ISSUE:
Should the Mayor and City Commissioners approve two waivers requested as part of the Better
Mobile Storage site plan?
BACKGROUND:
The Better Mobile Storage site is located at the west end of Enterprise Street at its intersection
with Roper Parkway, backing up to the SR 429 expressway (a.k.a.— the Western Beltway).
Several months ago, the City Commission approved a variance for this site to allow the owner to
use the site for vehicle storage without a paved surface, as long as adequate fire safety access
was provided. The updated Commercial and Industrial Development regulations permit the City
Commission, at its sole discretion, to waive provisions within the Land Development Code when
plans have been designed to: 1) be part of an integrated and master planned development; 2)
be compatible with surrounding developments; 3) impose no impacts on City infrastructure
greater than that generated by other uses normally permitted in the underlying zoning district;
and/or 4) provide an off-setting public benefit which is technically sound and measurable.
DISCUSSION:
The Land Development Code gives the Planning Director authority to negotiate waivers when a
specific plan furthers the goals and intents of the Commercial and Industrial Development
Regulations. In the case of the Better Mobile Storage site, the problems with an adjacent City
drainage ditch, the location of the site next to the Beltway as well as the previously approved
variance, result in a unique situation with this site.
Along a portion of the southern edge of the Better Mobile Storage site, there is an underground
drainage pipe which empties into a large open drainage ditch, also adjacent to the site. There is
currently no drainage easement for those drainage facilities, but there is a serious problem
because the pipe needs significant repairs and there has been severe erosion at the end of the

ditch. The owner has offered to provide a drainage easement and to do the necessary repairs to
the pipe and the ditch, in exchange for waivers to certain Code requirements on the site plan.
The owner is requesting two waivers from Code requirements as follows:
1) A waiver to not require any landscaping in any of the perimeter landscape buffers,
except as currently shown on the plan along a portion of the southern property line.
2) A waiver to allow a 10' x 60' pre-engineered building that would not meet the strict
building design guidelines in the Land Development Code.
The Code requires all commercial and industrial sites to have landscape buffers with trees,
shrubs and ground covers along road frontages, as well as along all side and rear property lines.
The aforementioned drainage pipe and ditch are located along the entire southern edge of this
site, the Western Beltway is located along the entire western edge of the site, a retention pond
for the Beltway is located along the entire northern edge of the site, and the entire eastern edge
of the site faces the rear of an existing industrial building. Considering those surrounding
conditions, except for some shrubs currently shown along a portion of the southern property line
near the front of the site, the owner feels that it would be unreasonable to provide the extensive
landscape buffers required by the Code along the side and rear boundaries of the site.
Given the location of the site and the City Commission variance to allow storage of vehicles
without a paved surface, the owner is intending to provide a small pre-engineered metal-sided
building as an office for his vehicle storage business. Such a building would not meet the Land
Development Code's strict building design guidelines for buildings in commercial and industrial
areas. Considering the limited site improvements being proposed for this vehicle storage site,
owner feels that it would be unreasonable to provide an expensive building for his offices.
Given the unique circumstances on this site and the owner's offer to provide the needed
drainage improvements, Staff believes that the two proposed waivers result from unique site
specific conditions and that the off-setting public benefits may justify the two proposed waivers.
If these two proposed waivers are approved by the City Commission, the lot tying agreement
and the site plan would still need a few revisions before they could be approved for construction.
The remaining outstanding issues are all relatively minor and the owner has agreed to address
them with a revised agreement and site plan. Those issues are listed in the attached Staff
memo dated August 28, 2001.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Mayor and City Commissioners approve the two
proposed waivers for the Better Mobile Storage site(Project No. SS-2001-002), subject to: 1) the
owner providing the needed drainage improvements, to be specified by the City Engineer; and,
2) subject to revising the lot tying agreement and the site plan to address all other outstanding
issues identified in the attached Staff memo dated August 28, 2001.

Small Scale Site Plan, Received August 16, 2001
These comments list the concerns of the Planning Department related to the current plan
submittal. These are changes that would need to be made in order to meet Code requirements
that apply to this proposed site plan. The applicant will be requesting waivers from the
requirements discussed in Comments 1 and 9. If those two waivers are approved by the City
Commission, the issues discussed in those two Comments will no longer be relevant. All the
other Comments will need to be addressed on a revised site plan which will be reviewed for
compliance with City Commission action and, if approved, will be part of the building permit
documents.
1) [Repeat Comment, Modified] Landscape buffers are required around the perimeter of
the site pursuant to the requirements of Ordinance #99-23. Revise the plan to show a
15-foot landscape buffer along the eastern property line and a 10-foot landscape buffer
along the northern, southern and western property lines. (Waiver request to not require
any landscaping in any of the perimeter landscape buffers, except as currently shown
on the plan along apportion of the southern property line)
2) As currently shown on the plan, it appears that the HC parking space is not paved. The
HC space and the adjacent 5' clear area need to be paved to meet ADA requirements.
3) Revise the plan to show the top of bank for the existing drainage ditch and any
underground drainage pipes along the southern edge of the site, and to show a
drainage easement for any underground drainage improvements or portions of the ditch
which are on the site.
4) Provide appropriate notes and details as required by the City Engineer to describe and
illustrate any proposed drainage improvements related to the underground drainage
pipes and the drainage ditch along the southern edge of the site.

5) [Repeat Comment, Modified] Revise the plan to include size specifications for all
proposed plant materials shown on the plan. Shade trees should be a minimum of 3"
DBH, understory trees a minimum of 2" DBH (or for multi-trunk trees, minimum of four 1"
DBH trunks) and shrubs a minimum of 3 gallons (24" —30" tall).
6) The plan currently shows an oak tree to be planted on top of a new sewer line. Either
the tree or the sewer line needs to be relocated, or both, so the tree is at least 15' away
from the sewer line.
7) Revise the Lot Tying agreement to include applicable legal descriptions for the lots
involved in the agreement.
8) The plan appears to show shrubs around the dumpster enclosure as required by the
Code, but they are not labeled — please label those shrubs.
9) Provide more information regarding the design of the proposed building to confirm that it
will meet Code requirements. (Waiver request to allow a 10' x 60' pre-engineered
building)
10) Revise the plan to include a note indicating that the new electrical service and all other
utilities to the site will be placed underground.
11) Any waivers from Code requirements need to be presented in a "Waiver Table" on the
plan, which has four columns: Code Section Citation, Code Standard, Proposed
Standard, Justification for Waiver (i.e. - unique site constraints, additional open space,
etc.). The waivers should be listed as they were approved by the City Commission.
