Goclon, Chief of Police DATE: December 30, 2003 RE: Approval to expend and/ or donate forfeiture funds to law enforcement related uses/ charities ISSUE Should the Honorable Mayor and Board of City Commissioners authorize the Police Department to expend and/ or donate forfeiture funds to law enforcement related uses/ charities. BACKGROUNDIDISCUSSION Per Florida State Statutes 932.7055 .....any local law enforcement agency that acquires at least $15,000 pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than 15 percent of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, or school resource officer program(s). The local law enforcement agency has the discretion to determine which program(s) will receive the designated proceeds." During fiscal year 02/03, the Police Department acquired approximately $29,000 (15% of which would be $4350). This year, the Ocoee Police Department has chosen to expend and! or donate: $2000 to Central Florida Police Athletic League, a non-profit organization working with law enforcement that helps keep youth crime and drug free $2000 to A Child Is Missing, a public/private partnership, devoted to assisting law enforcement in search and recovery efforts of missing children, elderly, and disabled persons and notifying the public about sexual predators. $2000 to the Orange County Sexual Assault Treatment Center $2000 to the Orange County Victim Services Center $1500 to buy bicycle helmets to be given to children in need. RECOMMENDATION It is recommended that the Honorable Mayor and Board of City Commissioners authorize the Police Department to expend and! or donate forfeiture funds to law enforcement related uses/ charities.
