SUBJECT: Magnolia Ridge Development Processing
ISSUE:
Should the Mayor and City Commissioners consider processing the Magnolia Ridge
project in a manner different than other land development projects?
BACKGROUND:
On June 12, 2001, the City Commission and the Planning and Zoning Commission held
a joint workshop to hear presentations by various developers on proposed projects being
considered within the community. At that meeting, the Magnolia Ridge project proposed
by Steve Dill was presented, and subsequently, a booklet was provided which
summarized the proposed development. These documents were described as "High
Concept Only" by the project designer.
DISCUSSION:
Based upon conversations and correspondence from representatives of the Magnolia
Ridge project, it is Staffs understanding that the developer wishes to enter into a
Development Agreement with the City that will establish a development program for the
project prior to actual submission of plans. Since the developer has made no formal
application to review this project under normal City review procedures, Staff would like to
clarify the wishes of the City Commission with regard to development processing
procedures.
Normally, Staff would not process this development unless the following steps were
followed:
1) Submission of formal applications for rezoning, subdivision review, and
small / large scale comprehensive plan amendments, togeth with
appropriate fees and deposits.

2) Submission of appropriate site plans, maps and other technical data /
studies which meet typical City sufficiency requirements.
3) Review of proposed rezoning petitions, plans, and amendments under the
normal City development review processing timeline, cycled together with
all other projects currently under review.
4) Preparation of a Development Agreement only after plans have been
reviewed by Staff and after all development program issues have been
worked out between the City and the developer.
5) Processing of developer-initiated Large Scale Comprehensive Plan
Amendments where all supporting documentation has been prepared by
the developer, not City staff, and only when consistent with the City
approved development procedure and published Large Scale Plan
Amendment review cycle (to be approved by City Commission action.)
STAFF RECOMMENDATION:
While it is the Mayor and City Commissioner's choice to direct Staff to process a project
outside normal City development review procedures, Staff believes that the standard
procedures outlined in this report have proven to work effectively to ensure that
developments are processed in accordance with the high quality standards established
within the Ocoee Land Development Code. Accordingly, it is recommended that the
Mayor and City Commissioners direct Staff to follow standard City development review
procedures for the proposed Magnolia Ridge project.
