Dyson, Senior Planner 2 c THROUGH: Russ Wagner, AICP, Director of Planning / SUBJ: Brookestone Phase 3 Final Subdivision Plan Project# LS-2000-009 ISSUE: Should the Mayor and City Commissioners approve the Brookestone Phase 3 Final Subdivision Plan? BACKGROUND: The site is zoned for single family dwelling units, and Phase 3 is proposed for 92 units. This final phase encompasses approximately 40 acres, which is a portion of the larger Brookestone project, totaling 133 acres for all three phases. The subject property is located on the west side of Maguire Road, south of Tomyn Road. Phases 1, 2 and 3 already have an approved Preliminary Subdivision Plan (PSP). Phases 1 and 2 of the Brookestone project have approved Final Subdivision Plans (FSP), are platted, and are under construction. The existing zoning on the Phase 3 site is both R-1A and R-1AA. The proposed minimum lot width is 75 feet. The lots within the R-1A area will have a minimum size of 8,000 square feet, and the lots within the R-1AA area will be at least 9,000 square feet in size. These criteria are consistent with the approved zoning and Preliminary Subdivision Plan for Brookestone. The subdivision requirements necessitate that open space and recreation should be provided for the projected population of the development, and this requirement has been met through provision of active recreation sites in the earlier phases of the project, as well as an open space tract (Tract G) in this project, or in phase 3. . c\--..\ . POW 8/15/01 Brookestone Ph. 3 FSP Page 2 The wetland areas that are to remain on this site constitute 18.42 acres, and represent a major amenity for lots that will back up to these natural areas. The on-site wetland lines were determined and permitted prior to Phase 3, as part of the Preliminary Subdivision Plan approval for all three phases of the Brookestone project. DISCUSSION: A Technical Staff Review Committee (TSRC) meeting was held for this project on February 20th, 2001. The applicant resubmitted a set of plans on April 25th, in order to address issues that were raised at TSRC. One major issue that has taken additional coordination time is the secondary entrance on the realigned Tomyn Road (west side of the project). The City has maintained that the secondary entrance should be fully operational, being very necessary to the subdivision design as a connection to support services, emergency services, future school and park sites, etc... The Orlando-Orange County Expressway Authority's (OOCEA's) plans for the realigned Tomyn Road showed a piece of intervening land between the planned road right-of-way and the boundary of the Brookestone project. Through meetings with the OOCEA and the City, the Expressway Authority expressed conceptual approval for the intervening land to become part of the Brookestone project, in that the area was described by Expressway officials as unneeded right-of-way which is no longer necessary for the future Tomyn Road design. In July, the developer secured a letter from OOCEA legal counsel that indicates the intent to move forward with sale of the intervening land to Brookestone. Staff is also requiring that the islands at the secondary entry be moved back (eastward) twenty feet in order to accommodate stacking room when Tomyn Road is widened. On the current plan, the location of the entry islands do not appear to take into account the future roadway width and turning patterns off of Tomyn Road at the project entry. DRC RECOMMENDATION: The Development Review Committee (DRC) met to review this project on August 7, 2001. The DRC voted unanimously to recommend approval of the project, subject to two conditions of approval. P&Z RECOMMENDATION: The Planning & Zoning (P&Z) Commission met on August 14th to review this project. P&Z voted unanimously to recommend approval of the project, subject to the two conditions recommended by staff. Commissioner McKey asked questions of the applicant and staff regarding internal access to the active park site. There was also some discussion about wetlands and ditches that were pre-existing on the site. 8/15/01 Brookestone Ph. 3 FSP Page 3 STAFF RECOMMENDATION: Based on the recommendation of the Development Review Committee and Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commissioners approve the Brookestone Phase 3 Final Subdivision Plan, as date stamped received by the City on July 24, 2001, pursuant to the following Conditions of Approval: 1. That prior to plat approval for Phase 3, the City will require an affidavit of ownership for intervening lands located near the western entrance of the subdivision for unused right- of-way for the planned Tomyn Road realignment. 2. That the islands at the Tomyn Road entry shall be moved 20 feet eastward (away from the road ROW), to account for an appropriate entry design and adequate stacking room.
