ISSUE:
Should the Mayor and City Commissioners approve the Conceptual Plan for the Villas at
Woodsmere?
BACKGROUND:
The Villas at Woodsmere townhouse development is located on the west side of Good
Homes Road, just north of SR 50 and the Good Homes Plaza. The property has a
Professional Offices and Services Future Land Use designation in the Comprehensive
Plan and is zoned P -S. The northern edge of the subject property abuts part of the Rose
Hill subdivision in Orange County, the southern edge and western edges of the subject
property abut the Good Homes Plaza shopping center and an existing retention pond.
This site is covered with planted pines and a mixture of oak trees and other varieties of
trees scattered around the property.
This proposed townhouse development is not consistent with the existing zoning of the
subject property. However, Section 4-6(A)(4) of the Land Development Code provides a
special procedure for approval of a Conceptual Plan for a proposed development within
the SR 50 Special Overlay District that is inconsistent with the existing underlying
zoning. This special procedure is available only if the proposed uses generate impacts
of equal or lesser intensity than the uses permitted by the existing underlying zoning.
The procedure requires advertised public hearings with the Planning and Zoning
Commission and the City Commission. The City Commission may impose any
additional Conditions of Approval as it deems appropriate. Any approval of the
Conceptual Plan will be subject to a Preliminary and Final Subdivision Plan acceptable
to the City Commission and in compliance with the requirements of the Land
Development Code.

DISCUSSION:
The Villas at Woodsmere townhouse subdivision includes 64 townhouse lots on about
6.4 acres. As shown in the Conceptual Plan, there is an existing 7' brick wall along the
entire southern boundary of the site. The Developer will construct a new 7' brick wall
along the entire northern and western boundaries of the site to buffer the townhouse
development from the existing Rose Hill subdivision. Tum lanes on Good Homes Road
will also be provided as determined by a traffic analysis approved by the City with the
Preliminary Subdivision Plan. The Villas at Woodsmere will be a gated community with
gates at the entrance from Good Homes Road. The Land Development Code requires a
minimum living area of 1,200 square feet per unit for townhouses, which has been
exceeded in this Conceptual Plan (the plan shows an minimum 1,500 square feet). The
only waiver being requested is from the maximum cul-de-sac length of 800 feet, due to
the unique constraints of limited access and the shape of the subject property. This
requested waiver is supported by Staff.
The Traffic Impact Analysis shown on the Plan indicates that the impact of the proposed
townhouse development is less than the impact that would have been generated by an
office development on this property, thereby meeting the criteria set forth in the Code for
a development that is inconsistent with the underlying zoning.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) reviewed the proposed Conceptual Plan on
February 25, 2004 and discussed a few remaining issues. The discussion centered on
issues that were identified in written comments from Foley and Lardner and from
Planning. It was agreed that all of the requested changes to the Plan would be made
prior to the Planning and Zoning Commission hearing. It was also recommended that
the Developer meet with the Rose Hill HOA prior to the public hearings. When the
discussion was finished, the DRC voted to recommend approval of the Conceptual Plan,
with the plan changes identified in written comments from Foley and Lardner and from
Planning.
All of the plan changes that were discussed at the DRC meeting have been made on the
plans that were submitted for the public hearings.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission is scheduled to consider the Conceptual Plan for
the Villas at Woodsmere on March 9, 2004. The City Staff and the Developer will
present a staff report and answer questions about any issues that come up. Since this
package was sent out prior to the Planning and Zoning Commission meeting to discuss
this proposal, Staff will provide a summary of the P&Z discussion and action at the City
Commission meeting.
STAFF RECOMMENDATION:
Based on the recommendation of the DRC, Staff respectfully recommends that the
Mayor and City Commissioners approve the Conceptual Plan for the Villas at
Woodsmere, as date stamped received by the City on March 4, 2004, including the
proposed waiver regarding cul-de-sac length.

ANTICIPATED TRAFFIC DEMAND OF THIS PROPOSED DEVELOPMENT. THE
PLACEMENT AND LENGTH OF THE TURN LANES SHALL BE DETERMINED BY A
TRAFFIC ANALYSIS, APPROVED BY THE CITY, TO BE SUBMITTED WITH THE
PRELIMINARY SUBDIVISION PLAN.
5. A FENCE WITH BRICK COLUMNS AND DECORAYIVE METAL FENCING BETWEEN
THE COLUMNS, ALONG WITH APPROPRIATE LANDSCAPING AS REQUIRED BY
THE Ido, SHALL BE PROVIDED ALONG THE ENTIRE SITE FRONTAGE OF GOOD

6. A SEVEN (7) FOOT BRICK WALL SHALL BE PROVIDED AS A BUFFER ALONG THE
ENTIRE NORTHERN AND WESTERN SITE BOUNDARIES, TO MATCH THE EXISTING
BRICK WALL ALONG THE SOUTHERN SITE BOUNDARY.
7. THE PRELIMINARY AND FINAL SUBDIVISION PLAN SHALL MEET ALL REQUIREMENTS
OF SECTIONS 6-14 AND 6-15 OF THE LDC AS THEY APPLY TO TOWNHOUSE AND
MULTI -FAMILY DEVELOPMENTS, SUBJECT TO THE RIGHT OF THE OWNER TO APPLY
