SUBJECT: Change Order No. 4 — Maguire Road
Attached for your review and action is Change Order #4 for the Maguire Road widening
project.
On the second through fifth pages of the Change Order packet you will find a detailed
description of each of the seventeen items that comprise this Change Order, describing
what work was involved and why it was done.
Three of the items listed in this Change Order, numbers 4-4, 4-5 and 4-17, totaling
$9,509.50 are related to a bridge design problem. This was a geometric error that
required additional steel and concrete to correct. PEC has accepted liability for the
error, and on May 3, 2001 PEC provided a check to the City in the amount of $9,509.52.
Item numbers 4-15 and 4-16 are related to work required on the Consery II main due
to our need to relocate an existing air release valve in order to complete our road
widening project. This air release valve is currently functioning, and except for the road
widening, could have remained in place. There is, however, a malfunctioning butterfly
valve on the air release line that Consery would have to replace if at some future date
they wanted to do any work on the air release valve. To move the air release valve
now, as required by our project, the malfunctioning butterfly valve must also be
replaced now. Items 4-15 and 4-16 are for the replacement of this valve, and while
they are not required to participate in the cost, I've spoken to Consery II
representatives and they have agreed to split the cost of this work with us.

Item number 4-14 is for overtime for our Resident Project Representative. By contract,
this cost is to be reimbursed to the City by the Contractor. This Change Order provides
for the reimbursement by making the $2,113.02 a deduction from the total of the other
Change Order amounts.
In summary, of the total Change Order amount of $31,180.69, we have received
$9,509.52 from PEC and we will be reimbursed $2,575.96 by Consery II. This brings the
City's total expense down to $19,095.21 for Change Order #4.
I recommend that the City Commission authorize the Mayor and City Clerk to execute
Change Order #4 in the amount of $19,095.21.

III. JUSTIFICATION
4-1 Provide electrical service connections as addressed by Work Directive No.'s 3 &4 due to FPL

to allow for road construction at referenced location.
4-3 Provide additional Chain Link Fence Gate(12' Width)at the City of Ocoee's Pond 5 Lift Station to
allow for proper access to wet well.

Substructure Abutment Plan.

4-17 Contractor delayed from Bridge Abutment Phase I construction. Claim details idle time for
equipment and personnel over claim period.
IV. NARRATIVE OF NEGOTIATIONS
4-1 WD#03/#04 issued by City of Ocoee on 4/5/01 and 4/17/01 at maximum limit value combined of
$3,000.00. Contractor provided cost(time&materials)on 05/07/01 at$3,201.90.

4-2 U.57- On April 09,2001, REF 412 was issued to the Contractor. On April I I,2001,the
Contractor detailed additional quantities due to Removal and Disposal of existing Consery II
Concrete Cap located within limits of Old Maguire Road at Maguire/Roberson Intersection at a
total cost of$4,584.27 and at no extension of Contract Time. The total cost was revised to
$3,948.87 during negotiations of 04/13/01 and 04/17/01. PEC made recommendation to the
Owner's Engineering Staff of acceptance of this additional cost for additional quantities due
Removal and Disposal of existing Consery II Concrete Cap located within limits of Old Maguire
Road at Maguire/Roberson Intersection at the revised total cost of$3,948.87 and no extension of
Contract Time. Unit Cost of work calculated at$39.49/SY for material removed and disposed.
On April 23,2001,the Owner's Engineering Staff accepted Contractor's proposal for
recommendation to City Council. As Unit Cost takes precedence,the total cost is calculated at
$3,949.00
4-3 U.58 - On April 09,2001, RFP#13 was issued to the Contractor. On April 18,2001,the
Contractor detailed additional quantities due to Pond 5 Area Wastewater Lift Station Additional
Access Gate at$788.66 and no extension in Contract Time. On April 23,2001, PEC made
recommendation to the Owner's Engineering Staff of acceptance of this additional cost for
additional quantities due Pond S Area Wastewater Lift Station Additional Access Gate at no
extension of Contract Time. On May 04,2001,the Owner's Engineering Staff accepted
Contractor's proposal for recommendation to City Council.

apparent problem existed between the Pile Installation Plan and the Substructure Abutment Plan.
On March 21,2001,PEC received written correspondence from the Contractor addressing this
issue(See enclosed). On April 02,2001,FO#09 was issued. On April 09,2001,the Contractor
accepted the established Contract Unit Price for additional work proposed. On June 05,20011,
PEC made recommendation to the Owner's Engineering Staff of acceptance of increase in quantity
due to Modification in Abutments for Class II Concrete(Substructure). On June 07,2001,
Owner's Engineering Staff accepted Contractor's proposal for recommendation to City Council.

apparent problem existed between the Pile Installation Plan and the Substructure Abutment Plan.
On March 21,2001, PEC received written correspondence from the Contractor addressing this
issue(See enclosed). On March 23,2001,the Contractor provided requested record drawing
information with respect to the actual location of piles as installed(see enclosed).On April 02,
2001, FO#09 was issued. On April 09,2001,the Contractor accepted the established Contract
Unit Price for additional work proposed. On June 05,20011,PEC made recommendation to the
Owner's Engineering Staff of acceptance of increase in quantity due to Modification in Abutments
for Reinforcing Steel(Substructure). On June 07,2001,Owner's Engineering Staff accepted
Contractor's proposal for recommendation to City Council.
4-6 thru 4-8 U.59, U2IA and U22A- Additional work performed in accordance with Work Directive No. 5
(05/14/01),Work Directive No. 6(05/16/01)and Work Directive No. 7(05/23/01). PEC received
written correspondence from the Contractor addressing the above Work Directives dated May 29,
2001. On May 29,2001,the Contractor provided requested cost information to PLC on the above
items for a total cost of$5,533.55.
4-9 thru 4-13 Quantities reflected represent field measured values in excess of Bid Quantity amounts for work
performed.

4-14 U.60- RPR City of Ocoee Overtime. Weekly RPR overtime is detailed by attached table.
4-15 RFP No. 10 issued on March 21,2001 addressing 6"reclaimed watermain Line Stop to be
provided at Consery II at ARV to be relocated. On April 10,2001 the Contractor provided CPS
addressing RFP No. 10 plus cost of addition&6" gate valve at a total cost of$5,509.06 and no
increase in Contract Time. During negotiations of 04/17/01,cost was reduced to$4,651.91 for
RFP No. 10 related work and additional 6"gate valve. PEC addressed reimbursement issues with
Consery II by memo dated March 20,2001(see attached memo). City of Ocoee to reimburse
Contractor for work performed and receive possible reimbursement from Consery II for work
performed directly.
4-16 On April 10,2001the Contractor provided CPS addressing RFP No. 10 plus cost of additional 6"
gate valve. Contractor agreed to provide additional 6"gate valve at the established Contract Unit
Price($500.00/ea)at no increase in Contract Time. PEC addressed reimbursement issues with
Consery II by memo dated March 20,2001(see attached memo). City of Ocoee to reimburse
Contractor for work performed and receive possible reimbursement from Consery II for work
performed directly.
4-17 Letter received from Contractor on April 11,2001 detailing cost related to construction delay. On
June 05,2001, PEC recommended acceptance of Contractor's claim for additional cost at
$3,755.28 and no increase in Contract Time. On June 07,2001,Owner's Engineering Staff
- accepted Contractor's proposal for recommendation to City Council.

Acknowledgments:
The aforementioned change,and work affected thereby, is subject to all provisions of the original contract not
specifically changed by this Change Order;and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges,by its execution and acceptance of this Change Order,that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim
for increased costs of performance or modifications of time will be granted by the OWNER for the Work covered by
this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time against the
OWNER, it Agents or the Engineer arising from or relating to the matters or Work set forth or contemplated by this
Change Order.
