Should the Mayor and City Commissioners approve the Modified Preliminary / Final Subdivision
Plan for West End Professional Park?
BACKGROUND:
A Final Subdivision Plan for West End Professional Park was approved several years ago with
29 lots. This Preliminary / Final Subdivision Plan modifies that previously approved plan. This
modified plan will include a total of 14 commercial / industrial lots, located on the south side of
Professional Parkway just east of Maguire Road. The subject property is currently undeveloped
with very few trees on the site. The southern edge of the subject property abuts the Florida
Turnpike. The Oak Forest apartment complex and Lake Lily abut the eastern boundary. The
property surrounding the proposed subdivision has C-3 and I-1 zoning (west— medical center),
C-3 and I-1 zoning (north— various commercial / industrial uses), and R-3 zoning (east— multi-
family apartments).
DISCUSSION:
As shown in the Modified Preliminary / Final Subdivision Plan, the West End Professional Park
will have three points of access, all from Professional Parkway (two short cul-de-sacs and one
long cul-de-sac). Due to the construction of a new retention pond for the Maguire Road
widening project, the existing stub road next to the medical center will not be extended un.-r the
modified subdivision plan. There is an existing stormwater management pond in the midi e of
the site which will serve all the lots in the subdivision. The property has 1-1 zoning, which al\,tws
for some office/commercial uses as well as light industrial uses. Additional right-of-way�'•or
Professional Parkway will be dedicated to the City, in order to accommodate the current ro-,
widening project for that road. This provision is covered in an existing Developer Agret
with the City which also provides for certain waivers from the Land Development Code.

This Preliminary / Final Subdivision Plan includes six proposed waivers related to the Developer
Agreement. The first waiver is related to the maximum block length of 1,000 feet, which would
be necessary because the design of the road is restricted by existing site conditions. The
second, third and sixth waivers are related to providing sidewalks, relieving the Developer of
these responsibilities. The fourth and fifth waivers are related to building setbacks and
landscape buffers along Professional Parkway. All of these proposed waivers are supported by
Staff.
The Modified Preliminary / Final Subdivision Plan for the West End Professional Park was
reviewed by the Development Review Committee (DRC) on October 10, 2001. There was
significant discussion during the DRC meeting about a variety of outstanding issues which were
identified in a DRC staff report. The concerns of Staff were explained and the Applicant agreed
to comply with Staff recommendations. The Committee voted unanimously to recommend
approval of the Preliminary / Final Subdivision Plan, subject to making the revisions to the plans
as discussed in the meeting. All of the DRC requirements have now been satisfactorily
addressed in the plans received November 5, 2001.
PLANNING 8 ZONING COMMISSION RECOMMENDATION:
On November 13, 2001, the Planning and Zoning Commission considered the Modified
Preliminary / Final Subdivision Plan for West End Professional Park. The Staff and the
Developer provided a detailed presentation describing the project and the most important
issues. During the discussion, the Commission asked several questions regarding the proposed
waivers, which were addressed by Staff and the applicant. When the discussion was finished,
the Planning and Zoning Commission voted unanimously to recommend approval of the
proposed Modified Preliminary / Final Subdivision Plan, including all of the proposed waivers, in
accordance with the Staff recommendation.
STAFF RECOMMENDATION:
Based upon the recommendations of the Planning and Zoning Commission and the DRC,Staff
respectfully recommends that the Mayor and City Commissioners approve the Modified
Preliminary I Final Subdivision Plan for West End Professional Park, including all of the
proposed waivers, as date stamped received by the City on November 5, 2001.

7. THE LOCATIONS OF EXISTING UTILITIES AND STORM DRAINAGE
SHOWN ON THE PLANS HAVE BEEN DETERMINED FROM THE
BEST INFORMATION AVAILABLE AND ARE GIVEN FOR THE
CONVENIENCE OF THE CONTRACTOR. ENGINEER ASSUMES NO
RESPONSIBILITY FOR INACCURACY. PRIOR TO THE START OF
ANY CONSTRUCTION ACTIVITY, IT SHALL BE THE CONTRACTOR'S
RESPONSIBILITY TO MAKE ARRANGEMENTS FOR FIELD
LOCATIONS AND FOR ANY RELOCATIONS OF THE VARIOUS

8. ANY DIFFERING SITE CONDITIONS FROM THAT WHICH IS
REPRESENTED HEREON, WHETHER ABOVE, ON OR BELOW THE
SURFACE OF THE GROUND, SHOULD BE BROUGHT TO THE
IMMEDIATE ATTENTION OF THE ENGINEER AND OWNER IN
WRITING. NO CLAIM FOR EXPENSES INCURRED BY THE
CONTRACTOR DUE TO DIFFERING SITE CONDITIONS WILL BE
ALLOWED IF CONTRACTOR FAILS TO PROVIDE THE REQUIRED
WRITTEN NOTIFICATION OF SUCH CONDITIONS FOR REVIEW BY
THE ENGINEER AND OWNER.
9. CONTRACTOR SHALL PROTECT LAKE LILLY, LAKE PEARL,
ADJACENT WETLANDS AND ALL ADJACENT PROPERTIES FROM
DAMAGE BY SEDIMENTATION OR OTHER POTENTIAL
CONSTRUCTION RELATED CAUSES.
10. ALL RECOMMENDATIONS AND REQUIREMENTS OF INSPECTION
PERSONNEL OTHER THAN OWNER'S SHALL BE REPORTED TO
ENGINEER/OWNER PRIOR TO IMPLEMENTATION. COMPENSATION
WILL NOT BE ALLOWED FOR WORK WHICH IS NOT AUTHORIZED
BY ENGINEER/OWNER.
11. CONTRACTOR SHALL BE EXTREMELY CAUTIOUS WHEN WORKING
NEAR TREES WHICH ARE TO BE SAVED, WHETHER SHOWN IN
THE PLANS OR DESIGNATED IN THE FIELD. CONTRACTOR SHALL
BECOME FAMILIAR WITH AND CONFORM WITH ALL TREE
PROTECTION/PRESERVATION PROVISIONS OF THE CONTRACT
DOCUMENTS AND LOCAL GOVERNMENT.
12. ALL WORK SHALL BE OPEN TO AND SUBJECT TO INSPECTION
BY AUTHORIZED PERSONNEL OF THE CITY, COUNTY, OWNER,
INVOLVED UTILITY COMPANIES, PROJECT ENGINEER AND
REGULATORY AGENCIES.
13. CONTRACTOR SHALL STAKE ALL IMPROVEMENTS USING THE
PLAT. CONTRACTOR SHALL CONFIRM WITH THE ENGINEER THAT
THE PLAT IS CURRENT PRIOR TO CONSTRUCTION. IT IS THE
CONTRACTOR'S SOLE RESPONSIBILITY TO COMPLETELY STAKE
AND CHECK ALL IMPROVEMENTS TO ENSURE ADEQUATE
POSITIONING, BOTH HORIZONTAL AND VERTICAL PRIOR TO THE
INSTALLATION OF ANY IMPROVEMENT.
14. CONTRACTOR SHALL CONFIRM COMPATIBILITY OF PIPE SLOPES
AND INVERTS DURING SHOP DRAWING AND MATERIALS
ORDERING PHASE OF PROJECT AND ADVISE ENGINEER OF ANY
DISCREPANCIES.
15. CONTRACTOR SHALL FURNISH OWNER WITH ACCURATE i
RECORD DRAWINGS SHOWING AS -CONSTRUCTED HORIZONTAL
AND VERTICAL DIMENSIONING OF THE WORK. THE SUBMITTAL
COPY OF THE RECORD DRAWINGS WILL NOT BE RETURNED. THE
RECORD DRAWING OR A REPRODUCIBLE COPY PREPARED BY
ENGINEER FROM CONTRACTOR'S SUBMITTAL SHALL BE
CERTIFIED BY THE CONTRACTOR AS CORRECT. ALL
INFORMATION WHICH IS UNCHANGED AND CURRENT SHALL BE
NOTED BY CHECKING OFF OR CIRCLING. ALL REVISED
INFORMATION SHALL BE CROSSED THROUGH AND NEW DATA

16. AS -BUILT DRAWINGS AND/OR RECORD DRAWINGS, AS REQUIRED

BY DIMENSIONING AND/OR ACCURATE PLOTTING. THEY SHALL
NOT PROVIDE LOCATIONS SOLELY BY COORDINATE POINTS. ALL
