SUBJECT: Ordinance Pertaining to Naming of Subdivisions
ISSUE:
Should the Mayor and City Commissioners amend the Land Development Code to
provide a procedure for naming or changing the name of a subdivision?
BACKGROUND:
The City Commission has discussed the need to promote consistency and continuity
related to the naming of subdivisions. It was requested that language be added to the
Land Development Code to set up a procedure for both establishing the name of a
subdivision as well as changing the name of an approved subdivision.
DISCUSSION:
The attached ordinance adds provisions to the Land Development Code to ensure that
the naming of a subdivision is done in a manner which does not confuse the public or
conflict with the name of other existing subdivisions. In the past, many subdivisions
within the community have been reviewed and approved with a name that logically
references the subdivision geographically, only to then have the name changed upon
platting to an identification that bears no relationship to the community or its
geographical location. The proposed ordinance establishes a procedure whereby the
developer cannot arbitrarily change the name, but rather, has to seek permission of City
Staff and the City Commission.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
At their meeting on July 10, 2001, the Planning and Zoning Commission held a Public
Hearing on the proposed ordinance pertaining to the naming of subdivisions. There was
no one from the public present to speak on this matter. After a brief discussion on the
merits of this proposed amendment to the Land Development Code, the Planning and
Zoning Commission voted 6-0 to recommend adoption of Ordinance No. 2001-18. \HNIC

STAFF RECOMMENDATION:
Staff respectfully recommends that the Mayor and City Commissioners adopt Ordinance
No. 2001-18 to amend the Land Development Code to establish a formal procedure for
naming or changing the name of a subdivision.

AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
AMENDING SUBSECTION 4-4(G) OF ARTICLE IV OF
CHAPTER 180 BY THE ADDITION OF A NEW
SUBSECTION (7) THEREOF TO PROVIDE A
PROCEDURE FOR NAMING SUBDIVISIONS AND
PROVIDING A FORMAL METHOD OF CHANGING THE
SUBDIVISION NAME; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF
OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of
Florida and Chapter 166, Florida Statutes.
SECTION 2. Subsection G of Section 4-4 of Article IV of Chapter 180 of the
Code of Ordinances is hereby amended by the adoption of a new Subsection (7) to read as
follows:
(7) Subdivision Name
Every subdivision shall be given a name by which it shall be legally known. All
subdivision signage must be consistent with its legally assigned name. Such name shall
not be the same, phonetically, or visually similar to any name appearing on any
recorded plat in the County so as to confuse the records or to mislead the public as to
the identity or location of the subdivision, except when the subdivision is subdivided as
an additional unit or section by the same developer or his successors in title. No
subdivision name shall mislead the public as to municipality or geographic area in
which the subdivision is located. The name of the subdivision shall be determined by
the developer, and subject to review by the Development Review Committee, and
approval by the City Commission as part of the Preliminary Subdivision Plan. If at any
time, the developer intends to change the name of the subdivision, the developer shall
request the name change in writing. All correspondence regarding a name change shall
be sent to the Planning Director who shall make a recommendation to the Development
Review Committee, who shall make a recommendation to the City Commission. All
such name changes shall be subject to the approval of the City Commission. The
decision of the City Commission is final. After approval by the City Commission, it

shall be the responsibility of the developer to make the appropriate changes to all
applicable documents and reference the previous subdivision name on all
correspondence for three (3) months following the name change. The provisions of this
subsection shall be applicable in all zoning districts, including planned unit
developments.
SECTION 4. Conflicts. All ordinances, resolutions, parts of ordinances, or
parts of resolutions of the City of Ocoee in conflict herewith are hereby repealed and
rescinded.
SECTION 5. Severability. If any section, subsection, sentence, clause,
phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining portion
hereto.
SECTION 6. Effective Date. This Ordinance shall become effective
immediately upon passage and adoption.

The Ocoee City Commission will hold the first of two public hearings con-
cerning the proposed Ordinance on Tuesday,July 17,2001 at 7:15 p.m..or
as soon thereafter as practical,and the second of Iwo public hearings con-
cerning the proposed Ordinance on Tuesday.August 7, 2001 at 7:15 p.m.,
or as soon thereafter as practical,at the Ocoee City Commission Chambers,
150 North Lakeshore Drive,Ocoee,Fonda.The City Commission may con-
tinue the public hearings to other dates and times as they deem necessary.
Any interested party shall be advised that the dates,times,and places of any
continuation of these or continued public hearings shall be announced dur-
ing the hearing and that no further notices regarding these matters will be
• published.
A copy of file proposed Ordinance may be inspected by the public an the
Ocoee Planning Department. 150 North Lakeshore Drive, Ocoee, Florida,
between the hours of 800 a.m. and 500 pm ., Monday through Friday,
except legal holidays. Interested parties may appear al the public hearings
and be heard with respect to the proposed Ordinance.This notice is given
pursuant to Section 165.041 (3)(c),Florida Statutes.
Any person wishing to appeal any decision made with respect to any matter
considered al the public hearings will need a record of the proceedings and
for this purpose may need to ensure that a verbatim record of the proceed-
ings is made which includes the testimony and evidence upon which the
appeal is based.Persons wit disabilities needing assistance to participate
in any of the proceedings should contact the City Clerk's Office 48 hours in
advance of the meeting at(407)905-3105.
