Should the Mayor and City Commissioners approve the Preliminary Subdivision Plan for the
Heavener Subdivision?
BACKGROUND:
The Heavener Subdivision includes 30.4 acres and is located in the northwest quadrant of the SR 50
— Clarke Road intersection. The property has frontage on both SR 50 and Clarke Road, but does not
include the corner itself. The parcel at the corner contains about 3.3 acres and ;is known as the
Ozanian Property. The subject property is currently undeveloped with a large number of trees on the
site. The property has C-2 zoning and the surrounding property has P-S and C-2 zoning (east —
vacant land [Ozanian Property], Don Pablo's restaurant), R-1-AA, R-3 and PUD zoning (north —
conservation area, retention pond, vacant land), and Orange County A-1 zoning (west — wetlands).
DISCUSSION:
This subdivision plan will include a total of 6 commercial lots with one lot facing SR 50, two lots facing
Clarke Road, and three interior lots facing a private internal road. The internal road will provide
circulation from SR 50 to Clarke Road, to the adjacent Ozanian Property and to the adjacent
commercial property to the north (part- of the Lake Lotta Commercial Center PUD). The western
portion of the subject property (about 15.5 acres) is part of a large wetland area and will be a separate
tract dedicated to the City.
The subdivision improvements will include right turn lanes from SR 50 and from Clarke Road into the
site at the point where the internal road meets those collector roads. A traffic study will be performed
.prior to review of the Final Subdivision Plan which will make recommendations for the design of the
turn lanes and any additional improvements that may be necessary to mitigate traffic impacts from the
project. The internal circulation road will be a private road, but it will include turn lanes as appropriate
to safely direct traffic within the subdivision and onto the collector roads. Condition of Approval # 58
describes an additional access point from Clarke Road which was not supported by the DRC (fee
discussion of the DRC recommendation below). % /

There is an existing 30' platted road right-of-way along the boundary between Lot 1 of this
subdivision and the Ozanian Property. It is anticipated that that right-of-way will be vacated, the
northern half of it to be vacated along with approval of the Final Subdivision Plan. There is also
an existing temporary construction easement and an access and drainage easement near the
northern boundary of Lot 2. Those easements, except for the drainage easement,.will also be
vacated along with approval of the Final Subdivision Plan.
A -unique feature of this 'subdivision is -that it will include some filling of an area, below the 100
year flood elevation.. along the western portion of the site, with the required compensating
storage volume provided. This would normally not be permitted, however, since FEMA modified
the 100 year flood elevation after the Plans had begun the review process, an exception was
made. There will be no development below the 100 year flood elevation as it existed prior to the
change (96.5), but they will be allowed to develop a portion of the area which is between the old
elevation (96.5) and the new elevation (101.0), as long as compensating storage volume is
provided for that development.
Expanded City Retention Pond:
The City. currently owns and maintains a retention pond just north of the subject property. That
retention -pond currently treats stormwater drainage from Clarke Road and some of the adjacent
properties: -pursuant to. an existing Development Agreement. That agreement also.grants the
majority of Lots 1 and 2 of this subdivision the right to use that retention pond. The developer
has requested that the City enter into a Drainage and Stormwater.Agreement with the Developer
to� allow for an expansion of the existing retention pond so that other portions of this subdivision
may also utilize the City pond.
The City and. the developer have negotiated the terms of a Drainage and,.Stormwater Agreement
during the review process for the subdivision -plan. It is anticipated that the Agreement will be
finalized very shortly and it will be executed. and recorded prior to platting the subdivision.
Pursuant -to -the Agreement, -the developer will convey to the City additional property adjacent to
the existing pond to accommodate the expanded retention pond which the developer shall
construct at his expense. The City will continue to hold ownership of the entire expanded
retention pond, but the developer will bearthe expense of maintenance of the entire expanded
retention pond, with the provision that if the developer fails to adequately maintain the retention
pond, the City may do so at the developer's expense. Approval of this subdivision plan will also
be deemed to be approval of the Drainage and Stormwater Agreement and authorization for
execution of the Agreement.
Declaration of Easement Document:
In addition to the stormwater retention pond agreement, there will also be a Declaration of
Easement which provides for cross access between the Heavener Subdivision property and the
adjacent Ozanian Property using the private internal road. The location of the private internal
road through the subdivision, and in particular its intersection with SR 50, has been a matter of
discussion and negotiations during the review of the subdivision plan. The adjacent property to
the east, the Ozanian Property, currently has an approved Conceptual Plan that provides for
access to SR 50. The City, the developer and the owner of the Ozanian Property have been
negotiating a Declaration of Easement document which would provide for joint access over the

private internal road as shown on the subdivision plan. It is anticipated that the Agreement will
be finalized -very shortly and it will be -executed, and recorded prior to platting the subdivision.
Approval of . this subdivision plan will also be deemed. to. be approval of the, Declaration , of.
Easement document.
Development Review Committee Discussion:
The. Preliminary Subdivision -Plan for the Heavener Subdivision was reviewed by the
Development .Review Committee (DRC) on November 20,- 2001. There was significant
discussion during the DRC meeting about a variety of outstanding issues which were identified
in a DRC staff report. The concerns of.Staff were explained and the Applicant agreed to comply
with almost:all of the Staff recommendations. The Committee voted unanimously to recommend
approval of the Preliminary Subdivision Plan, subject to, making the revisions to the plans as
discussed in the meeting. Almost all of the DRC requirements have now been satisfactorily
addressed in the plans received November 28, 2001.
Condition of Approval # 58 on Sheet C-1 indicates that there will be a right -in only driveway
access from Clarke Road to Lot 1, and it also includes language about removing that access
point at some time in the future. That.Condition was specifically discussed at the DRC meeting
and Staff voted against it. Accordingly, the.DRC recommendation does not include .Condition of
Approval # 58. To comply -with the DRC recommendation that Condition. would need to be
deleted from the Plan.
PLANNING & ZONING COMMISSION RECOMMENDATION:
On December 11, 2001, the Planning and Zoning Commission held a public hearing to consider
the .Preliminary Subdivision Plan for the .Heavener Subdivision. The applicant spoke in favor of
the Plan, including Condition of Approval-# 58 as presented. There was no other input from the
public. There was discussion on a variety of issues, including tree preservation, the off -site
retention ponds and safety --concerns regarding the proposed right -in only access point. When
the discussion was finished, the Planning and Zoning Commission voted 7-1 to recommend .
approval of the Preliminary Subdivision Plan, not including Condition of Approval # 58, in
accordance with the Staff recommendation.
STAFF RECOMMENDATION:
Based upon the recommendations of the DRC and the Planning and Zoning Commission, Staff
respectfully recommends that the Mayor and City Commission approve the Preliminary
Subdivision Plan for the Heavener Subdivision, as date stamped received by the City on
November 28, 2001, with Condition of Approval # 58 deleted,and subject to execution of
the Drainage and Stormwater Agreement and the Access Agreement.

The Ocoee Planning and Zoning
Commission or Ocoee City Commis-
sion may continue the public hear-
ings to other dates and times, as
they deem necessary. Any interest-
ed party shall be advised that the
dates, times, and places of any con-
tinuation of these or continued pub-
lic hearings shall be announced dur-
ing the hearing and that no further
notices regarding these matters
