HomeMy WebLinkAbout06-25-2019 Minutes CITY OF OCOEE Code Enforcement Board June 25,2019 I.CALL TO ORDER Member Odom called the Code Enforcement Board regular meeting to order at 7:04 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive,Ocoee, Florida. A. INVOCATION: Member Lomneck initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Mann led the Board in the Pledge of Allegiance to the U.S.flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Members Odom, Lomneck, Mirza, Bandur,& Mann. Also present: Board Attorney Mary Sneed, Assistant Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Siegrist& Loeffler. ABSENT: Chairman Lowery,Vice-Chairman Carrington & Member Lewis are excused absences. D. SWEARING OF OFFICERS/WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II.CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2019-00142 OFFICER SIEGRIST 2151 EL MARRA DR CRAIG H VIDLER JENNIFER M VIDLER Violation Cited: §165-3.A. Summary: No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation:One (1) Honda Acura TL/blk/ NO TAG/parked in driveway. Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of June 25, 2019, the property is still in non-compliance. The City asked for an order of compliance within 10 days, or thereafter to be fined $50.00 per day, per violation until found in compliance. Member Lomneck,seconded by Member Mirza, moved that in Case#2019-00142, the respondent be found in violation as cited as of April 10, 2019, and be given until July 6, 2019, to come into compliance or be fined$50.00 per day, per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2019-00237 OFFICER SIEGRIST 2453 GRAND POPLAR ST ANTONIO L DAVIS SONYA WORRELL Violation Cited: §108-24.D., §115-3.b., &§150-20.Q. Summary: It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. No person shall allow or permit excessive growth,ten inches or more on property owned,of weeds,grass, undergrowth or other dead or living plant life. It shall be unlawful for any person to cause or permit to be drained, deposited, placed or otherwise discharged into such natural waters, receiving waters, outlets or storm water management systems any organic or inorganic matter which causes or tends to cause pollution including silt. Observation: Misc. debris, wood, materials stored alongside of garage, tall weeds and grass side and rear yard, & silt /sediment dirt erosion onto sidewalk, into street and into storm water system. Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of June 25, 2019, the property is still in non-compliance. The City asked for an order of compliance within 10 days, or thereafter to be fined $50.00 per day, per violation until found in compliance. Member Lomneck, seconded by Member Mann, moved that in Case#2019-00237, the respondent be found in violation as cited as of April 11, 2019, and be given until July 6, 2019, to come into compliance or be fined$50.00 per day, per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2019-00299 OFFICER LOEFFLER 2008 LAUREN BETH AVE DERRICK SCOTT LANG Violation Cited: §6-4.H.(6)(b), §165-3.A, §168-4.A.(1)(16), & §168-6. B.(1) Summary: Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. No person shall keep any abandoned or junk vehicle on any public property or any private property. Parking is prohibited in grassed or landscaped portions of all public and private roadways and rights-of-way except along streets with a width of less than 22 feet. No owner, private property, shall consent to the parking or storing of vehicles on non-improved surfaces of the property. Observation: Occupied RV camper parked in street with expired tag and connected to utilities. Disassembled vehicles& vehicles without license tags on property. Vehicles parked upon grass easement and sidewalk areas. Vehicles parked / stored upon non-surfaced unimproved grass yard surface. Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of June 25, 2019, the property is only in compliance for 6-4.H.(6)(b). The City asked for an order of compliance for the remaining three violation within 15 days,or thereafter to be fined$50.00 per day, per violation until found in compliance. Member Lomneck, seconded by Member Bandar, moved that in Case#2019-00299, the respondent be found in violation of codes 165-3.A, 168-4. A.(1)(16), & 168-6. 8.(1), as of April 30, 2019, and be given until July 10, 2019, to come into compliance or be fined$50.00 per day, per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2019-00323 OFFICER LOEFFLER 2700 WESTYN COVE LN TRAMELL WEBS PARTNERS INC Violation Cited: §115-3.A.(3) &§115-3.B. Summary: No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. No person shall allow or permit excessive growth,ten inches or more on property owned,of weeds,grass, undergrowth or other dead or living plant life. Observation: Prohibited dumping/ placement of junk, litter and landscape debris; owner not preventing, monitoring or managing&overgrown tall weeds and grass, rear and gully section of parcel. Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of June 25, 2019, the property is still in non-compliance. The City asked for an order of compliance within 15 days, or thereafter to be fined $25.00 per day, per violation until found in compliance and the option to abate the property at the cost of the property owner. Member Mirza, seconded by Member Lomneck, moved that in Case#2019-00323 the respondent be found in violation as cited as of May 7, 2019, and be given until July 10, 2019, to come into compliance or be fined$50.00 per day, per violation that remains in non-compliance. The Board further authorizes the City to abate the property with the costs assessed against the property. Motion carried unanimously. CASE NO 2019-00385 OFFICER SIEGRIST 2458 AULD SCOT BLVD CHRISTOPHER P KINDRED CHRISTINE A KINDRED Violation Cited: §115-3.B. Summary: No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass, undergrowth or other dead or living plant life. Observation:Grass/weeds over 10' especially backyard. Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of June 25, 2019, the property is still in non-compliance.The City asked for an order of continuance. Member Lomneck,seconded by Member Mirza, moved that Case #2019-00385 be continued to the July 23, 2019, Meeting. II. Case Resolution CASE NO 2019-00191 OFFICER LOEFFLER 831 LICARIA DR JOHN N DENT ESTATE Violation Cited: §6-4.H.(6)(b), §115-3.b, &§165-3.A. Summary: Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass, undergrowth or other dead or living plant life. Observation: RV Camper parked/stored in prohibited location,tall weeds and grass,vehicle with expired tag. Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of June 25, 2019, the property is still in non-compliance for violations §6-4.H.(6)(b) & §165-3.A. The City asked the Board impose fines as previously set by the Board. Member Lomneck, seconded by Member Mirza, moved that in Case#2019-00191, the Board imposes fines starting May 9, 2019, as previously set by this Board. Motion carried unanimously. V. COMMENTS Clerk Mieras introduced Alternate Member Mann and explained the alternative member will be asked to fill in when there is a known expected absence. Additionally, if an alternate member is in audience and a regular member is not here when the meeting starts he may be asked to fill in.
