Shira, P.E., City Engineer/Utilities Director SUBJECT: Lake Olympia Estates Lift Station — Update I wanted to provide you with the latest information we have on this incident, and explain steps taken to prevent a recurrence. We have a total of 44 lift stations, most of which are standard lift stations and a few of which are either small grinder stations, or are privately owned but maintained by the City under contract. The Lake Olympia Estates lift station was one of a few remaining standard lift stations that were slated to get an autodialer in this fiscal year. This lift station was installed in April of 1990, and at that time, autodialers were not required. In the years since, we have tried several types and brands of autodialers with varied success. Most of the early ones were not very reliable and have, from time to time, been replaced with newer versions. The problem we had at this lift station began with a blown fuse in a low voltage circuit within the control panel. We have no way of knowing what made the fuse blow, although we know that power dropped out briefly in a large part of the city that day, and we suspect that this may have caused it. Whatever the cause, power to the entire station was out only momentarily, but power to the low voltage circuit was out completely as soon as the fuse blew. The older style autodialers only send an alarm in the event of a total loss of power to the lift station that lasts for several minutes. If this station had been equipped with the type of autodialer in use when it was built, no alarm would have been sent, since power was restored to the station within a few moments. When the fuse blew, power to the float switches and alarm circuitry was lost. The float switches tell the pumps when to turn on and off. With no power to the floats, there was nothing to tell the pumps to turn on. Since power to the whole station was not lost, no alarm would have been sent even if an autodialer had been installed. We have designed a modification to the internal circuitry that will allow a signal to be sent to an autodialer in the event this fuse blows again. This modification consists of a relay and some additional wiring as well as connections to the autodialer. We checked with the manufacturer of this lift station's control panel, and with the manufacturer of the most common control panel in our inventory. Neither manufacturer installs this relay as a standard item, and would install it only if specifically requested to do so by the customer. The reason for this is that the relay serves a purpose only if an autodialer is installed, and the installation of an autodialer is still more the exception than the rule. We will make this relay a standard item on future lift stations, and have added one to each of our existing lift station control panels, including the Lake Olympia Estates lift station. We have also installed an autodialer at the Lake Olympia Estates lift station that we removed from the old control panel for the lift station at Bluford and SR 50. The new panel for that lift station came with an autodialer. The autodialer we removed is the new style, so the Lake Olympia Estates lift station has the latest equipment we are using. On Friday of last week we discovered that even with all of this additional protection, our lift stations are still not completely fail-safe. We can now use the computer and phone line at the wastewater plant to call most of our lift stations to check on their operating status. During a routine check of the Lake Olympia Estates lift station, we were unable to make contact with the lift station and sent someone to investigate. Upon arrival, we discovered that the phone line that connects to the brand new autodialer had been cut. A contractor hired by the homeowner's association to install an irrigation system had cut the line. We were able to make a temporary repair of the phone line, and notified the phone company to come and make a final repair. We will bill any expenses incurred back to the contractor who caused the damage. This week we began installation of check valves in the sanitary sewer service lines at the affected homes. We have informed the homeowners that they must be careful to flush these out occasionally to prevent a buildup of grease and debris that would render the check valve inoperable. All of the homeowners indicated that they understood the importance of this maintenance. If you need further information on this subject, please let me know. The extra relay we have added will NOT be in a standard lift station control panel. The extra relay would only be added at a customer request. These extra relays are only added if the customer has a SCADA system or some type of monitoring system. Basically control panels are built to each customers specifications.Since we have the Micro Tel system we have added this to our specification. We have been using the Micro-Tel system for only a couple of years adding more controllers as the budget allows. This years budget will complete the system and yes they have been ordered. Aside from the incident itself, there were a number of factors which came together to exacerbate the cost of these claims. Firstly, an Industrial Hygienist was employed by one of the owners and made recommendations to all the property owners as to remediation. These recommendations seemed excessive to me but 1 have no training in microbiology and cannot dispute the need for these remediation measures. Additionally, there were disputes over the workmanship when the initial contractor was removed and another restoration service was engaged which resulted in some finger pointing between the contractors over the quality of some of the work which was done. The timing of the incident around the holidays made matters worse. Overall, the charges seem reasonable for the work that was done. On the surface, some things seem excessive but I cannot be certain without knowing the extent of the water intrusion, the degree of contamination and the necessity of some of the measures recommended by the Hygienist. We discussed a couple of things including the cost of floor covering that you negotiated downward with the vendor. We also agreed that the $6,000 claimed by Mr. &Mrs. Luce for their bedroom suite was excessive and that you would offer the replacement cost up to $3,000 contingent on their actually purchasing the furniture. The City appears to have made a considerable effort to accommodate these families and from my review of the invoices and estimates for damages already paid by the City, I must say that you have been more than fair in every respect. It is also my opinion from having spoken to each of these claimants that most of them feel violated because of this incident and despite your best efforts to indemnify these people, they still feel entitled to additional compensation. From some of their comments to me, it appears their expectations are far beyond what I would consider reasonable. For the most part,this involves items of household furniture and personal property. I will apply the same standard that would be applied if I were representing your liability insurance carrier. This includes not only evaluating the property damaged but also the extent to which you would be legally liable assuming you arc liable for the damages. My understanding of the applicable law is that basically, their claim for damages is limited to the value of the damaged property. lam not an attorney but I believe there is no legal basis for any claim for damages in the area of"pain and suffering"or any claims for inconvenience or punitive damages. I will make it clear to the parties involved that any negotiated agreements are subject to approval by the City and that I have no authority to bind the City to any settlement. My hourly rate is$75.00 per hour plus mileage and expenses. I expect the resolution of these remaining claims will not be easy. With your permission, I will submit an interim bill when the cost of my services reaches$1,000 and at that time we can discuss my progress and a budget for the anticipated time needed to conclude the claims. Shira, P.E., City Engineer/Utilities Director fps SUBJECT: Lift Station Failure — Lake Olympia Club Subdivision On December 12, at about 8:00 P.M., I received a call at home reporting a sewer backup in one or more homes on Olympia Drive. When I arrived, I found that there were three homes involved, and later learned that a fourth home was also affected. Utility Department personnel were at the scene and had switched the lift station controls to "manual" to begin pumping down the lift station. It was apparent that the lift station had failed to operate, and this resulted in a backup of sewage into these four homes, all of which have a floor level below the top elevation of the lift station. When we began trying to determine the cause of the failure, we found that a fuse on the low power circuit had blown. This fuse controls 24 volt power to the float and autodialer circuits. Even though there was power to the lift station, the blown fuse killed power to the float and autodialer circuits, effectively shutting off the lift station. This is not an incident that would have been avoided by the installation of an emergency generator since the lift station did not actually lose power for any length of time. The autodialers are normally set up to send an alarm in the event of complete loss of power to the lift station, failure of a pump to start, or high water. They aren't wired to send an alarm if power is available to the station, but has been lost in just the low power circuit. This lift station was built prior to the requirement that all lift stations have autodialers, and it was one of several that we planned to install new autodialers in this year. It may be that there was just enough of a surge when the power dropped out and then was quickly restored, to cause the fuse to blow. Since a fuse is designed to blow in the event of an overcurrent, it can't be said that the fuse "failed." It did what it is designed to do, but in doing eddta it major problem. This is not something we have ever had happen before, and happened, it wasn't apparent that there was a hole in our protection scheme. this ontrol In prevent a recurrence, n relays to all lift sst ttion panels as fast as weed a new electrical relay ocan. cWe have panel, and are adding similar also installed a new autodialer, and have connected the new relay to the autodialer so that it will send an alarm in the event that the low power circuit is lost due to a blown fuse or any other cause. Now, if the same fuse blows, the circuit will close and the autodialer will send an alarm signaling a loss of low voltage power. We will also replace all fuses on a routine basis, whether there is reason to suspect their condition or not. With this new relay, there is no condition that we can think of that would cause a similar problem except a direct lightning strike, or the loss of the phone circuit. Since the addition of the new relays does not make this station completely bullet-proof, we are looking into two other possibilities as far as protection for these four homes. One is the addition of a check valve in the sanitary sewer service line leading from the house. This device is essentially a one-way flapper valve that allows flow from the house, but stops it from backing up into the house. These are relatively easy to clog, and once clogged, cause sewage from within the house to back up into the house. If we install these, we will have to work with the homeowners to make sure they are flushed regularly to prevent clogging. The other possibility is the installation of a self-contained lift station similar to those used at the Beech Center, Community Center, Starke Lake bathroom, and Vignetti Center. These are sturdy units that would pump sewage from each house, breaking the gravity connection between the house and the city's lift station, and thereby eliminating the possibility of back up from the city's lift station. Had these homes been at a higher elevation, this sewage backup probably would not thesehave the time r elev houses was At thisunder ion wasquestioned, o and it was recommended that they be o raised. t The of developer objected, noting that raising the floor elevations would result in extra cost for fill material, and loss of back yard area due to the need for a retaining wall to keep the fill out of the lake. I have directed our engineering staff to look very carefully for similar grading situations on any plans presented for review, and our recommendation Pat Page 3 will be that all such lots be raised to an elevation that will preclude sewage backflow. This will increase development cost for those lots, and in some cases this requirement may result in loss of trees. In summary, the cause of the problem has been identified, and corrective action has been taken at the affected lift station. Similar corrective work is being performed at all lift stations, regardless of whether there are low-lying lots in the area. We are investigating what measures are available and most effective to provide a further layer of protection for these homes, and will present that information to you within two weeks. In that capacity I acknowledge receipt of this claim. My investigation has uncovered the following information.A fuse controlling electric power flow in a control panel blew at some point yesterday. Possibly when there was a brief loss or interruption of power in the City sometime around noon-Ipm yesterday. When the fuse blew electricity to some sewage pumps was cut off. When the pumps go down the City is alerted by an"auto dialer" system so countermeasures can be implemented. However,the"auto dialer" system did not function here because the blown fuse cut off it's power as well. The City first got notice of the problem at around 8pm as a result of a citizen complaint. Finally,the pumps aren't in an area that City Employees are routinely in close physical proximity to, so they weren't in a position to have noticed the pumps were down. Of course,that's one of the reasons for the alert system. Given this information it is my opinion that this unfortunate event occurred in the absence of negligence on anyone's part. I just don't see that the City did anything that a reasonable person would call negligent. Hence, my position is the City isn't liable for the property damage to these citizens and they should be directed to file a claim with their Homeowners Insurance . P.O.
