasible, but we still wanted to have as much independent control of the lakes as possible. To accomplish this, we are proposing a slight modification to the control structure that is presently in place between the lakes. Essentially, we will propose to the St. Johns River Water Management District that we be allowed to drill a hole in one wall of the structure so that when Olympia is lower than Starke, as it is now, water can flow from Starke into Olympia. This will give us a bit more control over the lakes in that we can use the capacity of Olympia to "save"excess water rather than having it all go down the drainwell. During periods of high lake levels, the control structure will be opened, and water from both Olympia and Starke can be released down the drainwell. In order to do this work, the existing SJRWMD permit must be modified. This will require preparation and submission of a new SJRWMD Environmental Resources Permit (ERP), as well as supporting drawings and calculations. Attached for your review and action is a proposal from PEC for this work. PEC proposes to meet with the District to discuss the project, and prepare and submit all of the required ERP documents, plans and calculations for a fixed fee of $10,000, with an additional not-to-exceed amount of $3,500 for reimbursable expenses. I recommend that the City Commission authorize the Mayor and City Clerk to execute Work Order No. 22 with PEC in the not-to-exceed amount of $13,500. Execution of the Work Order No. 22 shall serve as authorization of ENGINEER to provide professional engineering services as described in Attachment "A" which is attached hereto and made a part hereof. ENGINEER shall provide said service pursuant to.Work Order No. 22, its attachment and that certain Agreement of June 2, 1992 between CITY and ENGINEER which is incorporated herein by reference as if it had been set out in its entirety. Whenever the Work Order conflicts with said Agreement, the Agreement shall prevail. TIME FOR COMPLETION: The work authorized by this Work Order shall be completed by Monday, December 31, 2001. COMPENSATION: The CITY shall compensate the ENGINEER a negotiated fixed fee in the amount of Ten Thousand Dollars ($10,000.00) for the professional services required under this Work Order. INTRODUCTION The Lake Olympia / Starke Lake watershed consists of two (2) interconnected lakes / drainage basins that comprise approximately 1,338 acres, or roughly 2.1 square miles, of central Ocoee and unincorporated areas of Orange County. The drainage basins are located within Sections 16, 17, 18, 19, 20 and 21 of Township 22 South, Range 28 East. Based on the total watershed area, the Starke Lake Basin comprises approximately 894 acres, while the Lake Olympia Basin comprises approximately 444 acres. The Starke Lake Basin is bounded on the west by a wetland system and citrus groves west of Bowness Road; on the south by Orlando Avenue (White Road); on the east by Ocoee Hills Road, First Street, the Admiral Point Subdivision, and Montgomery Avenue; and on the north by Flewelling Street. The primary drainage conveyance system within the Starke Lake Basin is a series of roadway ditches and storm sewers which convey stormwater runoff directly to Starke Lake. This basin also has a primary drainage ditch (a.k.a., City Hall Ditch) which collects stormwater runoff from the older portions of the City of Ocoee and discharges directly to the west side of Starke Lake. The Lake Olympia Basin is bounded on the north by Silver Star Road; on the east by Clarke Road and a future Phase of the White Hill Subdivision; on the south by White Road (Orlando Avenue); and on the west by Ocoee Hills Road, First Street, the Admiral Point Subdivision, and Montgomery Avenue. The primary drainage conveyance system within the Lake Olympia Basin is via curb and guttered street systems, with storm sewers that convey stormwater runoff to stormwater management facilities(ponds) before discharging into Lake Olympia. Both Starke Lake and Lake Olympia are classified as landlocked basins with water levels in the lakes controlled by two (2) existing drainage wells on Starke Lake. Starke Lake and Lake Olympia are interconnected by an existing control structure. The purpose of the control structure is to divert water from Starke Lake to Lake Olympia if water levels within Lake Olympia fall below a certain elevation (elevation 96.0 feet NGVD). When Lake Olympia is above elevation 96.0 feet, the existing control structure will be closed. 1 P-0341.SCO • ATTACHMENT "A" SCOPE OF SERVICES for WORK ORDER NO. 22 LAKE OLYMPIA / STARKE LAKE CONTROL STRUCTURE MODIFICATION During March of 1996, PEC finalized an Engineering Report for the City of Ocoee entitled "Lake Olympia / Starke Lake Drainage Basin Study". The purpose of the study was to analyze the existing drainage facilities within the watershed; identify system deficiencies based on a level of service; and develop a capital improvement program that addresses flood protection, water quality, and localized flooding. The drainage basin study was adopted by the City Commission and the $1.28 million of identified projects have been incorporated into the Citywide Capital Improvement Program (e.g., Center Street Ditch). II. PURPOSE During the 1994- 1996 period, Starke Lake flooded when the drainage wells became plugged and Lake Olympia also rose to very high sustained stages, submerging back yards and boat docks for an extended period. Recently (April, 2000), a video survey of the Starke Lake drainage wells was performed which indicated that the north 12-inch drainage well is definitely in need of replacement while the south 8- inch drainage well is questionable. It should be noted that the south drainage well is actually 12-inches but was sleeved with an 8-inch casing to temporarily repair the well. Based on the present condition of the drainage wells and the potential for flooding during above average "wet" seasons and/or a major storm event, the City of Ocoee would like to remove and replace both drainage wells and modify the existing control structure between Starke Lake and Lake Olympia. The purpose of this work order is to provide professional services to permit the modification of the existing control structure with the St. Johns River Water Management District (SJRWMD). It is our understanding that the City will contract directly with Henderson Wilder/Devo Seereeram or Central Florida Well Drillers, Inc. to remove and replace the two (2) Starke Lake drainage wells. 2 P-0341.SCO ATTACIIi LENT "A" SCOPE OF SERVICES for WORK ORDER NO. 22 LAKE OLYMPIA / STARKE LAKE CONTROL STRUCTURE MODIFICATION Following is a detailed scope of work and the associated fees (Exhibit "B") anticipated for this project. 1. Conduct various meetings with the St. Johns River Water Management District(SJRWMD)and the Florida Department of Environmental Protection (FDEP). The primary focus of the meetings will be to discuss the goals and objectives of the original drainwell replacement program versus the proposed control structure modification. 2. Prepare and submit to the SJRWMD an Individual Environmental Resource Permit (ERP) application(Sections A and C) for the proposed activities. The Individual ERP application will be required to modify the existing control structure. The ERP application shall contain an engineering report; figures; ICPR Analysis; and supporting information. 3. The Consultant will prepare a comprehensive permit application package which contains information required by,the regulatory agencies. The Consultant is responsible for supplying responses to reasonable requests for additional information (RAI) from regulatory agencies in order to acquire the necessary permits, limited within this scope of services to two (2) responses per agency. Though permit applications are prepared according to applicable regulatory agency regulations, codes and laws, we cannot guarantee approval of the permits by the various agencies due to circumstances beyond our control. 3 P-0341.SCO ATTACHMENT "A" SCOPE OF SERVICES for WORK ORDER NO. 22 LAKE OLYMPIA / STARKE LAKE CONTROL STRUCTURE MODIFICATION III. CONDITIONS AND ASSUMPTIONS The following conditions and assumptions are noted as qualifications to this proposal. 1. This scope of work has assumed that a monitoring or mitigation program will not be required by the SJRWMD. 2. If additional water quality sampling is required based on review comments associated with the ERP application, the Water Quality Subconsultant (ERD) will submit an amendment to the work order to perform any requested sampling and/or laboratory analysis. 3. Since the proposed construction activities are assumed to be less than five(5)acres of disturbed land, it is assumed that a NPDES Construction Permit application is not required to be submitted to the EPA. 4. Engineering services related to construction administration, including: site inspections during construction; review of shop drawings; review of partial pay requests, etc; are not included within this proposal. Only construction administration assignments discussed within other sections of this proposal are included herein (e.g., resolution of construction related issues). 5. Construction testing services, geotechnical engineering and testing, boundary and topographic surveys, landscape and irrigation design and non-utility engineering (e.g., power, gas, telephone, cable television, site lighting) services will be provided by others. 6. Underground utility location information will be provided by the servicing utility. Any utility investigation required in addition to information made available by the utility companies may be provided as an additional service performed based on the attached hourly rate sheet(Exhibit "C"). In the case where an underground contractor is required, those costs will be billed directly to the Owner as they are incurred. 4 P-0341.SCO ATTACHMENT "A" SCOPE OF SERVICES for WORK ORDER NO. 22 LAKE OLYMPIA / STARKE LAKE CONTROL STRUCTURE MODIFICATION IV. ADDITIONAL ENGINEERING SERVICES The following Additional Engineering Services are not included under the Basic Scope of Professional Services. These services, if required, may be performed upon proper authorization by the City. 1. Services resulting•from significant changes in the general scope, extent or character of the Project or its design including, but not limited to, changes in size, complexity, Owner's schedule or character of construction. 2. Services resulting from revising previously accepted studies, reports, design documents or Contract Documents when such revisions are required by changes in laws, rules, regulations, ordinances, codes or orders enacted subsequent to the preparation of such studies, reports or documents, or are due to any other causes beyond Engineer's control. 3. Services resulting from the award of more than one individual prime contract for construction of the Project. 4. Further bidding and negotiating services including assistance in connection with bid protests and rebidding or renegotiating contracts for construction, materials, equipment or services, provided that rebidding is not required by errors or omissions of the Engineer. 5. Providing any type of property surveys or related engineering services needed for the transfer of interests in real property, field surveys for design purposes, engineering services needed for the transfer of interest in real property, field surveys for design purposes, engineering surveys, staking to enable Contractor(s) to proceed with their work, and providing other special field surveys. 6. Services in connection with work directive changes and change orders to reflect changes requested by Owner. 8. Services in making revisions to construction documents occasioned by the acceptance of substitutions proposed by Contractor; and services after the award of each contract in evaluating and determining the acceptability of more than three substitutions proposed by Contractor. 9. Additional or extended services during construction made necessary by a significant amount of defective or neglected work of the Contractor, acceleration of the progress schedule involving services beyond normal working hours, and default by any Contractor. 10. Services to verify the accuracy of drawings or other information furnished by Owner. 11. Services required due to conditions different from those itemized under Basic Scope of Professional Services or due to events beyond the control of the Engineer. 12.
