Scott Vandergrift STAFF REPORT TO: The Honorable Mayor and City Commissioners FROM: Jean Grafton, City Clerk DATE: January 14,2004 RE: Resolution No. 2004-02 Change in Late Fee for Sewer and Water Billing In the January 6, 2004 regular Commission meeting, direction was given to staffto prepare a Resolution changing the fee for late payment of the sewer and water bills from $25 to $10 and for service restoration from $50 to $20. Resolution No. 2004-02 presents these changes for your consideration. RESOLUTION NO. 2004-02 A RESOLUTION OF THE CITY OF OCOEE, FLORIDA RELATING TO SEWER AND WATER SERVICE CHARGES; AMENDING EXHIBIT "A" OF RESOLUTION NO. 2002-14; DECREASING LATE FEES AND SERVICE RESTORATION FEES; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant to Section 174-9 of the Code of Ordinances of the City of Ocoee, Florida, Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes; and WHEREAS, on August 6, 2002, the City Commission of the City of Ocoee adopted Resolution No. 2002-14 relating to Certain Fees and Charges for Sewer and Water Service; and WHEREAS, the City Commission of the City of Ocoee desires to decrease the late fees and service restoration fees adopted in Exhibit "A" of Resolution No. 2002-14. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant to Section 174-9 of the Code of Ordinances of the City of Ocoee, Florida, Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment to Exhibit "A". Severahility. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto.
